We recommend that the following conditions be included in the State authorization: All work authorized by this permit must be performed in strict compliance with the permit plans, which are a part of this permit. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 3. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. City of Washington Moss Lumber Mill Site Beaufort County Environmental Setting The applicant is the City of Washington which is located in Beaufort County. A portion of the city lies adjacent to both the Tar and Pamlico Rivers. The project site is the old Moss lumber mill site adjacent to and downstream (east) of the North Carolina Estuarium. The tract of land is ±13 acres and is predominately vegetated with upland grasses. Several abandoned buildings are present on the site along with various concrete pads. The shoreline is stabilized with concrete riprap, and a deteriorated pier along with various pilings are present in the Pamlico River. The downstream property to the project site is the current Moss lumber retail sales property. The elevation of the project site is f2' above the normal water level. The City of Washington is presently constructing a storm water wetland collection system in Washington which will terminate in a created wetland on the project site adjacent the Pamlico River. Although this project is within 30' of the Pamlico River, a CAMA permit was not required since the design and implementation of this project began prior to 1 August 2000. Prior to 1 August 2000, the City of Washington had obtained a storm water permit and an erosion control permit as well as an approval certificate from the Division of Water Quality for the Tar/Pamlico buffer rules. The created wetland project includes a berm adjacent the Pamlico River and the existing riprap along the river will be maintained and extended up the slope of the new berm for protection. The maintenance of the existing riprap is considered Statutorily Exempt and does not require a permit from this Division. The Pamlico River at the project site has been classified as SC-NSW by the Environmental Management Commission and is closed to shell fishing. Project Proposal The city of Washington is proposing to construct a 6' wide by ±1,600' boardwalk adjacent the Pamlico River on the previously described berm. The project includes observation platforms of 12' by 12' and a 18' by 24' to be constructed on the berm. The proposed boardwalk will extend over the Pamlico river in two places. One crossing is ±15' long and the other is ±35' long and both will be approximately 6' above the normal water level. In the two sections where the boardwalk is in the river, the applicant proposes to place concrete footings on the pilings. The result is 48 pads with a size of 3' by 3' each for a total of 432 ft2 of fill. The proposed boardwalk will connect to the existing deck at the North Carolina Estuarium on the upstream (west) end and will terminate at Water Street on the downstream (east) end. Environmental Impact The project as proposed will result in the filling of ±432 ft2 of river bottom associated with the placement of the concrete footings on the pilings. Shading of approximately 300 ftz of river bottom will result associated with the construction of the boardwalk over the river in the two sections. Some short term turbidity will result as a result of the piling installation. The upland impact will result in a disturbance of ±9,804 ftz resulting from the construction of the boardwalk and observation platforms on the berm. David W.
