APPROVAL of Tar-Pamlico River Riparian Buffer Protection Rules MINOR VARIANCE [15A NCAC 2B.0259(9)(b)] with
ADDITIONAL CONDITIONS
Dear Mr. and Mrs. Brancato,
You have our approval, in accordance with the conditions listed below, to impact ± 1,350 ft2 of Zone 2 of the protected riparian
buffers for the purpose of constructing a single family residence on the subject property. This letter shall act as your Minor Variance
approval as described within 15A NCAC 2B .0259(9)(b). In addition, you should get any other required federal, state or local permits
before you proceed with your project including but not limited to CAMA Permits and Sediment and Erosion Control Permit.
This approval is only valid for the purpose and design that you described in your Minor Variance Request dated 10/11/00 with
additional information provided within the EPI letter dated 3/21/01. If you change your project, you must notify us and you may be
required to send us a new request for approval. If the property is sold, the new owner must be given a copy of this approval and is
thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below.
1. No impacts shall occur to Zone 1 of the protected riparian buffers.
2. Additional woody vegetation (native shrubs and trees) shall be planted in retained areas of Zone 1 and Zone 2 of the
protected riparian buffer to the greatest extent practicable.
3. Stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers as identified
within 15A NCAC 2B .0259(5). Drainage from the house shall be directed to vegetated areas prior to entering the
protected riparian buffers.
4. Any additional stormwater located on the remainder of the property shall be directed as diffuse flow at non-erosive
velocities prior to entering the protected riparian buffers. No new ditching or piping of stormwater through the
protected buffers is allowed.
5. A mitigation plan to compensate for impacts to the protected riparian buffer must be approved by this office prior to
construction. The required amount of mitigation for the Zone 2 impacts is 2,025 ft2 [ 1,350 ft2 x 1.5 (required
mitigation ratio)]. You have one month from the date of this approval to make this payment.
6. The mitigation plan can consist of restoring (replanting native woody vegetation at a density of at least 320 trees/shrubs
per acre) on at least 2,025 ft2 of protected riparian areas located on the property.
7. If restoration or enhancement or donation of property per 15A NCAC 2B .0260 is not an option, another suitable
method to meet this mitigation requirement is to make a payment into the Riparian Buffer Restoration Fund
administered by the NC Wetlands Restoration Program (WRP). In accordance with 15A NCAC 2B .0242(7), this
contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2B .0260(10) and (7)(c). Until
the WRP receives and clears your check (made payable to: DENR - Wetlands Restoration Program), buffer impacts
shall not occur. Mr. Ron Ferrell should be contacted at (919) 733-5208 concerning payment into the WRP. For
accounting purposes, this Certification authorizes payment into the Riparian Buffer Restoration Fund to

If you do not accept any of the conditions of this certification, you may ask for and adjudicatory hearing. You must act within
60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, PO Box 27447, Raleigh, N.C. 276 1 1-7447. This certification
and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Tar-Pamlico River Riparian Buffer Protection Rules
[ 15A NCAC 2B .0259(9)(b)]. Please be aware that your project may be eligible for the use of a proposed "General" Major Variance if
approved by the Water Quality Committee of the Environmental Management Commission in May 2001. Please call me if you would

Attached you will find the composite map which has been prepared on behalf of Linda and Joseph
Brancato. Mr. and Mrs. Brancato have submitted to your office a request for authorization to construct
their single-family residence within 50 feet of Blounts Creek.
As you will note on the attached drawing, the house location has been situated to setback 30 feet from
Blounts Creek and is immediately adjacent to the Section 404 wetlands which do not have setbacks for
single-family residential construction. The house location is predicated at this site due to the commitment
of the appropriate areas for sewage disposal and repair areas as required by the North Carolina Health
Department. Ms. Brancato has submitted the variance request forms, and this plat is to be used with that
application for approval.
We trust that this additional information is satisfactory for you to administratively issue the request for
construction as proposed on the attached plat. We look forward to your expeditious response to this

Bob and Cyndi,
The Lynn Clayton project is the one I was concerned about also (I talked
to Cyndi about this one). I spoke with Tracey who said that DCM was
going to deny the permit anyway. The Clayton's have since modified their
appl. to put a water level breakwater in front of the area, bring the
area down to wetland level and reestablish marsh in the area. When all
is finalized, I'll send you the modification. I have no problem with the
modification as Tracey relayed it to me.
I'm not sure what the Bob Corans project is - must be new.
Chip Watkins is the builder for the Linda Broncato project. Bob, this is
the one that sent in the variance request with the purple box colored in
for the house, no dimensions or anythiung about the structure. I had
them send in a proper drawing which I just recd. in January (not sure of
the date). Bob, I showed you this one in Raleigh but it still needed to
have a thorough WaRO review
Hope this helps. I'll be at a mine site in Pitt Co. on Tuesday AM and in
Pamlico Co. measuring Bob Cowdens lots at Cabin Creek in the PM. I'll be
on Ocracoke on Wednesday. I'll be in the office on Thursday but in
various meetings ( 10:00 am the wetland cleanup at the Kinston WWTP; and
George Wood at 11:00 AM for the Twin Lakes Campground project and at
1:00 PM for the Currituck Golf Coarse).
