C/o Beth Reed 4020 West Chase Blvd., Suite 190 Raleigh, NC, 27607 APPROVAL of 401 Water Quality Certification and Neuse River Buffer Rules with Additional Condition Dear Ms. Reed: You have our approval, in accordance with the attached conditions, to place fill in 136 linear feet of perennial and 212 linear feet of intermittent unnamed tributaries to Stony Creek in order to construct roadway and driveway crossings for the Windfall subdivision in Orange County, as described in your application received by the Division of Water Quality on April 6, 2001 and in additional correspondence received June 5, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3289, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands. This Certification allows you to use Nationwide Permit Number 14 when it is issued by the U.S. Army Corps of Engineers. This approval is also valid for the Neuse River Buffer Rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification as well as the additional condition listed below: 1. An additional condition is that stormwater shall be directed to diffuse flow at non-erosive velocities through any protected stream buffers. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Beth Reed with Kimely-Horn provided Steve a copy of this letter and a map depicting additional crossings associated with the drive ways (an additional 40 feet). Therefore 212 feet of an intermittent stream crossings and 136 feet of perennial crossings is proposed. After review RO has determined compliance with Neuse Buffer Rule, does not recommend mitigation. Three features are present on the site. Only one is subject to the Neese Buffer Rule, Number 3. That crossing . permittable as it is necessary and under threshold. Grossing 1 is at best over an ephemeral ditch. Crossing 2 was the problem. THis stream is important biologically, but not subject to NBR, and the total egress for the road crossing was 96 linear feet with three houses requiring access. Windfall Subdivision - Orange County Dear Mr. Smith: Per your request, the attached 81/2" x 11 site plan shows the location of the proposed driveway crossings for Lots 13 and 14 for the above referenced subdivision. Each driveway will be a 10-foot crossing (30" corrugated aluminum pipe) with 5' fill slopes on each side. Each driveway crossing with impact 20-1f of stream (40 If total). In addition to the 96-If of stream disturbance for the proposed road crossing, the addition of the driveway crossings will bring the total stream impact for this tributary to 136-1f. It is our understanding that this additional information is sufficient to release DWQ's hold of this project and facilitate the issuance of the 401 Certification. DWQ ID: 010506 Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject pre-construction notification. The project area was viewed on 11 May 2001 by NCWRC biologists to further assess impacts to fish and wildlife resources. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C, 661-667d), and North Carolina General Statutes (G. S, 113 -13 1 et scq.). Applicant proposes to impact 308 linear feet of stream with culverts and fill for access roads in a 25-acre residential development, Windfall Subdivision. The streams that run through the project are tributaries to Stony Creek. Stony Creek, designated as WS-IV-NSW, is a tributary of the Eno River and is within the Neuse River basin. An additional 0.13 acres of impacts are proposed to occur within the Neuse buffer zone. According to the site map, there are a number of lots that have streams running through them or are located within the Neuse River buffer zone. Additionally, in the Eno River there are numerous records for the existence of listed species, including the federal species of concern and state endangered, green floater (Lasn:lgona subviridis), the federal species of concern and state threatened, Atlantic pigtoe (Fusconaia masons) and yellow lampmussel (Larnpxilis cariosa), and the federal species of concern and state significantly rare, pinewoods shiner (Lythrurus matutinus). The perennial stream drains from the southeast corner of the property through a culvert under Old Durhain Road (NC 10). Stream piping and placing fill in aquatic resources can result in significant negative impacts to downstream areas and eliminate fish and wildlife habitat, Stream piping reduces the infiltration of stoma water and associated pollutants, as well as the dissipation of stream energy. Piping a stream and placing it underground obviously removes both aquatic and terrestrial habitat. Existing uses by wildlife are lost and fttture opportunities to improve aquatic diversity, evtm if water quality improves, are precluded. We are particularly concerned about the many listed species that are located downstream of the proposed project. Likewise we are concerned about impacts to wetlands due to their wildlife habitat value and the well-known beneficial functions that they provide for flood control and water quality protection. Changes in land use from a primarily forested area to a suburban landscape may exacerbate channel degradation due to increased stormwater runoff. However, we wig not object to the project provided that the following recommend conditions are incorporated into the permit to reduce impacts to fish and wildlife resources. 1. Remaining wetlands and streams on the site should be protected from additional impacts by placing them in a permanent conservation easement to prohibit filling, draining, flooding, and excavation. 2. In order to minimize stream impacts, while retaining some measure of wildlife habitat, we recommend a 100-foot undisturbed, native, forested buffer along perennial streams, and a 50-foot buffer along intermittent streams and wetlands. Maintaining undisturbed, forested buffers along these areas will minimize impacts to fish and wildlife resources, water quality, aquatic habitat both within and downstream of the project area, and help prevent the extirpation of endangered and threatened species In addition, wide riparian buffers are helpful in maintaining stability of stream banks and for treatment of pollutants associated with urban stormwater. Whereas, a grassed buffer, particularly fescue, is a vegetated buffer but will not provide the necessary and highly valuable functions as discussed for forested buffers. 3. Usc bridges for all permanent roadway crossings of streams and associated wetlands to eliminate the need to fill and culvert. If culverts must be used, the culvert should be designed to allow for fish passage. Generally, this means that the culvert or pipe invert is buried at least one foot below the natural stroambed. If multiple cells are required, the second and/or third cells should be placed so that their bottoms are at stream bankftlll stage (similar to Lyonsfield design). 'This will allow sufficient water depth in the culvert or pipe during normal flows to accommodate fish movements. If culverts are long, baffle systems are required to trap gravel and provide resting areas for fish and other aquatic organisms. If multiple pipes or cells are used, at least one pipe or box should be designed to rurnain dry during normal flows to allow for wildlife passage. In addition, culverts or ,r. Finally, riprap should not be placed on the streambed. 4. Locate sewers and other utilities as fkr away from creeks as functionally possible and minimize stream crossings. It is preferable that sewers be located outside the riparian buffers. The construction of roadways in new neighborhoods can produce short-term direct impacts as well as long-term cumulative eflbcts. Increased stormwatcr runoff can accelerate erosion of stream banks and scouring of the stream channel. Additionally, the pollutants (e. 9,, sediment, heavy metals, herbicides, pesticides, and fertilizers) washed from roads and urban landscapes can adversely affect and extirpate species downstream of developed areas. Grassed swales in place of curb and gutter and on-site stormwalcr management (i.e. bioretention areas) can be installed to produce no net change in the hydrology of the watershed and are recommended. These designs often cost less to install and significantly reduce environmental impacts from residential development. Many of these recommondations have been applied in Maryland in efforts to protect the Chesapeake Bay from water quality degradation. Permit Authorization is being requested for the piping of 212 linear feet of intermittent (unimportant) streams and 96 linear feet of perennial Neuse buffer stream for required road access. No wetlands will be impacted by this project. The proposed subdivision is located 6600 feet southwest of the intersection of I-85 and NC Highway 86. Access to the site can be obtained from SR 1710.
