The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the permit plans, which are a part of this permit. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 3. Box 549 Wanchese, NC, 27981 APPROVAL of 401 Water Quality Certification Dear Mr. Peele: You have our approval, in accordance with the attached conditions, to cover 0.022 acre of wetlands in order to construct a seaplane ramp from an existing building to Broad Creek on Lot 11, Wanchese Seafood Industrial Park in Dare County, as described in your application received by the Division of Water Quality on April 25, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes to construct a seaplane ramp from an existing building to Broad Creek on Lot 11, Wanchese Seafood Industrial Park. NC Seafood Industrial Park Authority Field Investigation Report Page Two Proiect Settin The applicant, the North Carolina Seafood Industrial Park Authority, owns and operates a commercial industrial park located on 54 acres at the end of Harbor Road (SR 1140), Wanchese, Roanoke Island, Dare County. The park has an extensive shoreline that fronts a manmade basin off Mill Landing Creek, Roanoke Sound and Broad Creek. The park was created by filling an existing marsh with spoil material derived from dredging the basin. The property is divided into lots that vary in size and are leased to tenants. Lot 11 is approximately 16,144 sq. ft. in size and is located on the northeast side of Harbor Road and adjacent to Broad Creek. It has an elevation of approximately 6 ft. above normal water level and has sandy soils. The lot is vegetated mostly with yard grasses. The shoreline of Lot 11 has a coastal wetland fringe approximately 35 ft. wide that is vegetated with Spartina altern.iflora along the waterline and Juncus roemerianus. Above the coastal wetland fringe at an elevation of approximately 2 ft. above normal water level is a possible Section 404 wetland fringe vegetated with common reed and grasses. Manmade structures on the property consists of a 48' x 60' metal building with a 6'x 15' shed addition built on a concrete slab. The tenant, Hathaway Marine, operates a mobile marine repair business from the site. The tenant owns a small seaplane and uses it to travel to repair locations. Adjacent property consists of lots of varying sizes and similar physical characteristics used for marine related activities. The waters of Broad Creek are classified as SA by the Division of Environmental Management and are closed to shellfishing. The area of Broad Creek upstream from the proposed development site is classified as a Primary Nursery Area by the Division Marine Fisheries. Development Proposal in order to provide water access for the applicant's seaplane, the applicant proposes to construct a 12 ft. wide and approximately 160 ft. long wooden, ground level ramp to run from the back of the existing building to the adjacent waters of Broad Creek. Approximately 20 ft. of the proposed ramp will be located below the normal water level in Broad Creek at a depth of approximately -3 ft. Anticipated Impacts The construction of the proposed ramp will result in approximately 240 sq. ft. of Broad Creek bottom, Public Trust Area, Estuarine Waters, Areas of Environmental Concern (AEC) NC Seafood Industrial Park Authority Field Investigation Report Page Three being covered by the submerged portion of the ramp. Approximately 420 sq. ft. of Coastal Wetland AEC will be covered by the ramp. Approximately 312 sq. ft. of possible 404 wetlands located in the Estuarine Shoreline AEC will be covered by the ramp. Approximately 168 sq. ft. of upland Estuarine Shoreline will be covered by the ramp and approximately 780 sq. ft. of upland outside the AEC will be covered by the ramp.
