Stevens Division of Water Quality May 15, 2001 Catawba County DWQ Project # 010576 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Lorin Weaver NDI, Inc. 52 River Pointe Drive Hickory, NC 28601 Dear Ms. Weaver: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 147 linear feet of streams for the purpose of constructing road crossings at Phase II, Magnolia Place subdivision as described in your application dated April 11, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3289. This certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. The stream impacted outside the immediate are of the culvert at crossing 1 shall be restored and the riparian buffer replanted. Written DWQ approval for these plans is required before further impacts occur. 3. The crossing in Phase 2 shall not exceed 147 feet including culvert, riprap and stream relocation. 4. Prior to the clearing and grubbing of Phase 2, the applicant shall submit updated plans for written DWQ approval. These plans must show the location of the proposed buffers. 5. Upon completion of the project, the applicant shall complete and return the enclosed "Certification of Completion Form" to notify DWQ that all the work included in the 401 Certification has been completed. The property is owned and is being developed by NDI, Inc. The project location is approximately shown on the attached site vicinity map (Newton, USGS TopoQuad). The project site was evaluated for the presence and extent of jurisdictional Waters of the U.S. by Wetland and Natural Resource Consultants in February, 2001. Jurisdictional areas on the property consist of perennial stream channels. The centerlines of the streams were surveyed and are shown on the attached road crossing details. No vegetated wetlands were located on the property. Previous impacts for the site associated with Road Crossing I of Phase One were authorized by NW 39 (see attached General Permit Verification). New impacts associated with Road Crossing are proposed for construction development of Phase II of the project. Impacts associated with this crossing are requested under NW Permit 14. Impacts ual 147 linear feet. Minimization and Avoidance has been achieved by lot layout co figurations which avot any impacts by the project other than the required road crossing as mandated by the City of Conover to meet thoroughfare plans. Headwalls have been utilized to the maximum extent feasible for minimization. In order to minimize impacts the design of the project has allowed for approximately six acres of buffers to the remaining channels. These areas are to be permanently deeded as open space and are estimated to average greater than 50 feet for the site. The project site was evaluated for the presence and extent of jurisdictional Waters of the U.S. by Wetland and Natural Resource Consultants in February, 2001. Jurisdictional areas on the property consist of perennial stream channels. The centerlines of the streams were surveyed and are shown on the attached road crossing details. No vegetated wetlands were located on the property. Previous impacts for the site associated with Road Crossing 1 of Phase One were authorized by NW 39 (see attached General Permit Verification). New impacts associated with Road Crossing are proposed for construction development of Phase H of the project. Impacts associated with this crossing are requested under NW Permit 14. Impacts equal 147 linear feet. Minimization and Avoidance has been achieved by lot layout configurations which avoid any impacts by the project other than the required road crossing as mandated by the City of Conover to meet thoroughfare plans. Headwalls have been utilized to the maximum extent feasible for minimization. In order to minimize impacts the design of the project has allowed for approximately six acres of buffers to the remaining channels. These areas are to be permanently deeded as open space and are estimated to average greater than 50 feet for the site.
