I further certify that the Applicant or any parent, subsidiary, or other affiliate of the Applicant has not been convicted of an environmental crime, has not abandoned a wastewater facility without proper closure, does not have an outstanding civil penalty where all appeals have been exhausted or abandoned, are compliant with any active compliance schedule, and does not have any overdue annual fees. The Carolina Pole Leland, Inc. facility in Leland, North Carolina, owned by Leland Land LLC, treats wood using pentachlorophenol. The facility currently operates an exempt wastewater treatment unit (WWTU), which collects and treats wastewater generated from its on -site operations and recirculates it back into its process (i.e., zero discharge) under a closed -loop recycle system permit. The facility will continue operating a 6,000 gallon per day (GPD) wastewater treatment and closed -loop recycle facility consisting of a package treatment system consisting of a mixing tank with polymer feed and pH adjustment, primary mixing and settling tank, equalization tank, nutrient addition, dual biological reactors with fixed media, dual 240 cfm blowers, secondary mixing and settling tank with polymer addition, and a sludge filter press with polymer addition. Solids from the filter press are managed as hazardous waste and the residual oil and water are introduced back into the wood treating process. The facility generates and treats wastewater with pentachlorophenol residue from the wood treating process and stormwater from the tank farm containment area at this facility, but will also accept shipments of similar wastewater from wood treatment operations (i.e., wastewater with pentachlorophenol or chromated copper arsenate residue) from Koppers facilities located in Vidalia, Georgia; Vance, Alabama; and North, South Carolina. The wastewater will be transported to the Leland facility from only these locations via tanker truck (approximately 6,000 gallons per tanker truck). The wastewater will be offloaded from the tanker truck via pump. Based on the permit limitation of 6,000 gallons per day, the wastewater transported to the site may be temporarily stored in a 30,000 gallon aboveground wastewater storage tank connected to the WWTU prior to processing. No increase in the flow capacity or change treatment units on the existing facility will be made to accommodate the addition of the proposed wastewater.
