Since we have traded a few telephone calls, I thought that email might be
the best way to communicate with you.
In reading your letter of April 24, you requested a map showing the location
of any streams or ponds on the property. There are no streams or ponds on
my property, and none on any adjacent property. You also requested some
information concerning the area of water to be filled in. To the best of my
knowledge, there will be no water filled in. I have arranged with a
contractor, once I have the appropriate permits in hand, to stabilize the
shoreline using rip-rap. This contractor has installed rip-rap for quite a
few other landowners on Lake James and he tells that the location of the
shoreline will not change and there will be no increase or decrease in the
water area.
I hope this answers the two questions you raised in your letter. If not, I
will be happy to provide any further information that is required.

On April 6, 2001 the Division of Water Quality (DWQ) was notified by receipt of your
applications regarding your plan to stabilize a shoreline on lot 204, South Pointe subdivision on
I_,ake James for the purpose of stabilizating the shoreline in Burke County. Approval from DWQ
is required to disturb these areas. Please provide seven copies of the following information and
refer to the DWQ 4 listed above in your reply. In particular as described in 15A NCAC 213 .0502,
we will require you to locate all streams and ponds on the property. Please show these on maps
of' suitable scale (for instance F - 100 feet) so we can begin to determine your projects'
compliance with 15A NCAC 211 .0500. Please provide a site plan which clearly shows the
location of the proposed shoreline stabilization and report the area of water to be filled.
Please call me at [phone] if you have any questions or would require copies of
our rules or procedural materials. This project will remain on hold as incomplete in accordance
with 15A NCAC 211 .0505(c). The processing time for this application will begin when this
information is received. If we do not hear From you by writing within three (3) weeks we will

On March 26, 2001, your application for 401 Water Quality Certification for a
project in (Mecklenburg?) County was received by the N.C. Division of Water Quality.
Please note that beginning January 1, 1999, the N.C. General Assembly passed legislation
requiring payment of a fee for all 401 applications. Your application is being returned
since no payment was received with the package. The fee for applications is $200 for
projects impacting less than an acre of wetland and less than 150 linear feet of streams.
For projects impacting one or more acres of wetland or 150 or more feet of streams, the
fee is $475. In order for DWQ to review and process your request, you must send a
check in the appropriate amount made payable to the N.C. Division of Water Quality
attached to your applications. Also, for review of your project, you need to include a
vicinity map (ie, topographic) showing specific location of your project and any adjacent
streams or waters. Please also notice our new address as seen below.
