Dear Mr. Villari:
On February 5, 2020, Brian Lambe from the Wilmington Regional Office of the Division of Energy,
Mineral, and Land Resources (DEMLR), conducted a compliance evaluation inspection for S & J Villari
Livestock WWTF located in 982 Penny Branch Road, Warsaw, Duplin County, North Carolina. The site
drains to an unnamed tributary to Turkey Creek, which is currently classified as Class C, Sw Waters in the
Cape Fear River Basin.
The following observations were noted during the DEMLR inspection (please see the attached
addendum for additional information about your permit):
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has not been developed, recorded, and properly
implemented.

Other Observations:
Animal waste trailed from the loading dock to the road. Refrigerant leak in the back of the building.
Many drums of various materials were not in containment.

of the NPDES Stormwater General Permit may be subject to a civil penalty assessment of up to
$25,000.00 per day for each violation. You are directed to schedule a re -inspection immediately. If you

Inspection Summary
Upon arrival, there was and animal waste debris (blood) trail on Penny Branch Road and into the parking lot, leading to the
loading bay of waste product.
Met with site supervisor, Matt Jones, and Gerald M. of Facility Maintenance. Gerald did not have the SPPP or monitoring
records onsite. We discussed the blood trail and they began clean up of the trail, but did not remove material,only covered
with gravel.
Facility inspection revealed several containers that need secondary containment. A refridgeration leak yeilded ammonia
waste on the back of the property. Separation of stormwater and wastewater is very tight in the middle of the facility.

Comment. Permit and CDC was not available during inspection. The outfall is located behind the building to
th North west of the wastewater pond to a stream. No evidence could be produced of facility
