APPROVAL of 401 Water Quality Certification
Dear Mr. Weatherly:
You have our approval, in accordance with the attached conditions, to place fill in 0.26 acre and disturb 0.48 acre of
wetlands in order to construct a community water system in Dare County, as described in your application received by the
Division of Water Quality on April 25, 2001. After reviewing your application, we have determined that this fill is covered by
General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when it is issued
by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you
go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply
Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application for a new certification. If the property is
sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in
the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Project Setting
The project setting involves the village of Stumpy Point and the area known as Lake
Worth which are located on mainland Dare County, along SR 1100 and along US 264. The
proposed project is a community water system which will include wells, a treatment plant,
distribution lines and a discharge line with a diffuser assembly to be located in Stumpy Point
Bay. The site of the water treatment plant is part of a 34 acre parcel owned by Dare County.
The parcel is located on the north side of SR 1100 and approximately 1000 feet east of US
264. Previous development at the site includes a baseball field and a gravel parking area. A
drainage canal cuts through the property north of the ballfield and two feeder ditches are
connected to the canal in the area of the proposed development. The canal drains into Stumpy
Point Bay. A small church building is also located on the property.
The property has been used as a spoil site for past dredging activities in Stumpy Point
Bay. It is mostly a wetland area vegetated with common reed. The shorelines of the canal and
ditches have juncos roemerianus.
The proposed location of the discharge line and diffusers is approximately 400 feet east
of the site of the water plant. The area has a sandy shoreline and an existing riprap shoreline
erosion control system. The bottom of Stumpy Point Bay varies from sandy to silt and sand.
The water depth at the proposed location of the diffuser is approximately -3 feet at normal
water level. The waters of Stumpy Point Bay are classified as SA by the Division of
Environmental Management and are open to shellfish taking.
Development Proposal
The applicant proposes to construct a water treatment plant, a 75,000 gallon elevated
water tank, two wells on the property adjacent to SR 1100 and adjacent to the existing ball
field. The development proposal will require approximately 11,123 square feet of wetland fill
and approximately 26,307 square feet of total land disturbance.
The construction of the proposed 4" discharge pipe will be done by directional bore to
start from the north right of way for SR 1100 and to end 125 feet offshore for a total distance
of approximately 220 feet. The diffuser assembly will be secured to a 3' x 3' x 1 1/2' concrete
anchor that will be buried in Stumpy Point Bay bottomland. Approximately 10 feet of the 4"
line will be exposed on the bottom for the diffuser assembly. The portion of the line running
from the water treatment plant to the start of the directional bore will be trenched along the
north side of SR 1100.
The development proposal includes the installation of approximately 21,000 feet of 6"
and 8" water main supply lines. The main supply line will be trenched along the NCDOT
right of way 3 feet below the edge of the pavement and 5 feet off the shoulder. A directional

bore installation method is proposed at the intersection of US 264 and SR 1100 to allow the
main supply line to cross to the west side of US 264 and under a canal bridge crossing on US
264.
Anticipated Impacts
The proposed construction of the wells, water tank and treatment plant building will
result in approximately 4300 square feet of land disturbance in the Estuarine Shoreline Area of
Environmental Concern (AEC) including approximately 600 square feet of disturbance planned
for an area within 30 feet from the normal water line. Approximately 11,123 square feet of
404 wetlands outside of the AEC will be filled by the project and approximately 22,007 square
feet of total land disturbance outside of the AEC will occur. The trenching for the water main
along the right of way will result in approximately 42,000 square feet of land disturbance by
the trenching machine which includes approximately 16,800 square feet of disturbance in the
Estuarine Shoreline AEC. The placement of the diffuser will result in approximately 30
square feet of bottom disturbance Public Trust Area AEC includes 10 square feet of bottom fill
by the anchor and diffuser line.
Temporary water turbidity will occur during construction. Less than 1% of impervious
coverage in the Estuarine Shoreline AEC is proposed by the development plans.

Dear Mr. Jennings:
Dare County plans to construct a community water system for the Stumpy Point Water and
Sewer District. Included in that plan will be a.080 million gallon per day (MGD) water
treatment plant, elevated storage tank and two wells. These structures will be constructed on a
5.8-acre tract bordered by ditches on the West, North and East and to the South by Stumpy Point
Road, SRI 100 (see site plan Attachment 1). The ditches drain to Stumpy Point Bay, which is
classified as SA waters. In 1998, a baseball field and parking lot were constructed on this tract.
Most of the remaining area in the above mentioned tract was previously filled with dredge spoil
but has since reverted back to wetlands. The tract is part of a 34-acre parcel owned by Dare
County. A copy of the deed can be found as Attachment 2. The water treatment plant, elevated
tank, and wells will require disturbing .6 acres (26,307 SF), of which .26 acres (11,123 SF) will
be wetlands.
In addition to the water treatment site, approximately 21,000 lineal feet of water main will be
installed within five feet of the road in the NCDOT right of way. The DOT encroachment
agreement may be found as Attachment 3. This includes a four-inch discharge line into Stumpy
Point Bay (NPDES permit pending) and a directional bore across a canal just South of the
Highway 264/SR1100 intersection. The overall project will be within the 75 ft. buffer of several
AEC areas. These areas have been delineated on the enclosed AEC map (Attachment 4).
Methods of construction for the 4" discharge line will be to trench along the North side of
Stumpy Point Road to the property now or formerly owned by Truxton Payne. From there,
directional bore under the road and through an easement on the Payne property (Attachment 5) to

the diffuser assembly, which will be located 125 feet from shore in about 3 feet of water. Details
of the directional bore for the discharge line and canal crossing are included as Drawings 1,2,
and 3. The Water Treatment Plant discharge will consist of the backwash from the pressure
filters and the concentrate stream from the reverse osmosis (RO) treatment process located in the
water treatment plant. Projected effluent flows are 4,320 gallons per day (GPD) for the pressure
filters and 38,880 GPD (27 gpm) for the RO process.
A Sedimentation and Erosion Control Plan (Dare-2001-004b) has been approved for the project
(Attachment 6), while a Stormwater Management Permit is being processed. A copy of that
