APPROVAL of 401 Water Quality Certification
Dear Mr. and Mrs. Humphrey:
You have our approval, in accordance with the attached conditions, to place fill in 0.093 acre of wetlands in order to
construct a single family dwelling on Lot 28, Block A, Chadwick Shores subdivision in Onslow County, as described in your
amended application received by the Division of Water Quality on July 26, 2001. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3106, which can also be viewed on our web
site at http://h2o.enr.state.nc.us/ncwetlands. This Certification allows you to use Nationwide Permit 18 when the US Army
Corps of Engineers (USACE) issues it. In addition, you should get any other federal, state or local permits before you go
ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge
and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter-and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

Dear Mr. Dorney:
In response to your letter of June 26, 2001 in regards to the above referenced project, I submit
the following information for your review.
The Humphreys have made every effort to minimize the impact of wetlands on this property. They
had originally pursued the placement of their dwelling, adjacent to Fullard Creek and on the
uplands. However, placement of a dwelling between the 30' CAMA Buffer and the permitted
septic area, does not allow sufficient space for a dwelling, decks, porches or driveway. Also,
access to this upland would need to negotiate around the only suitable septic area. In conclusion,
this upland area does not provide adequate spacing for residential construction.
The only alternative was to build on the uplands adjacent to the street. Therefore, the Humphreys
approached the Chadwick Shores Homeowners Association and requested permission to encroach
within the 75' setback. The Association has agreed for the Humphreys to encroach 17' within this
setback. The original plot plan illustrates this location.
It is our opinion; the location of the proposed dwelling as shown on the original plot plan, is the
only available alternative. This alternative does minimize the impact of wetlands to 0.093 acres.

On May 15, 2001, the NC Division of Water Quality (DWQ) received your application for a 401 Water Quality
Certification to impact 0.10 acre of wetlands for residential construction in Onslow County. In accordance with 15A NCAC
2H .0506, a thorough inspection of the site has been conducted by Ms. Joanne Steenhuis of the DWQ Wilmington Regional
Office. Based on this review, along with your application materials, we have determined that insufficient evidence has been
provided to conclude that your project must be built as planned. Specifically, please investigate whether the following
avoidance measures can be taken:
• Can the residence be placed on either of the upland sections of the property? Please provide evidence that you
have investigated upland alternatives in your site plan.
Unless modifications of the proposal are made, or compelling evidence is provided to demonstrate the avoidance and
minimization of wetland impacts, we will move toward denial of the 401 Certification as required in 15A NCAC 2H .0507(e).
Until the information requted in this letter is provided, I will request (by copy of this letter) that the Corps of Engineers -
place this project on hold. Als , this project will be placed on hold for our processing due to'incomplete information (15A
NCAC 2H .0507(h)).

010712 - (Madison Co., DOT) the affected waterway, Paint Fork, is WS-II. Road crossings are
allowed assuming no practical alternatives, and bua must be minimized, stormwater must be
diverted away from surface waters, and DOT must use/follow their BMPs document.
010691 - (Mitchell Co., DOT) no WSWP impacts, but Roaring Branch is C Tr.
010678 - (Durham Co., Triangle WWTP) the project is within WS-IV Haw River (Jordan Lake).
Kick it to Durham Planning Dept. for enforcement of BUA requirements. Crossings ok, assuming
no practical altematives, and bua must be minimized, stormwater diverted, BMPs for water quality
used.
010666 - (Clay Co., DOT) the project is not is WS waters, but it's in Tr.
010637 - (Granville Co., John Braddy) the project is within WS-II NSW. Kick it to Butner Planning
Dept. for enforcement of BUA requirements. Crossings ok for public projects, assuming no
practical alternatives, and bua must be minimized, stormwater diverted, BMPs for water quality
used. Since it's a private project, then road pavement must be included in the total bua and
crossings not ok without a variance.
010630 - (Watauga Co., Wetland and Natural Resource Consultants, Inc.) not is WS waters, but it's
within TR HQW.
010628 - (Stanly Co., Gerald Goodman) The project is within the Lake Tillery WS-IV-CA. Kick to
local planning department (Norwood?) for review of bua and buffer compliance. The state
minimum for WS-IV projects is that the WSWP rules don't apply to projects not needing a SEC
plan, but local gov't can be more protective. If SEC plan is needed, must comply with bualbuffer
requirements.
010626 (S&EC Consultants, Inc., Iredell Co.) - the site is most likely in the WS-IV-CA of Lake
Norman. No new roads in CA to the extent practicable; if allowed must minimize bua, divert
stormwater, use BMPs. Private roads must be included in the bua calculations. The state
