Dear Mr. Hora,
Your application for a Minor Variance from the Neuse River Riparian Area Protection Rules (15A NCAC 2B
.0233) was received by the Division of Water Quality (DWQ) on March 22, 2001. The activity for which the Minor
Variance is sought is to construct a three bay automobile garage addition to your existing home which currently has an
attached two-car garage. A Minor Variance Approval is a determination by the DWQ that the activity for which the
approval is sought meets all of the requirements per 15A NCAC 2B .0233(9)(a).
After a thorough review of your proposed activity, DWQ staff have determined that you have not demonstrated
that your proposed activity meets all of the requirements per 15A NCAC 2B .0233(9)(a). Specifically per our phone
conversation with Mr. Uhalley on 4/24/01, Mr. Uhalley stated that it would be possible (although not preferred by the
property owner) to build a two-car garage on the property and thereby eliminate the need for disturbance to the protected
riparian buffers. This would in turn eliminate the need for a Minor Variance and would still provide you with 2 additional
garage bays. Therefore, I am hereby informing you that it is the determination of this office that this project does not
meet the requirements per 15A NCAC 2B .0233(9)(a). Therefore, in accordance with 15A NCAC 2B .0233(9), the Minor
Variance Approval for this project is hereby not approved.
If this decision is unacceptable to you, you have the right to an adjudicatory hearing upon written request within
sixty (60) days following receipt of this denial. This request must be in written petition conforming to Chapter 150B of
the North Carolina General Statures and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, NC
27611-7447. Unless such demands are made, this denial shall be final and binding. Finally, we are available to further
discuss modification to your proposal which would answer our objections and allow issuance of a Minor Variance
Approval.
