Pease International Trade Port 72 Pease BLVD Portsmouth, NM 03801 Dear Sirs: You have our approval, in accordance with the attached conditions and those fisted below, to place fill material 0.42 acres of wetlands and 1800 square feet of stream buffers for the purpose of coratructirg a road crossing and electronic manufacturing facility in Wake County as described in your application dated May 10, 2001 and revised on July 16, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3287 This certification allows you to use Nationwide Permit Number 39 when the Corps of Engineers issues it In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the fixture) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Also, before any permanent building is occupied at the subject site, the facillities (as approved by this Office) stall be constructed and operational, and the stormwater management plan (as approved by this Office) shall be implemented. The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. (Golder), on behalf of Celestica, is responding to your req L or F information on wetland and water quality impact avoidance measures for a proposed ele Wr tcs . manufacturing plant construction project in Wake County. Your comments were prove Rh a N letter dated 6 July 2001. I have restated your comments, with Golder's response imm ctjlkt-ly CO following. 1. Please describe how stormwater will be treated onsite, and include construction drawings o ., your proposed stormwater management facility. The calculations and decision-making process you used to determine the size and the design of your stormwater facility will be helpful in our review. An extended detention wetland is recommended by DWQ in this case. Stormwater from the site will be routed to a detention pond at the lowest point on the property. The detention pond has not been designed in detail yet, but conservative estimates of runoff conditions were employed to insure that the pond footprint as shown on Figure 3 would be sufficient to accommodate a detention pond to handle runoff from the impervious area expansion. The detention pond shown on Figure 3 occupies 1.1 acres. This size is a worst-case estimate derived by assuming that the pond would receive an average of 4000 cubic feet of runoff from the entire 48 acre property. In fact, approximately one quarter of the site (west of the creek) will not drain into the pond. Also, Celestica proposes to route stormwater from the existing developed areas to the pond, although it is our understanding that this is not required. Currently this runoff enters the stream with no detention or treatment through existing storm sewer inlets to the pipe that runs under the site. Celestica's architect is examining whether or not there is sufficient space to accommodate an extended detention wetland. We will contact you by phone to discuss specific calculations and construction drawings' that your unit may require in order to complete the evaluation of the project. 2. The proposed stream crossing is not perpendicular. Please re-design the road crossing so that it crosses the stream at a perpendicular angle, thereby reducing impacts to the maximum extent practical, in accordance with the Neuse Buffer Rules (I SA NCAC 2B. 0233). There is an existing entrance driveway that was originally designed to have a T -junction right at the stream crossing (see Figure 2). Two arms were completed, forming a 90 degree turn on top of the stream. As shown in Figure 3, the proposed driveway extension will join the existing driveway to complete the T as originally planned. This arm of the T will not cross the main stream at all, but will cross (perpendicular) a small wetland ditch that is the outfall of an existing pipe that channels an intermittent stream under the existing manufacturing facility. The total amount of fill for this ditch is approximately 0.01 ac. In surn, no new stream crossing is proposed, and the tie in to the existing driveway configuration minimizes impacts to the greatest extent practical. 3. It appears that a 20 foot landscaped buffer cuts through the Neuse Buffer at the road crossing. Please re-design the road crossing to minimize impacts of the road crossing to 40 feet, as required in the Neuse Buffer Rules (15A NCAC 2B. 0233). As shown on Figure 3, the new proposed driveway extension cuts through a small portion of the Neese buffer area. The total incursion is only 60 linear feet at the edge of the buffer with an average width of 30 feet, resulting in impacts to 600 sq. ft. of Zone I and 1200 sq. ft. of Zone 2. All of this buffer area is currently a lawn. The shoulder of the road will be a maximum of 20 feet wide as dictated by the need to maintain a stable slope for the fill necessary to support the roadbed. Celestica suggests that extending the proposed driveway from the existing driveway minimizes impacts to aquatic resources and the small area of impact to the Neuse buffer is unavoidable. In summary, although the detention area has not been designed in detail, Celestica believes that sufficient detention area has been reserved to accommodate site runoff. Additionally, Celestica suggests that extending the driveway from the existing T -junction minimizes impacts to the stream and the Neuse buffer. We appreciate your attention to this project and look forward to proceeding with Section 401 Water Quality Certification. In accordance with 15A NCAC 2H .0506, a thorough inspection of the site has been conducted by Mr. Steve Mitchell of the DWQ Raleigh Regional Office. Based on this review, along with your application materials, we have determined that insufficient evidence has been provided to conclude that your project must be built as planned. Specifically, please investigate whether the following avoidance measures can be taken, or provide the requested information so that we can complete our review of your proposal: 1. Please describe how stormwater will be treated onsite, and include construction drawings for your proposed stormwater management facility. The calculations and decision-making process you used to determine the size and the design of your stormwater facility will be helpful in our review. An extended detention wetland is recommended by DWQ in this case; 2. The proposed stream crossing is not perpendicular. Please re-design the road crossing so that it crosses the stream at a perpendicular angle, thereby reducing impacts to the maximum extent practical, in accordance with the Neuse Buffer Rules (15A NCAC 2B .0233). 3. It appears that a 20-foot landscaped buffer cuts through the Neuse Buffer at the road crossing. Please re-design the road crossing to minimize impacts of the road crossing to 40 feet, as required in the Neuse Buffer Rules (15A NCAC 213.0233). Until this information is received, I will request (by copy of this letter) that the Corps of Engineers place this project on hold. Also, this project will be placed on hold for our processing due to incomplete information (15A NCAC 2H .0507(h)). Wetland B - Sewer line corridor, small beaver ponded areas, and mixed pine/hardwood riparian forest along an intermittent stream. The impacted portion of wetland B is a vegetated ditch where the previously mentioned piped stream discharges into the main intermittent stream. This wetland will be filled for extension of the existing driveway. 0.01 acres of impact. Wetland C - NOT impacted by the project. Mixed pine/hardwood riparian forest and beaver ponded areas. Wetland D - A grassed drainage swale, adjacent to the existing truck parking area. The bottom of the swale is vegetated with emergent hydrophytes. This wetland will be filled for parking and building expansion. 0.01 acres of impact. The swale drains into a small ponded area at the pipe inlet which is outside of the Celestica property. Nationwide Permit Terms The proposed project meets the terms ofNWP 39: a. The discharge does not cause the loss of greater than %z acre of non-tidal wetland. The project will fill 0.42 acres of wetland b. The discharge does not cause the loss of greater than 300 linear feet of stream bed. The project will not impact the main intermittent stream on the property. All of the impact areas are ephemeral drainageways, described as "unimportant waters" by the Corps of Engineers. Information on known occurrences at the project site has been requested from the U.S. Fish and Wildlife Service and the North Carolina Natural Heritage Program. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete.
