Stevens Division of Water Quality April 19, 2001 DW Q# 01-0466 Rockingham County APPROVAL of 401 Wa*r Quality Certification with Additional Condition Dear Mr. Livengood: 1 You have our appr val, in accordance with the attached conditions, to place fill in 90 linear feet of an unnamed tributary to Hogans Creek in order to cons ruct a roadway crossing for the Dogwood Acres subdivision in Rockingham County, as described in your application received by t e Division of Water Quality on April 2, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3289. This Certification allows you to use Nationwide Permit Numbers 14 when it is issued by the U.S. Arrhy Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project includi? g (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will e*ire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is o ly valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may b required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Cert ication and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in th future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be lid, you must follow the conditions listed in the attached certification as well as the additional condition listed below: 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whilchever is later). A sample deed notification format can be downloaded from the 401/Wetlands Unit web site at If you do not acce t any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you rec ive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the ffice of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter comple es the review of the Division of Water Quality under Section 401 of the Clean Water Act. We propose to linstall a street to meet NCDOT specifications in order for inclusion into NCDOT's system. In order to minimize the impact to the stream we are only proposing a 20' wide paved street. Thd location of the proposed road is the only access we have to a state road. We have also put re4rictions on the lots in this subdivision that join the stream. There is also, at this time, an old 50' wide farm crossing approximately 75' south of the proposed crossing that we intend to remove and restore the stream to its original state, if this application is approved. After restoring the banks Of the stream we will revegitate them with River Birch trees and Herbaceous plants that are commo to this stream.
