HomeMy WebLinkAboutNC0044750_LV-2020-0039_20200218 February 5, 2020 FEB 1 2020 Case#LV-2020-0039 NCQ 'QrD ,Np® Dear Director, As per the civil penalty assessed to Granite Falls LTC LLC, Jacob's Creek Nursing & Rehabilitation Center we respectfully request a waiver for the penalty based on form "Justification for Remission Request" factor "b". Our Wastewater Treatment Plant uses Sanitron Ultraviolet Purifiers for Effluent disinfection. The Operator in Responsible Charge and maintenance personnel performs maintenance to the UV system as per manufacturer's specifications (see attached form Maintenance). As this is a canister style UV disinfection system, the UV lamps are inspected through a sight glass. This sight glass is inspected daily to ensure proper operation, as per manufacturer's specifications. Upon receiving notification of a NPDES permit limitation exceedance, we promptly contacted Shining Light Electric Services.' After completing a diagnostic test the electrician notified us that even though the UV lamps were working they were only working at 50% intensity due to a faulty UV lamp wiring harness. New parts were ordered and installed (see attached form Invoice). No further permit exceedances as of August 20, 2019. We believe we responded in a timely manner thereby abating any environmental damage. Your cooperation will be greatly appreciated. If you should need any additional information please so advise. You must also complete the "Request For Remission, Waiver of Right to an Administrative Hearing, and Stipulation of Facts"form to request remission of this civil penalty. You should attach any documents that you believe support your request and are necessary for the Director to consider in evaluating your request for remission. Please be aware that a request for remission is limited to consideration of the five factors listed below as they may relate to the reasonableness of the amount of the civil penalty assessed. Requesting remission is not the proper procedure for contesting whether the violation(s) occurred or the accuracy of any of the factual statements contained in the civil penalty assessment document. Pursuant to N.C.G.S. § 143B-282.1(c),remission of a civil penalty may be granted only when one or more of the following five factors apply. Please check each factor that you believe applies to your case and provide a detailed explanation, including copies of supporting documents, as to why the factor applies (attach additional pages as needed). INSPECTION 1. Regularly inspect the water purifier to ensure that the germicidal lamp is still in operation. • On purifiers not equipped with the Ultraviolet Monitor, lamp operation can be verified by a visible glow through the translucent sight port. This provides an indication of lamp operation and does not indicate the level of ultraviolet intensity or transmission through the water. • On purifiers so equipped, the GuardianTM Ultraviolet Monitor provides visual indication of the ultraviolet intensity through the quartz sleeve and water in the purifier chamber. 2. To ensure proper operation of the water purifier, regular biological testing should be performed on a schedule recommended by local public health authorities, or at minimum;at installation, quarterly for the first year of service and annually, at lamp replacement, for the life of the water purifier. DISPOSAL OF MERCURY ADDED LAMPS Germicidal ultraviolet lamps, like standard fluorescent lamps contain small amounts of mercury. Mercury added lamps should not be placed in the trash.
