After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below: 1. PROJECT SUMMARY: The applicant proposes to install a drainage system as part of the infrastructure for a 21 lot residential subdivision on Cedar Island, in Nags Head, Dare County Korbach Limited Partnership Lone Cedar Village Field Report Page 2 PROJECT SITE The applicant's property is located on Cedar Island on the north side of US64/264, on the Manteo-Nags Head causeway and the Roanoke Sound, in Nags Head, Dare County. The project site is a strip of natural and man created high ground bordered by a man-made basin on the west side and a man-made canal along the northern and eastern edge of the property. Based on available records, in the Elizabeth City District Office, dredging at this site was conducted in the early to middle 1970's with a permit from the Army Corps of Engineers. During the years following the issuance of the permit, a number of violations occurred that involved the excavation and filling of Juncus Marsh. A combination of continuing violations and a failure to take the necessary corrective action resulted in the revocation of the Corps permit in 1974. The renewal of a permit from the Department of Natural and Economic Resources was denied in 1975 as a direct result of the applicant's failure to take corrective action for the violations issued by the Army Corps of Engineers. It appears from the information available that the eastern canal was excavated from Juncus marsh, in violation f the original permit issued (See Attached Photos and Correspondence). Tile property in question consists of four separate parcels with a total area of 15.79 acres. Approximately 12 acres of the property consists of high ground with the remaining area being Section 404 and coastal wetlands. Wetland vegetation on the property includes, but is not limited to, Black needle rush (Juncus roenierianus)s, Giant Cordgrass (Phragmites australius), Scirpus, spp., and Salt Meadow Grass (Spartina patens). Upland vegetation includes Live Oak (Quercus virginiana), Toothache Tree (Zanthoxylum clava-herculis), Rabbit Tobacco (Gnaphalium obtusifolium), Salt Meadow Grass (Spartina patens), Cat brier (Smilax bona-nox), Red Cedar (Juniperus virginiana) and Wax Myrtle (Myrica cerifera). All of the properties on the project are vacant with the exception of a 6' x 37' pier (to remain) and a 142' x 14' jet ski rack (to be removed). The eastern side of the property is bound by a man-made canal and has a high Juncus marsh that ranges from 80' to 150' deep measured at the waters edge at normal water level landward. Roanoke Sound is classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Currituck Sound is SA (shell fishing). Additional review indicates that there are no known archeological sites or geological formations associated with the applicant's property. PROJECT DESCRIPTION The applicant's propose to develop the 15.79 acre site into a 21 lot subdivision with three stormwater drainage swales that will be established along three 20' wide drainage easements. Two of the discharge swales will terminate within the Estuarine Shoreline Area of Environmental Concern, and empty into a basin on the west side of the property. A third drain, will be placed Korbach Limited Partnership Lone Cedar Village Field Report Page 3 on the east side of the project site and will terminate landward of the Coastal Wetland AEC and the Estuarine Shoreline AEC in the JUllCLis Marsh on the east side of the property. Stormwater will flow through a vegetated discharge Swale 160' to 180' in length, to a 10' x 20' riprap covered geosynthetic underlines, and flow into the man-made basin off Roanoke Sound. A rock sediment trap will be placed where the swale intersects with the existing scarp along the shoreline and will have a geosynthetic underliner that will terminate above normal water level. The placement of the traps will serve as a temporary sediment control structures and will be removed once vegetation has established in the drainage swales. Outlet control dams will be placed oil the landward end of the ditches, where the subdivision streets drain into the easement. The third and final discharge will be adjacent to the central subdivision street (Lone Cedar Court), through lot 20, on the east side of the project site. The drainage easement passes through approximately 15' of high ground, 12' of Section 404 Wetlands and 140' of Coastal Wetland, terminating at a man- made canal. A control dam will be placed between the drainage swale, paralleling Lone Cedar Court, and the drain outlet. A 10' x 16' underliner with riprap over will be placed immediately landward of the Section 404 Wetlands. Surface runoff will drain to the swale through the Section 404 Wetland strip and into the Coastal Wetlands. High ground disturbance for the project within the Estuarine Shoreline AEC, will involve two 20' wide drainage swales (20' x 75') for a total of 3,000 square feet of land disturbing activity. Approximately 2,600 square feet of Estuarine Shoreline will be disturbed to install the 20' wide swale and 400 square feet will have riprap placed over the existing shoreline in Section 404 Wetlands. Ill addition all eight-foot wide section of the proposed swales (approximately 600 square feet), within the AEC, will be filed with six inches of riprap to filter runoff. ANTICIPATED IMPACTS • Loss of 400 square feet of Section 404 Wetlands from the placement of riprap fill. • Development of the property for a residential subdivision will increase the density of the property as structures are built and occupied. • Increased runoff will be directed into the adjacent water body. • Increased use of Public Waters can be anticipated as the properties are developed. • A secondary impact of the increased use of Public Trust Waters will be an increase in turbidity of the adjacent waters. • Another secondary impact that can be anticipated from this development is an increase in non-point source pollution from watercraft. Mathis Date: March 19, 2001 LONE CEDAR VILLAGE SUBDIVISION CAMA NARRATIVE PROJECT DESCRIPTION: The purpose of this project is to construct a 21-lot subdivision on 15.79 acres of land in Nags Head, NC. This CAMA permit application is for clearing and grading for the construction of Lone Cedar Court, a public street, and Cedar Island Drive, a private street, stormwater management systems, a water distribution system and street lighting. The total impact of this work will affect 3.0 acres. Residential lot clearing, grading, earthwork, and house construction will be the responsibility of the individual lot owners. SITE DESCRIPTION: The site is located along the north side of the U.S. Route 64/264 causeway approximately 2000 Ft before the Melvin R. Daniels bridge in the Town of Nags Head in Dare County. The site is relatively flat with slopes ranging from 0.5% to 1.0% and is covered with medium to light ground cover vegetation. Presently, drainage is afforded the site through overland flow to the canals surrounding the property that flow to the Roanoke Sound. The State classification of the surrounding waters is SA. STORMWATER MANAGEMENT: As the project is located within a "Coastal County" as defined in NCAC 2h .1002 (4), the stormwater requirements to be implemented are outlined in NCAC 2h.1005. The project has a built-upon area of less than 25% and falls under the classification of a "Low Density Project" per NCAC 2h.1003(d)(1). The site does not drain to waters classified as Outstanding Resource Waters (ORW). Stormwater will be transported primarily by vegetated conveyances, and a vegetative buffer in excess of 30 feet is provided along the entire site. Stormwater runoff from this site will be conveyed to retention areas by overland flow, with the site graded such that all impervious areas will drain by overland flow through grassed areas before reaching a defined channel. A stormwater retention system consisting of level, grass-lined swales will be constructed along both sides of Lone Cedar Court and Cedar Island Drive. The system will function by retaining the first 1'/Z inches of runoff from a 2-hour, 1'/2-inch storm event, which will infiltrate into the ground. Stormwater flows above this amount will be allowed to pass to the discharge swale.ml1 The built-upon area for this site will be approximately 17% of the total site area, which is less than the 25% maximum allowed by NCAC 2h .1005 (2)(a). Field Office. The project in question, located on the Manteo-Nags Head Causeway, Dare County, N.C. is being constructed by Mr. William J. Korback under SWAKS Permit No. 74-28-03-340. According to conditions of the Federal Permit, as outlined in conditions 3 and 4 of the U.S. Department of the Interior's letter dated July 5, 1973, the proposed canals are to be excavated on high ground'adjacent to the marsh and spoil materials are.to be placed on the existing high ground leaving the salt marsh undisturbed. As a result of our October 99 1974 site visitation, it was observed that spoil had been deposited in Juncus roemerianus marsh and that a new canal was under construction adjacent to the fill.area also in J. roemerianus marsh. Approximately 4 acres of marsh has been filled and T acre of marsh has been excavated. According to the plat submitted with Mr. Korback's public notice, the fill area adjacent to the fish pond was to average 250 feet wide. This same area now approximates 416 feet wide along the northern boundary and 288 feet wide along the southern border. It is noted that we previously reported to Mr. Mark Thompson on October 129 1973 that Mr. Korback was violating his Federal Permit. At that time a canal had been dug in J. roemerianus marsh parallelling highway 64/264 (Manteo-Nags Head Causeway). Subsequently on October 18, 1973 the Corps issued a Cease and Desist Order halting all work. This order was rescinded on October 30, 1973 upon agreement by Mr. Korback to locate his dikes along the existing shrub-marsh transition as originally specified by FWS. As a result of the October 9, 1974 visit it was observed that the previously reported canal had been filled and that the spoil area parallelling highway 64/264 had been increased to 350 feet where the permit plat indicated only 250 feet would be filled. 2 It is therefore requested that the above-cited matter be investigated immediately by the Corps. If the work is found to be in violation of Mr. Korback's Federal Permit we feel that the Federal Permit should be revoked and legal action calling for complete restoration of destroyed wetlands be instigated. The original issuance of the permit occurred only after a lengthy negotiation between you and objecting Federal agencies. Whereas the US Fish and Wildlife Service originally recommended outright denial of your permit, after a period of almost 8 months the agency withdrew its recommended denial and accepted a conditional issuance. These conditions restricted all excavation and fill to high ground areas above the extensive surrounding marsh areas.. The revised plat on which the permit was issued has a scale of distance upon which the project is CERTIFIED MAIL - RETURN RECEIPT REQUESTED SAWKS 27 August 1975 Mr. John W. The plat, along with the written conditions contained in the USDI letter, was considered to define the allowable work areas sufficiently for work to proceed. However, within 3 months of the issuance of the permit, the first violation of its conditions was reported.and confirmed. This matter was resolved to everyone's satisfaction, and work was allowed to proceed without resorting to legal action. However, approximately 1 year later a second violation was reported and confirmed which was much more extensive than the first and which, if allowed to continue, could result in extensive wetlands destruction. As it stands, there has already been wetlands destruction in the work which has been completed beyond the limitations of the permit. Had the project been performed in accordance with the plat on which the permit was issued and in accordance with the written conditions, there would have been little if any wetlands destruc- tion. However, the marshland destruction already accomplished and anticipated if the project were to continue as it stands, is detrimental to the public interest and serves no necessary need or other justifiable. purpose. b. Since application was first made for a permit and during the long process of negotiations leading to the issuance of the permit, a clear, well-defined plan has not been available. Upon receipt of the rather poor plan upon which the permit was issued, however, it was felt that with the written conditions and the scale plan the permit could be administered and enforced. Indeed, it was possible to translate the permit plan and scale onto a detailed plat prepared from aerial photo- graphy. However, numerous contacts and conversations. between you and representatives of this office have revealed that you have-disregarded the specific written conditions of the permit which.had been negotiated with the USDI to obtain the permit in the first place. You have proceeded to construct the project according to your own desires, disregarding the permit, which in this situation is not acceptable. C. After two significant violations of the permit, a reasonable plan of restoration of the affected areas was developed with input from onsite meetings and conversations with you. Compliance with restoration of the affected areas would have allowed this office to rescind the cease work order so that you could-continue work, and a recommendation for no prosecution could have been forwarded to the US Attorney's office. However, the project as it now stands has involved the illegal excavation and filling of wetlands. Because of the greatly increased concern of the public and Federal and State agencies over wetlands destruction as reflected in present laws and regulations, the continued excavation and filling of wetlands and marsh areas beyond the scope of the permit is not in the best public interest. 2 SAWKS Mr. John W.
