Existing conditions on the site consist primarily of forested land and agricultural land. A perennial stream bisects the property with an intermittent stream and adjacent wetlands
intersecting midway through the property. Additionally, a perennial stream bounds the northwest property. The general land use in the vicinity of the project is predominantly residential
and some forestry.

The purpose of this project is to construct infrastructure for a residential development.

The overall project consists of the construction of a single-family residential development, including but not limited to roads, utilities, residential structures, and storm water devices.
Specifically, there is one (1) road crossing that impacts a stream and riparian buffers and one (1) sanitary sewer crossing that impacts a stream, wetland, and riparian buffers.
Equipment to be used will include excavators, bull dozers and other typical equipment used for land clearing, construction and excavating.

E. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
S&EC completed a wetland delineation and Neuse River Buffer evaluation for the entire property in order to identify natural resources so that impacts
could be avoided and minimized to the maximum extent practicable. Impact #1 is proposed road crossing to a perennial stream. Proposed impacts
include permanent (culvert), permanent -no permanent loss (dissipator), and temporary (construction corridor) stream impacts and riparian buffer
impacts. This road crossing is necessary to access the east and west sides of the property. Impacts have been avoided by locating the road crossing
on the north side of the project to avoid crossing both stream B & C, and by avoiding the linear wetlands W4 & W5. Headwalls have been utilized to
minimize stream and riparian buffer impacts. Impact #2 is a proposed Force Main and Water line crossing and connection. Proposed impacts include
permanent -no permanent loss wetland (permanent maintenance corridor) and temporary wetland (construction corridor) impacts, temporary stream
impacts (open -cut) and riparian buffer impacts. This utility crossing is necessary to provide sanitary sewer and water to the proposed residential
development. This connection location was set, impacts were minimized to the maximum extent practicable by designing the crossing at a near
perpendicular angle and by combining and utilizing a 30' easement for two utilities. Temporary wetland impacts will be brought back to pre -
construction contours and the existing adjacent wetland source will assist in the restoration of the wetland vegetation. Temporary stream impacts will
be brought back to pre -construction stream bed elevations and the stream banks will be stabilized.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Per the project engineer, Pump around, coffer dams, and silt fencing will be utilized.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document
prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause
cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural
and silvicultural operations. The Sugg Property project is a small residential development. Additionally, the project is located within the town of
Fuquay-Varina ETJ, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream
waters: 1) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area,
in addition Best Management Practices may be required that control nitrogen if diffuse flowcannot be achieved; and 2) the Phase II NPDES
Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -
construction stormwater management requirements. We anticipate that the DWR will advise us if any additional information is needed.

S&EC completed a Threatened & Endangered Species Report, to include a Self -Certification letter through the US Fish & Wildlife Service, a query
through the NC Natural Heritage Program database, and an Official Species List through IPac. A formal request was sent to the USFWS on February
11, 2020. We have not received response back from USFWS. Please see attached report.
