Bennett, Jr. Town of Fuquay-Varina 401 Honeycutt Road Fuquay-Varina, NC 27528 Dear Mr. Bennetth: You have our approval, to construct the Willow Creek sanitary sewer line in Fuquay-Varina as you described in your revised application dated May 18, 2001 (original application dated March 29, 2001). After reviewing your application, we have decided that this project is covered by the Neuse River buffer rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. 1. Applicant is reminded that no impacts to Zone 1 of the protected stream buffer are allowed except for crossings. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Because the project will utilize a nationwide permit 12, written authorization for use of a 401 water quality certification from DWQ is not required if the project complies with the conditions of the permit. For this reason, the cover letter for the application stated at the top of the page that only the approval of Neuse Buffer impacts was requested. The additional information you have requested appears to apply to 401 certification issues and not buffer compliance issues. My response, which follows, assumes that your letter is intended to address the buffer impacts. If further information is required concerning the placement of the sewer line in order for you to provide buffer approval please let me know. Mr. Alan Keith's letter, which accompanied the permit request, stated that the north side of the creek contained wetlands that the corridor was trying to avoid by being routed on the south side of the creek. You requested to see the boundaries of the wetlands being avoided on the Stephens Property, however I can not provide a delineation map of these areas due to the fact that I only had permission from the property owner to delineate wetlands within and close to the corridor as shown on the impact map. If your office would like to confirm that these areas exist, please call me so that we can set up a site meeting. The placement of the corridor was negotiated with the property owner and is currently within a recorded easement with the Town of Fuquay-Varina. If the line is moved outside of the existing easement and the riparian buffer, the approximately 1500 linear foot pipe would require deeper excavation and the casement would need to be rerecorded. A non- perpendicular impact in Zone 2 of the Neuse River Riparian Buffers due to a non-electric utility line is currently an "allowable" activity as described in 15A NCAC 2B.0233 (page 8). All activities related to this project will abide by the conditions stated in 15A NCAC 213.0233. The current alignment of the sewer line from the north side of the extensive wetland area to the south side is an "exempt" activity as described in 15A NCAC 213.0233 (page 8) because it crosses the channels perpendicularly and uses a corridor of less than 40 feet in width. In order to tie the sewer lines together the wetland and creeks have to be crossed. Project # 01-5865 DWQ Project # 010478 impact map was chosen because it required less pipe be used with fewer turns (i.e. fewer places for backups and overflows) while temporarily impacting very little if any more wetlands/creek than would be impacted if the wetland and creek areas were crossed anywhere else. Your letter stated that the applicant has three weeks to respond to the request or DWQ will assume that the applicant no longer wants to pursue the project. Although we understand that this timeframe can be extended with a telephone call to your office, it is still restrictive based on the following. The letter was dated April 27, 2001; however, the applicant did not receive it until May 10, 2001. Additionally, the letter indicated that a copy was mailed to me as the authorized agent for the project; however, I did not and have not yet received a copy from your agency. In this and many other instances, the client assumes that I have received the information and am handling the situation as necessary. Based on the above complications, we may not be aware of the request until after the requested response time has lapsed. As suggested by your office, a stamped self addressed envelope is included with this submittal to aid your office in sending further correspondence relating to this project to me in a timely manner. Wetland and Upland Data sheets for this site were submitted with the earlier permit request (Action ID #'s referenced below). A Pre-construction Notification Form is attached. The proposed Willow Creek Sanitary Sewer Line is located south of Old Honeycutt Road (SR 2765) and west of Highway 55. The sewer corridor ends approximately 1.3 miles south of the intersection of Highway 55 and Highway 401 in Fuquay-Varina, Wake County, NC (see attached USGS site vicinity map). The ±78-acre property below Old Honeycutt Road contains approximately 28 acres of jurisdictional Waters of the US. Proposed impacts to waters for the construction of the sewer line will total 0.26 acres including 60 I.f. of channel. No other wetlands or channels are to be impacted. Construction of the sewer line will comply with the general conditions stated within Nationwide Permit 12. The applicant requested a delineation of wetlands present on the property prior to site plan development in order to avoid jurisdictional Waters of the US to the maximum extent practicable. The current sewer line corridor was chosen for several reasons, which are contained in the attached letter from Diehl and Wetland Delineation/Permitting/Mitigation Soil/Site Evaluations On-Site Septic Systems Environmental Assessments/Audits Neuse Basin and Watershed Buffer Evaluations Groundwater Hydrology Endangered Species Western Branch Offices: (828) 635-5820 - (828) 312-7902 - (704) 516-3922 Phillips, P.A. Due to the temporary nature of the impacts, S&EC, Inc. does not believe that any wetland mitigation will be required. If for some reason however mitigation is required, our client proposes payment into the North Carolina Wetland Restoration Program. The sewer line is required to service the public park and the Willow Creek residential subdivision south of Old Honeycutt Road. The U.S. Army Corps of Engineers determined that the public park is also considered part of this project. Also impacts related to the Willow Creek Subdivision north of Honeycutt Road have been determined to be part of this project. Impact totals for the entire tract are as follows: Willow Creek (north of Old Honeycutt Road) NWP 14: 0.18 acres (Action ID # 199708098) NWP 26: 0.10 acres (Action ID # 199708099) NWP 12: 0.13 acres (Action ID # 199708100) Total: 0.41 acres (0.28 acres of permanent impacts) Willow Creek (south of Old Honeycutt Road) NWP 39: 0.34 acres (Action ID # 200120188) NWP 12: 0.076 acres (Action ID # 200120187) Total: 0.416 acres (0.34 acres of permanent impacts) Honeycutt Park NWP 39: 0.16 acres (Action ID # 200021195) The entire tract's total wetland impacts are 0.986 acres. Of this total only 0.78 acres are permanent impacts. The additional proposed temporary impacts will add another 0.26 acres of temporary impacts. Three channels and their buffers will be impacted by nearly perpendicular crossings. The sewer line corridor is only 20 feet wide (i.e. less than 40 feet) and therefore should be exempt under the current Neuse River Riparian Buffer Rules en i ular impacts to Zone 2 of the Neuse Buffers do occur and tot 0.2764 acres he nonperpendicular Zone 2 impacts are necessary due to stee y in these areas (see attached letter from Diehl and Phillips and impact map). Mr. Steve Mitchell of the NC Division of Water Quality visited the proposed corridor on January 31, 2001, however a confirmation letter has not yet been received. Mr. Mitchell determined that the three features shown on the Wake County Soil Survey (attached) draining from the south are not subject to the Neuse River Riparian Buffer Rules. The construction will employ the use of mechanical equipment typically used to complete such work. 13. Purpose of proposed work: The sewer outfall is required to provide service to the Willow Creek Subdivision and the Old Honeycutt Road Park. 14. State reasons why it is believed that this activity must be carried out in wetlands (include any measures taken to minimize wetland impacts): The applicant requested a delineation of wetlands present on the property prior to site plan development in order to avoid iurisdictional wetlands to the maximum extent practicable. Impacts 1 2 and 3 (see attached impact map) will temporarily disturb iurisdictional wetlands and channels in order to provide sewer connection from the public park and the residential subdivision to an existing line on Highway 55- 15. You are required to contact the U.S. Fish and Wildlife Service (USFWS) and/or National Marine Fisheries Service (NMFS) (see agency addresses sheet) regarding the presence of any federally listed or proposed for listing endangered or 4 threatened species or critical habitat in the permit area that may be affected by the proposed project. Willow Creek Subdivision and the Town's Honeycutt Road Park are currently under construction. The sewer route as designed would minimize the length of sanitary sewer required to serve both of the above projects. It is possible to run the sewer that is required to serve the park on the north side of the wetlands, which parallel the branch. The park sewer could cross the wetlands near the eastern property line of the park. However, this route would add approximately 200 feet to the length of sewer required. The additional sewer would cost approximately $10,000.00 and would add length to the sewer that must be maintained by the Town. Further, the north route would cross playing fields, which will be completed in the near future. We have concerns about the sewer construction interfering with the seeding of playing fields with bermuda grass given the short time window available to grow-in bermuda for playing fields. The route of sewer across the Stephens Property would logically follow the north side of the branch. However, the sewer was routed on the south side of the branch at an increased depth and increased cost to avoid extensive wetlands, which exist on the north side of the branch. The sewer was routed in Zone 2 on the south side of the branch to minimize the depth of the sewers. If the sewer is moved out of Zone 2, evert more sewer depth and cost could be incurred. Three channels and their buffers will be impacted by nearly perpendicular crossings. The sewer line corridor is only 20 feet wide (i.e. less than 40 feet) and therefore should be exempt under the current Neuse River Riparian Buffer Rules. Nonperpendicular impacts to Zone 2 of the Neuse Buffers do occur and total 0.2764 acres. The nonperpendicular Zone 2 impacts are necessary due to steep topography in these areas (see attached letter from Diehl and Phillips and impact map). Mr. Steve Mitchell of the NC Division of Water Quality visited the proposed corridor on January 31, 2001, however a confirmation letter has not yet been received. Willow Creek Subdivision and the Town's Honeycutt Road Park are currently under construction. The sewer route as designed would minimize the length of sanitary sewer required to serve both of the above projects. It is possible to run the sewer that is required to serve the park on the north side of the wetlands, which parallel the branch. The park sewer could cross the wetlands near the eastern property line of the park. However, this route would add approximately 200 feet to the length of sewer required. The additional sewer would cost approximately $10,000.00 and would add length to the sewer that must be maintained by the Town. Further, the north route would cross playing fields, which will be completed in the near future. We have concerns about the sewer construction interfering with the seeding of playing fields with bermuda grass given the short time window available to grow-in bermuda for playing fields. The route of sewer across the Stephens Property would logically follow the north side of the branch. However, the sewer was routed on the south side of the branch at an increased depth and increased cost to avoid extensive wetlands, which exist on the north side of the branch. The sewer was routed in Zone 2 on the south side of the branch to minimize the depth of the sewers. If the sewer is moved out of Zone 2, even more sewer depth and cost could be incurred. The terrain on the south side of the branch is fairly steep. Movement away from the branch quickly adds depth to the sewer. Re: Routing of Sanitary Sewer Qutfall to serve Willow Creek Subdivision and the Town of Fuquay-Varina Park, Fuquay-Varina, NC Dear Sean: The route of the sanitary sewer outfall to serve Willow Creek Subdivision and the Town of Fuquay-Varina Park was chosen to balance cost, length of sewer, and environmental impacts. Willow Creek Subdivision and the Town's Honeycutt Road Park are currently under construction. The sewer route as designed would minimize the length of sanitary sewer required to serve both of the above projects. It is possible to run the sewer that is required to serve the park on the north side of the wetlands, which parallel the branch. The park sewer could cross the wetlands near the eastern property line of the park. However, this route would add approximately 200 feet to the length of sewer required. The additional sewer would cost approximately $10,000.00 and would add length to the sewer that must be maintained by the Town. Further, the north route would cross playing fields, which will be completed in the near future. We have concerns about the sewer construction interfering with the seeding of playing fields with bermuda grass given the short time window available to grow-in bermuda for playing fields. The route of sewer across the Stephens Property would logically follow the north side of the branch. However, the sewer was routed on the south side of the branch at an increased depth and increased cost to avoid extensive wetlands, which exist on the north side of the branch. The sewer was routed in Zone 2 on the south side of the branch to minimize the depth of the sewers. If the sewer is moved out of Zone 2, even more sewer depth and cost could be incurred. The terrain on the south side of the branch is fairly steep. Movement away from the branch quickly adds depth to the sewer.
