After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3287 and 3289. This Certification allows you to use Nationwide Permit Numbers 39 and 14 when issued by the US Army Corps of Engineers (USACE). This letter will also act as your Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 213 .0233(8). In addition, you should get any other required federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application dated 4/5/01 with additional information provided within S&EC, Inc.'s response letter dated 6/11/01. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers as identified within 15A NCAC 213 .0233(5). 2. Upon completion of all work approved within this Certification Approval and Authorization Certificate, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. 3. Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification Approval and Authorization Certificate. 4. In response to the specific concerns expressed in the May 18, 2001 letter fro DWQ (attached), the attached letter from Mr. Peter Cnossen and the attached maps how the planned building footprints on lots 12 and 18. Also, Mr. Cnossen's lette explains why the proposed road crossing of the creek and adjacent wetlands wasp laced where it is. The attached letter from the DWQ states that mitigation will be required by the DWQ in accordance wit 15A NCAC 21-1.0506(h). This section specifies that the DWQ may ask for wetland mi gation if the project proposes wetland impacts that exceed 1 acre. This site plan propo es wetland impacts that total 0.3087 acres (i.e. less than 1 acre) as stated ? in the first sentence of your May 18, 2001 letter. It is also our understanding that the \II,? DWQ does not require stream mitigation for impacts less than 150 linear feet per channel - or buffer mitig require for buffer impacts less than 1/3 acre and/or 150 feet. As stated in the %0_ first sentence o your May 18, 2001 letter, this project proposes stream impacts of 108 linear feet (i.e. ess than 150 linear feet) and buffer impacts of 0.1833 acres (i.e. less than 1 /3 acre). If o r understanding of the current DWQ mitigation thresholds is incorrect or if these threshold have changed please let me know. If mitigation is required, we propose payment into t e N.C. Wetland Restoration Program as specified in 15A NCAC 2H.0506(h) as ?he preferred method of mitigation. This information pertains to the stream and wetland impacts of the planned Street A crossing and building impacts in relation to wetlands on Lots 12 and 18. As part of this letter, please find a copy of the Site Plan that shows revised street locations for Streets B & C. Also, copies of Lots 12 and 18 are attached that show building footprints in relatic^ to wetlands. The Street A alignment shown on the Site Plan is controlled by the tie to Sunset Lake Road that must be made within a previously established access easement within the Johnson Property. Between this established access easement and creek, sufficient length does not exist to substantially alter the Street A alignment using required Town of Fuquay-Varina (Town) horizontal design criteria. Furthermore, the Town has supported this alignment so that a planned connection to future Judd Parkway, a planned collector, can be made. This alignment and future connection has been established to avoid the potential need for additional creek crossings as this subdivision extends further north and west. For these reasons, we request that the alignment of Street A be approved as planned. Building footprints on Lots 12 and 18 show that house construction can occur without impacting the wetlands. The revision to Streets B & C has allowed us to provide additional lot depth around the cul-de-sac, thereby more distance between the house and wetlands is provided. We believe sufficient separation from the wetlands now exists and that the lots contain enough high ground to avoid any impacts to the jurisdictional areas (see attached lots 12 and 18 building footprints). 9934 DWQ Letter 06/08/01 It is hoped that the information provided is sufficient and has adequately addressed your concerns and allows approval of the planned development as designed. A headwater forest wetland and an unnamed tributary to Terrible Creek divide the property, making it necessary to impact this area to allow access to the property west of the wetland and stream. In order to provide access to the western half of the property, the applicant proposes to construct a road crossing (crossing 1) that will impact 0.2613 acre of wetlands, 108 linear feet of a 3-foot-wide stream (324 sq. ft.), and 7, 983 square feet (0.1833 acre) of riparian buffer (see impact map). An additional headwater forest wetland is present west of the stream, on the northern boundary of the property, which lies within the access road's proposed alignment. The applicant proposes to construct a road crossing (crossing 2) that will impact 0.0474 acre of this wetland in order to provide road access to the western half of the property (see impact map). The road alignment through the northern half of the property is necessary to provide connectivity to the subdivision's access corridor to Sunset Lake Road, which is on the northeast corner of the property. The total cumulative impacts for this project consist of 0.3087 acre of wetlands, 108 linear feet of stream channel, and 0.1833 acre of riparian buffer. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the thresholds for notification (0.10 acre) or if a discharge causes the loss of any open waters. The applicant requested a detailed delineation of wetlands prior to site plan development in order to avoid jurisdictional wetlands and waters to the maximum extent practicable. However, a wetland and an unnamed tributary of Terrible Creek separate the western and eastern portions of the property, making it necessary to construct a road crossing (crossing 1) to provide road access to the western half of the site. A wetland also falls within the subdivision's access road alignment, which was designed to provide efficient connectivity to the site's access corridor to Sunset Lake Road. Though the majority of this wetland will be avoided, construction of a road crossing (crossing 2) over the southern tip of this wetland will also be necessary. To minimize impacts, both road crossings are designed to be perpendicular to the wetlands and stream channel. In addition, a portion of the headwater forest wetland impacted by crossing two is included in a 0.19 acre open space which will not be impacted. S&EC does not believe compensatory mitigation should be required by the USACE for this project. NC-DWQ's current 401 Water Quality Certification policy requires written concurrence for impacts to wetlands and stream channels associated with NWP 14. As noted above, the proposed road crossings will impact less than 150 feet of stream channel and less than 1 acre of wetlands. Current NC-DWQ policy does not require wetland or stream channel mitigation for impacts below 1 acre and 150 linear feet. Because the impacts associated with this project do not exceed the aforementioned thresholds, S&EC believes wetland and stream channel mitigation should not be required.
