DWQ ID: 010726 Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject pre-construction notification. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), and North Carolina General Statutes (G.S. 113-131 et seq.). Applicant proposes to relocate a stormwater retention pond and an unnamed tributary to Big Branch to allow for expansion of the quarry. The relocation will impact 250 linear feet (10 of stream, while 1000 if will be created by the relocation. Big Branch is a tributary of Walnut Creek and is within the Neuse River basin. We concur with the proposed project. However, we recommend that the process involve restoring as much of the natural geomorphic dimension, pattern, and profile of the stream as possible and that bioengineering methods are utilized. Additionally, a minimum 50-foot undisturbed, forested buffer should be maintained along all intermittent streams and wetland areas, while a minimum 100-foot undisturbed, forested buffer should be maintained along all perennial streams within the project area. Maintaining undisturbed, forested buffers along these areas will minimize impacts to fish and wildlife resources, water quality, and aquatic habitat both within and downstream of the project area. In addition, wide riparian buffers are helpful in maintaining stability of stream banks, for treatment of pollutants associated with urban stormwater, and provide continuous travel corridors for wildlife. A small non jurisdictional stormwater retention pond and several hundred feet of jurisdictional stream need to be relocated to allow for expansion of an adjacent quarry. On October 19, 2000, we met Mr. Todd Tugwell of the Corps of Engineers at this site to discuss the project and to get his ideas on options for construction. Based on his suggestion, we have moved the proposed stormwater retention pond upstream to allow for more jurisdictional stream to be created by the pond overflow. Our pit discharges to this pond and a consistent flow out of the pond created a rather nice unnamed tributary to Big Branch. Mr. Tugwell determined the existing stormwater retention pond to be non jurisdictional, as is the pit discharge ditch located above the pond. The receiving stream below the pond was considered as jurisdictional. Trees will be planted along the channel at a spacing of 8-feet on center on 3 rows each side of the channel. The rows will be spaced 6-feet apart. 3. Trees will be planted along the shore of the proposed stormwater retention pond at a spacing of 8-feet on center for 2 rows spaced 6-feet apart. 4. Trees used will be from the North Carolina Division of Forest Resources and will be from the Environmental East Package. This would include Loblolly, White Pine, Longleaf, Eastern Red Cedar, Southern Wax Myrtle, Sweetgum, Sycamore Coastal, Baldcypress, Water Oak, Cherrybark Oak and Green Ash. 5. Trees will be planted during the first winter after completion of the project. 6. Bare earth areas will be planted with the recommended seed mix found in the Surface Mining Manual produced by the Land Quality Section. A copy of that seeding schedule is attached.
