The lot lies along a man-made ditch that existed since 1996, before I purchased the lot and years before the above referenced law come into effect. I had excavated the ditch bank in preparation for development. Now, I learn that my 30 feet of street access frontage is in the 30 feet of undisturbed buffer. This makes my lot inaccessible. I understand that this ditch, constructed three or four years ago is interpreted as a blue line stream on the USGS Map. I question the validity of this argument. This entire drainage system over the past five or six years was re-ditched. There are no natural streams within 1,500 feet of my property. The entire drainage system within one-half mile of my lot is man made and atypical, in so far as drainage is concerned. Further, there is some question as to the accuracy of this part of the USGS Washington 7'/: minute quadrangle, which was last up-dated during 1983, and not field checked (noted on the map). Stevens Division of Water Quality Subject: Cayton Furniture site DWQ# 010546 Beaufort County Dear Mr. Bliley: This office has reviewed the information submitted on April 6, 2001 (dated March 31, 2001) relevant to the subject property and I conducted a site visit for the above referenced project on April 18, 2001. It was determined that the streams depicted on the USGS topographic and Wake County Soils maps and shown in green on there locations on the attached map from DWQ are at least intermittent streams and therefore subject to the Tar-Pamlico River Basin: Nutrient Sensitive Waters Management Strategy: Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A .0213 .0259. The stream has been relocated from it's original alignment as shown on the Beaufort County Soil survey. My field visit showed that the stream starts at the eastern part of the property where the two existing ditches join. .According to the Tar-Pamlico buffer rules, construction must be no closer than 50 feet to this stream and all new stormwater must be directed to sheetflow across this buffer unless the stormwater is treated first. My understanding is the Mr. Moore of our Washington Regional Office has issued a costal stormwater permit for this site as well. In order to impact this stream and buffer, written approval from DWQ is required unless the project is an exempt activity as outlined in these rules.
