APPROVAL OF 40lQuality Certification and ADDITIONAL CONDITIONS and Neuse River Buffer Rules

Dear Bradsher:
You have our approval, in accordance with the attached conditions and those listed below, to impact 618 linear
feet of streams for constructing a new irrigation pond at your farm in Wake county, as you described in your
application dated April 12, 2001. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3287. This certification allows you to use Nationwide Permit Number 39 when the
Corps of Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 213 .033). In
addition, you should get any other federal, state or local permits before you go ahead with your project including (but
not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified In the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified
below. If you change your project, you must notify us and you may be required to send us a new application.. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby
responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one
acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval
shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification.
For this approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below,
1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters or
areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future
wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter
or the issuance of the 404 Permit (whichever is later).
2. A 50 foot wide vegetated buffer (at least 30 feet wooded) must be established and maintained around the
entire edge of the pond except for the dam and specific locations for access to irrigation equipment. If planting
is needed to meet this condition, a planting plan must be submitted to DWQ for written approval within one
month of the date of this letter.
3. Upon completion of the project, the applicant shall complete and return the enclosed "Certification of
Completion Form" to notify DWQ that all the work included in the 401 Certification has been completed. The
responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of
Water Quality.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a
hearing.

Enclosed is the permit fee in the sum of $475 for the Robert Bradsher 401 Water Quality
permit. I have also enclosed seven copies for your agency's review. This letter and the
enclosed materials will be sent to the Crabtree Blvd. Address.
Please note on the Pre Construction Notification form that there is no mention of the
number of copies to enclose and also that the address shown is the old address for the
Division of Water Quality. I obtained this form from the web site of the US Corps of
Engineers. I realize that the Division of Water Quality does not generate this form but
would it be possible to inform the Corps of the updates and the number of copies needed
for proper review by your agency and to have this information included in the PCN
materials? As a government employee myself I realize protocols and "chains of
command" are at times difficult to transcend. This would help everyone involved in this
process, especially those of us who do not submit these forms on a regular basis. I will
also contact the Corps and inform them of these suggested changes as well.

Dear Amanda Brown,
Enclosed is the Pre-Construction Notification (PCN) for the R.L. Bradsher pond
construction site. Following are some points that may prove helpful concerning one of the
possible Nationwide permits for the construction of an embankment pond on an unnamed
tributary that feeds into the Neuse River.
Richard Brooks, soil scientist with the Division of Soil and Water (DENR), made a
wetland determination on Thursday, January 11, 2001. Mr. Brooks determined that the
wetland area within the scope of the proposed work was confined to the channel area. The
stream channel is incised and there is no prevalent flood plain. I believe you concurred with
this assessment on a site visit made on Tuesday, March 13, 2001.
The proposed scope of work that follows is approximate due to the site not having
been completely surveyed at this point. The area as described and as shown in #1 OA and 1 OB
on the PCN will show the maximum impacted areas.
Unless otherwise stated, all figures described herein are projected as maximum. The
dam will have a base width of 118 feet. This will impact an are feet by 8 feet (the
stream width). Within the base area of the dam, all ro i 1 be clea d and grubbed. This
is the area shown in #l0A under filling. There wil 500 feet by 8 f t of the stream
flooded due to the pond embankment. The pool are will also be ared and grubbed. This
is the area shown in #I OA under flooding.
The stream channel will not be relocated however approximatel 618 feet ill be
flooded or filled. The width of the current stream is 8 feet; after construction a stream
channel itself will not change, however the pool area will be 250 feet at the widest point.
As discussed, Mr. Bradsher will lose one irrigation pond he is currently using due to
the construction of I-540. He is currently irrigating out of the Neuse River to supply the
needed amount of water for his turfgrass. He has worked out a conservation easement on
approximately 17 acres of wetland located along the Neuse River with the City of Raleigh.
By constructing this pond, Mr. Bradsher will reduce or eliminate the need for pumping out of
the Neuse.

Enclosed is the permit fee in the sum of $475 for the Robert Bradsher 401 Water Quality
permit. I have also enclosed seven copies for your agency's review. This letter and the
enclosed materials will be sent to the Crabtree Blvd. Address.
Please note on the Pre Construction Notification form that there is no mention of the
number of copies to enclose and also that the address shown is the old address for the
Division of Water Quality. I obtained this form from the web site of the US Corps of
Engineers. I realize that the Division of Water Quality does not generate this form but
would it be possible to inform the Corps of the updates and the number of copies needed
for proper review by your agency and to have this information included in the PCN
materials? As a government employee myself I realize protocols and "chains of
command" are at times difficult to transcend. This would help everyone involved in this
process, especially those of us who do not submit these forms on a regular basis. I will
also contact the Corps and inform them of these suggested changes as well.

Dear Amanda Brown,
Enclosed is the Pre-Construction Notification (PCN) for the R.L. Bradsher pond
construction site. Following are some points that may prove helpful concerning one of the
possible Nationwide permits for the construction of an embankment pond on an unnamed
tributary that feeds into the Neuse River.
Richard Brooks, soil scientist with the Division of Soil and Water (DENR), made a
wetland determination on Thursday, January 11, 2001. Mr. Brooks determined that the
wetland area within the scope of the proposed work was confined to the channel area. The
stream channel is incised and there is no prevalent flood plain. I believe you concurred with
this assessment on a site visit made on Tuesday, March 13, 2001.
The proposed scope of work that follows is approximate due to the site not having
been completely surveyed at this point. The area as described and as shown in #I OA and l0B
on the PCN will show the maximum impacted areas.
Unless otherwise stated, all figures described herein are projected as maximum. The
clam will have a base width of 118 feet. This will impact an area of 118 feet by 8 feet (the
stream width). Within the base area of the dam, all ground will be cleared and grubbed. This
is the area shown in #1 OA under filling. There will be 500 feet by 8 feet of the stream
flooded due to the pond embankment. The pool area will also be cleared and grubbed. This
is the area shown in #I OA under flooding.
The stream channel will not be relocated however approximately 618 feet will be
flooded or filled. The width of the current stream is 8 feet; after construction the stream
channel itself will not change, however the pool area will be 250 feet at the widest point.
As discussed, Mr. Bradsher will lose one irrigation pond he is currently using due to
the construction of 1-540. He is currently irrigating out of the Neuse River to supply the
needed amount of water for his turfgrass. He has worked out a conservation easement on
approximately 17 acres of wetland located along the Neuse River with the City of Raleigh.
By constructing this pond, Mr. Bradsher will reduce or eliminate the need for pumping out of
the Neuse.
