APPROVAL of 401 Water Quality Certification
Dear Mr. and Ms. Johnson:
You have our approval, in accordance with the attached conditions, to place fill in 0.011 acre and incorporate 0.012
acre of non-vegetated wetlands in order to extend an existing bulkhead, add riprap to protection for the bulkhead, and
construct a pier, platform, floating dock and boatlift adjacent to your property in Pender County, as described in your
application received by the Division of Water Quality on May 16, 2001. After reviewing your application, we have
determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use
your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other
federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying
CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application for a new certification. If the property is
sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in
the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

9. )PROJECT DESCPJaMON:
The project site is located at 1222 Shoreline Drive, within the Town of Topsail. Beach. The
property is located adjacent to Topsail Sound / Banks Channel and is located within the Inlet
Hazard area of New Topsail Inlet. The property is an undovelopod residential lot and is the last
residential lot on the south end of Topsail Island.
The existing lot measures approximately 48' wide by approximately 97' deep, or approximately
5,000 sq. ft.. The elevation of the property averages approximately 3' above normal high. Water
(1 HW). Man-made features on the property include a septic tank, a failing wooden bulkhead,
a partially completed vinyl sheatpile bulkhead, and scattered concrete paver stones. Tlie property
is bounded on the northeast by an existing, develpped residential lot and on the narthwest and
southwest by the waters of topsail sound. During high tide the waters of topsail sound extend to
within approximately 25' of the pavement at the cul-de-sac end of Shoreline Drive at the
applicant's western property line. Due to rapid shoaling and erosion, the NNW line at this location
can change rapidly. On November 20, 2000, the applicant recKved authorization to replace the
existing, failing bulkhead on the property with a new bulkhead which would extend an average
of two feet waterward of the existing structure. Approximately 4$' of this hulkhead was
completed on the l3ankn Channel side of the property.
The waters of Topsail are classified "SA" by the Division of Water Quality. The waters of the
Atlantic Ocean are classified "S$". The area is not designated as a Primary Nursery Area by the
Division of Marine Fisheries and is open to the taking of shellfish.
The applicant is proposing to complete the bulkhead along the southwest side of the property. The
bulkhead would measure approximately 96 linear feet and would extend approximately 8'
waterward of the existing bulkhead on the Banks Channel side of the property and taper back into
the existing bulkhead at the intersection of the property line with Shoreline Drive. The bulkhead
would average approximately 5' waterward of NRV along its length. The new bulkhead would
follow the recorded property fine. There are no Coastal Wetlands present along the bulkhead
alignment, At the base of the bulkhead, the applicant is proposing to place riprap for toe scour
protection. The riprap would be placed at a 1:1 slope and would extend approximately 3'
waterward of the bulkchead for its end{re length.
The applicant is also proposing to construct a pier, boatlift, floating dock and platform into the
waters of Banks Channel. These structures would all be located adjacent to the existing bulkhead
and in line with each other. The pier would measure 4' wide by 16' long and would be located
15' from the northeastern property line. The boat lift would measure 16' long by 12' wide and
would be located directly adjacent to and to the southwest of the pier. Next to the boat lift the
platform would measure IT wide by 16' long and the floating dock would measure 8' wide by
12' long ending near the southwestern property line. Water depths at the waterward end of all the
structures would be approximately -12' at normal biigh water.

The construction of the bulkhead would result in the filling of approximately 355 sq. ft. of shallow
bottom area averaging approximately 3' deep at NHW, The placement of riprap will result in the
filling of an additional 126 sq. ft. of shallow bottom. The installation of the dead marl arad tie
back system for the bulkhead will result in the disturbance of 1,920 sq, ft. of high ground arm.
The proposed pier, boat lift, floating dock and platform will result in the incorporation of
approximately 544 sq. fl. of Public Trust Area. Although the NHW shoreline in this area can
change rapidly, the applicant currently has approximately 119 linear feet of shoreline. As of
August 1, 1998, under individual permits, "T"s, finger piers, platforms, and decks must not
exceed a combined total area of 4 Sq, ft, per linear foot of shoreline, unless necessary fior We use
or to support a water dependent use that cannot otherwise occur. The proposed platform, floating
dock and finger pier will have a combined square footage of 352, which in leas than the total of
476 sq. ft. allowed under the 4 sq. ft. mile. The applicant currently does not have a signed waiver
from the 15' setback from the adjacent property owner to the southwest. Minor increases in
turbidity can expected during construction.

On June 20M,-2000 we purchased a lot on Shoreline Or., Topsail Beach, NC.
(Lot T i - Block 4 -- Sixth Sub-Division of Topsail Beach - Map 13 - P 62)
We purchased the lot from Lany P. & Audery C. McCullen.
The lot was sold as and purchased as being ioo X 55 A All available plot
plans and maps had the dimensions as being 10oX 55It After we purchased
the lotl obtained a permit and began construction ara new sea wall to
replace the exisfinglFailing sea wall. The permit allowed the new wall to be
buff two (2) feet out ifmm the old existing wall.
it was not until the Marine Contractor was completing the new wall across
the 155" ft end swan of the lot that we discovered the old sea wall had
been built at ON and not 55ft which is the actual property line.
We have halted construction and 1 am now applying far a permit that will
allow me to extend the new see wall the (7) ft needed to MaCh the actual
properly titre, making the lot 100 X 55ft.
There is reason for urgency in getting this project completed due to the
fact that where the contractor had to remove some of the existing riprap
in order for him to install the new wall, the sand is beginning to wash
away. This will be stabilized by adding more riprop when the new wall
is completed
Since 1 plan to construct a home (my permanent residence) on this lot it
is very important that I be allowed to recoup the pMpetiy to the full size
of the lot
l am also applying for a permit to construct a 12 X 10 ft deck, an 8 X 12 it
floating dock, a boat lift and a 4 X 16 ft finger pier as indicat+ad on the
enclosed drawings.
An construction wfil be performed according to code by a licensed Marine
Contractor.

of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require that you

notice in writing before a permit for development can be
issued.

storms and erosion. Permits issued for development inthis
area expire on December M of the third year following the
year in which the permit was issued. Shortly before work
begins on the project site, the Local Permit Officer will
determine the vegetation line and setback distance at your
site. If the property has seenlittle change and theproposed
development can still meet the setback requirement, the
LPO will inform you that you may begin work. It is impor-
tant that you check with the LPO before the permit expires
for official approval to continue the work after the permit
has expired, Generally, if foundation pilings have been
placed and substantial progress is continuing, permit
renewal may not be necessary. If substantial progress has
not been made, the permit must be renewed and a new
setback line established. It is unlawful to continue work
after permit expiration without this approval.
