This Certification allows you to use Nationwide Permit Number 14 when issued by the US Army Corps of Engineers. If you change your project, you must notify the Division in writing and you may be required to submit a new application for a new Certification. If the property is sold, the new owner must be given a copy of the Certifications and approval letter and is thereby responsible for complying with all conditions. If total wetland fill for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506(h). For this approval to be valid, you must follow the conditions listed in the attached Certifications and the additional conditions listed below: As-built plans and the attached Certificate of Completion (COC) must be submitted to the Division upon final construction of the road crossings. 2. This project must be constructed and maintained in compliance with the Randleman Lake Water Supply Watershed Regulations. Specifically, 15A NCAC 02B .0250(5)(a), (b), and (c) state the following: • "Sheet flow must be maintained to the maximum extent practical through dispersing concentrated flow and re-establishment of vegetation to maintain effectiveness of the riparian area", • "Concentrated runoff ...must be dispersed into sheet flow before the runoff enters Zone 2 of the riparian area...", and • " Periodic corrective action to restore sheet flow shall be taken by the landowner if necessary to impede the formation of erosion gullies which allow concentrated flow to bypass treatment in the riparian area." If you do not accept any of the conditions of this Certification, you may ask for an adjudicatory hearing. You must act within 60 days from the date of receipt of this letter. To request a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, PO Box 27447, Raleigh, NC 27611- 7447. Insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H.0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H.0507(e) and will place this project on hold as incomplete until we receive this additional information. We are requesting (by copy of this letter) that the U. S. Army Corps of Engineers place your project on administrative hold. A. Section 401 Water Quality Certification (1) Additional information regarding the road crossings is necessary for our review. Please submit detailed plans for each crossing. The details (both plan view and profile) must include culvert size and length, headwalls, endwalls, and rip-rap and the linear footage of stream impact or wetland impact associated with each. In addition, please provide this office with evidence that the design and placement of the culverts and associated structures will be conducted in such a manner that they will not result in a dis-equilibrium of the stream bed and banks, adjacent to and upstream and downstream of the crossings. Triangle Lake Road Extension Page 2 (2) Your application states that the stream impacts for two of the proposed crossings equal 150 LF, respectively, and that the Division does not require stream mitigation for impacts less than or equal to 150 linear feet. This is incorrect. Compensatory mitigation is required for stream impacts equal to or greater than 150 linear feet. Your mitigation proposal is insufficient since none was proposed. (3) If it is determined through a DWQ site visit that the road crossings are proposed to occur on the same tributary, the impacts of both crossings will be considered cumulative and mitigation would be required if the sum impact of both crossings was equal to or greater than 150 LF. (4) Will there be associated (direct or indirect) development of the adjoining properties as a result of this road collector? Please explain if construction of this road will provide the only access for the adjoining properties, such that, development of those lots could not occur without this road. If this is not the case, submit documentation that adjoining lot developments are not directly or indirectly associated with your proposed project. B. Randleman Lake Water Supply Watershed (1) Your plan shows an impact to Zone 2 of the Randleman Lake Water Supply Watershed Riparian Area. It appears that this is an activity that would require a minor variance. Your application included a letter from CPT Engineering and Surveying, Inc., which states that the City of High Point Technical Review Committee and the Watershed Review Committee have approved this plan. Please submit any documentation from the City of High Point regarding this matter. (2) Please submit detailed plans, preferably at a scale larger that 1:300, showing the location of the road with respect to all protected riparian areas, Zone 1 and Zone 2, streams and wetlands. The proposed project consists of construction of a minor thoroughfare road (Triangle Lake Road Extension). The proposed Triangle Lake Road Extension begins at Kivett Drive and runs approximately 3300 feet north to the proposed point of connection with Sherrill Street. Please refer to the attached map (Figure 1) for the location of the proposed road on a USGS topographic quadrangle. The wetlands and jurisdictional waters within the proposed road extension corridor were delineated by another consultant. The Randleman Lake Watershed riparian buffers shown on the attached impact map were identified by CPT Engineering and Surveying, Inc., as per the Environmental Management Commission (EMC) approved High Point Development Ordinance. Road crossing 1 will impact 150 linear feet of stream channel approximately 3 feet in width and an adjacent wetland, resulting in 0.041 acre (1783 square feet) of wetland and stream channel impacts. Road crossing 2 will impact 150 linear feet of stream channel approximately 5 feet in width (746 square feet, 0.02 acre). Both tributaries are subject to the Randleman Lake Watershed riparian buffers. Approximately 13,532 square feet of riparian buffer will be impacted by road crossing 1, and approximately 17,028 square feet of riparian buffer will be impacted by road crossing 2. In addition, Triangle Lake Road Extension will impact 91 square feet of Zone 2 of the riparian buffer (see "Impact 3" on attached impact map). Please note that 0.021 acre (927 square feet) of wetland was previously impacted within the proposed Triangle Lake Road Extension corridor under Non-reporting Nationwide Permit 39 (see attached impact map). The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the thresholds for notification (0.10 acre) or if a discharge causes the loss of any open waters. It is important to note that portions of the alignment and the connection points of Triangle Lake Road Extension to the existing Triangle Lake Road (to the south) and Sherrill Street (to the north) are generally fixed based on their presence on the City of High Point's thoroughfare plan (see City of High Point Thoroughfare Plan document, attached). The applicant requested a detailed delineation of wetlands present on property prior to site plan development in order to avoid jurisdictional wetlands to the maximum extent practical. However, two unnamed tributaries of the Deep River separate Triangle Lake Road and Sherrill Street, making it necessary to impact these stream channels with road crossings to construct Triangle Lake Road according to the thoroughfare plan. The applicant has attempted to cross streams as close to 90 degrees as possible, and has met with the City of High Point on numerous occasions in an effort to arrive at road design specifications that will minimize road crossing impacts (see CPT Engineering letter, attached). The total cumulative impacts of this project to wetlands and waters of the U. S. (including previous impacts to 0.021 acre of wetland) total 0.062 acre of wetland and 300 linear feet of stream channel. For the reasons listed above and because the total impacts to wetlands and stream channels (0.082 acre) are below the notification threshold, S&EC does not believe further compensatory mitigation should be required for this project. NC-DWQ's current policy does not require stream channel or wetland mitigation for wetland impacts below 1 acre and stream channel impacts less than or equal to 150 linear feet per tributary. Because the cumulative impacts to wetlands, excluding stream channel impacts, (0.062 acre) are below the aforementioned threshold and neither of the proposed road crossings exceed 150 linear feet of stream channel impact, S&EC believes that wetland and stream channel mitigation should not be required by DWQ. As discussed above, the applicant has attempted to cross stream channels as close to 90 degrees as possible given that the proposed road's connection points were predetermined May 17, 2001 S&EC Project #: 01-6063 Page 3 and a minimum road curve radius was specified by the City of High Point (see CPT Engineering letter of justification, attached). Road crossing 1 will impact 13,532 sq. ft. (0.311) acre of riparian buffer and 150 linear feet of stream channel. Road crossing 2 will impact 17,028 square feet (0.391 acre) of riparian buffer and 150 linear feet of stream channel. As discussed in the attached CPT Engineering letter of justification, the applicant has been unable to avoid 91 square feet of non-perpendicular impact to Zone 2 of the riparian buffer south of the connection point with Sherrill Street. The applicant has met with the City of High Point on numerous occasions to agree upon the proposed, reduced centerline radius of Triangle Lake Road Extension, which has greatly reduced the original design's impacts to streams and riparian buffers (see CPT Engineering letter of justification, attached). Moving the road surface beyond Zone 2 of the buffers will require reducing the curve radius of the road below the allowable limits. The City of High Point will not allow further reduction of the radius, due to motorist safety concerns. Martin President ?0 WAT??Q Pre-Construction Notification (PCN) Application Form For Section 404 and/or Section 10 Nationwide, Regional and General Permits, Section 401 General Water Quality Certifications, and Riparian Buffer and Watershed Buffer Rules This form is to be used for projects qualifying for any of the U.S. Army Corps of Engineers' (USACE) Nationwide, Regional or General Permits as required by Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act, and for the North Carolina Division of Water Quality's (DWQ) associated General 401 Water Quality Certifications. This form is also to be used for any project requiring approval under any Riparian Buffer Rules implemented by the N.C. Division of Water Quality. This form should not be used if you are requesting an Individual 404 Permit or Individual 401 Water Quality Certification. The USACE Individual Permit application form is available online at http://www.saw.usace.army.mil/wetlands/Pei-m app.htm. The USACE is the lead regulatory agency. To review the requirements for the use of Nationwide, Regional or General permits, and to determine which permit applies to your project, please go to the USACE website at http://www.saw.usace.army.mil/wetlands/regtour.htm, or contact one of the field offices listed at the end of this application. The website also lists the responsible project manager for each county in North Carolina and provides additional information regarding the identification and regulation of wetlands and waters of the U.S. The DWQ issues a corresponding Certification (General or Individual), and cannot tell the applicant which 401 Certification will apply until the 404 Permit type has been determined by the USACE. Applicants are encouraged to visit DWQ's 401/Wetlands Unit website at http://h2o.enr.state.nc.us/ncwetlaiids to read about current requirements for the 401 Water Quality Certification Program and to determine whether or not Riparian Buffer Rules are applicable. The applicant is also advised to read the full text of the General Certification (GC) matching the specific 404 Permit requested. In some cases, written approval for some General Certifications is not required, provided that the applicant adheres to all conditions of the GC. Applicants lacking access to the internet should contact DWQ's Central Office in Raleigh at (919) 733-1786. Trout Waters Coordination - Special coordination with the North Carolina Wildlife Resources Commission (NCWRC) is also required for projects occurring in any of North Carolina's twenty-five counties that contain trout waters. In such cases, the applicant should contact the appropriate NCWRC regional coordinator (listed by county on the last page of this application). Page 1 of 12 CAMA Coordination - If the project occurs in any of North Carolina's twenty coastal counties (listed on the last page of this application) the applicant should also contact the North Carolina Division of Coastal Management (DCM) at (919) 733-2293. DCM will determine whether or not the project involves a designated Area of Environmental Concern, in which case DCM will act as the lead permitting agency. In such cases, DCM will require a Coastal Area Management Act (LAMA) Permit and will coordinate the 404/401 Permits. USACE Permits - Submit one copy of this form, along with supporting narratives, maps, data forms, photos, etc. to the applicable USACE Regulatory Field Office (addresses are listed at the end of this application). Upon receipt of an application, the USACE will determine if the application is complete as soon as possible, not to exceed 30 days. This PCN form is designed for the convenience of the applicant to address information needs for all USACE Nationwide, Regional or General permits, as well as information required for State authorizations, certifications, and coordination. Fully providing the information requested on this form will result in a complete application for any of the USACE Nationwide, Regional or General permits. To review the minimum amount of information that must be provided for a complete PCN for each USACE Nationwide permit, see Condition 13, 65 Fed.Reg. 12893 (March 9, 2000), available at http://www.saw.usace.anny.mil/wetlands/nwpfinalFedReg.pdf. Processing times vary by permit and begin once the application has been determined to be complete. Please contact the appropriate regulatory field office for specific answers to permit processing periods. 401 Water Quality Certification or Buffer Rules - All information is required unless otherwise stated as optional. Incomplete applications will be returned. Submit seven collated copies of all USACE Permit materials to the Division of Water Quality, 401/Wetlands Unit, 1650 Mail Service Center, Raleigh, NC, 27699-1650. If written approval is required or specifically requested for a 401 Certification, then a non-refundable application fee is required. In brief, if project impacts include less than one acre of cumulative wetland/water impacts and less than 150 feet cumulative impacts to streams, then a fee of $200 is required. If either of these thresholds is exceeded, then a fee of $475 is required. A check made out to the North Carolina Division of Water Quality, with the specific name of the project or applicant identified, should be stapled to the front of the application package. For more information, see the DWQ website at http://h2o.ehnr.state.nc.us/ncwetlands/fees.htrnl. The fee must be attached with the application unless the applicant is a federal agency in which case the check may be issued from a separate office. In such cases, the project must be identifiable on the U.S. Treasury check so that it can be credited to the appropriate project. If written approval is sought solely for Buffer Rules, the application fee does not apply, and the applicant should clearly state (in a cover letter) that only Buffer Rule approval is sought in writing. Wetlands or waters of the U.S. may not be impacted prior to issuance or waiver of a Section 401 Water Quality Certification. Upon receipt of a complete application for a 401 Certification, the Division of Water Quality has 60 days to prepare a written response to the applicant. This may include a 401 Certification, an on-hold letter pending receipt of additional requested information, or denial. The applicant reauested a detailed wetland delineation of wetlands prior to site plan development in order to avoid jurisdictional wetlands and waters of the U.S. to the maximum Page 7 of 12 extent practical It is important to note that portions of the alignment and the connection points of Triangle Lake Road Extension to Triangle Lake Road (to the south) and Sherrill Street (to the north are generally fixed based on their presence on the City of High Point's thoroughfare plan. Two unnamed tributaries to the Deep River and a wetland adjacent to one of these channels separate Triangle Lake Road and Sherrill Street, making it necessary to impact these areas with road crossings in order to construct the extension according to the thoroughfare The applicant has attempted to cross streams as close to 90 degrees as possible, and has met with the City of High Point on numerous occasions in an effort to arrive at road design specifications that minimize road crossing impacts. In fact the centerline radius of the proposed road has been reduced substantially from the radius of the original design in order to minimize impacts to stream channels and riparian buffers. Please refer to the CPT Engineering letter of justification (attached) for further explanation of alignment constraints that necessitate impacts to jurisdictional areas VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at httl2://h2o.enr.state.ne.us/ncwetlaiids/strm,gide.html. 1. Sherrill Street is to be improved to a 3 lane cross-section and the intersection with Dillon Road is to be reworked to allow the Triangle Lake Road Extension to be the through street with ?Dillon Road to the north and to create a stop condition with Dillon Road to the West. This is a requirement of the zoning conditions and the Triangle Lake Road Extension is shown on the official City of High Point Thoroughfare Plan adopted by the City of High Point City Council in May 1989 as a minor thoroughfare. The original design of Triangle Lake Road Extension called for the road to be designed using the design guidelines for a minor thoroughfare. These guidelines call for a minimum of a 955 feet centerline radius. The original design resulted in approximately 1,200 feet of stream and buffer impacts. After numerous meetings with the City of High Point Transportation and Engineering ,epartments, it was decided that the road was to be designed using the design criteria of a minor thoroughfare and the minimum radius requirements of a collector street. The minimum centerline radius of a collector street is 765 feet. Using this design criteria and meeting the original planimetric requirements to connect Dillon Road with Triangle Lake Drive resulted in unacceptable stream and buffer impacts. It was finally concluded that a 550 foot minimum radius would be acceptable. This is the absolute smallest radius that could be used without endangering the motorist. As a result of these meetings and design changes we have developed an alignment that meets the trarsportation requirements of the public with the least impacts on the existing streams and stream buffers. The small buffer impact just south of Sherrill Street is a result of the minimum radius requirement and cannot be eliminated without reducing the radius. Again, minimum radius requirements have required the stream crossings to be slightly less than ninety degrees. 'n conclusion, this plan has been studied and revised numerous times and an alignment has been developed that,meets the traffic needs for the City of High Point with a minimum of impacts to the existing streams. The plan has been approved by the High Point Technical Review Committee and the Watershed Review Committee as required in Chapter 7, Environmental Regulations - Watershed Protection Overlay Districts, of the High Point Zoning Ordinance. Insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional information. We are requesting (by copy of this letter) that the U. S. Army Corps of Engineers place your project on administrative hold. A. In addition, please provide this office with evidence that the design and placement of the culverts and associated structures will be conducted in such a manner that they will not result in a dis-equilibrium of the stream bed and banks, adjacent to and upstream and downstream of the crossings. This is incorrect. Compensatory mitigation is required for stream impacts equal to or «reater than 150 linear feet. Your mitigation proposal is insufficient since none was proposed. (3) If it is determined through a DWQ site visit that the road crossings are proposed to occur on the same tributary, the impacts of both crossings will be considered cumulative and mitigation would be required if the sum impact of both crossings was equal to or greater than 150 LF. (4) Will there be associated (direct or indirect) development of the adjoining properties as a result of this road collector? Please explain if construction of this road will provide the only access for the adjoining properties, such that, development of those lots could not occur without this road. If this is not the case, submit documentation that adjoining lot developments are not directly or indirectly associated with your proposed project. B. Randleman Lake Water Supply Watershed (1) Your plan shows an impact to Zone 2 of the Randleman Lake Water Supply Watershed Riparian Area. It appears that this is an activity that would require a minor variance. Your application included a letter from CPT Engineering and Surveying, Inc., which states that the City of High Point Technical Review Committee and the Watershed Review Committee have approved this plan. Please submit any documentation from the City of High Point regarding this matter. (2) Please submit detailed plans, preferably at a scale larger that 1:300, showing the location of the road with respect to all protected riparian areas, Zone 1 and Zone 2, streams and wetlands. Show the extent of all fill slopes and any proposed re-vegetation plans for any disturbance of Zone 2. Triangle Lake Road Extension Page 3 (3) Even though road crossings are an allowable activity within the Randleman Lake Water Supply Watershed, you must demonstrate, as stated in 15A NCAC 02B .0250 (2)(e), that the project shall be (or will be) located, designed, constructed and maintained to have minimal disturbance, provide maximum nutrient removal and erosion protection, have the least adverse effects on aquatic life and habitat, and protect water quality to the maximum extent practical through the use of best management practices. Please address these issues in your response. (4) Please provide documentation regarding the management of the stormwater from this project. Please keep in mind that diffuse flow must be provided through the buffer zones and temporary sediment and erosion control measures cannot be located within Zone 1.
