4a. Describe the existing conditions on the site and the general land use in the vicinityof the project at the time of this application:*
The project Site is a planned residential development that consists of an approximately 189.34-acre parcel located at 1408 & 1520 New Bethel Church Road, within Garner, North
Carolina (Wake County). The project Site is bound by New Bethel Church Road to the north and residential homes and forest to the south, west, and east. Appropmately 50 % of the site
is comprised of agricultural fields with the remainder of the site being occupied by hardwood forest and planted pine forest.
The proposed residential development will consist of 180 townhome lots and 364 single-family lots and associated amenities, roadway, stormwater control measures, and utility
improvements (i.e. public voter supply and sanitary sewer alignment).
A delineation of the Site was completed by S&EC in early 2019, and a site visit was conducted with Dave Bailey of the USACE on March 22, 2019 confirming the boundaries utilized for
avoidance and minimization during project planning. Impacts associated with the proposed project are limited to those necessary for one road crossing to connect the northern and
southern portions of the site, minor wetland and stream impacts associated with installation of a greenway system, and minor impacts to Zone 2 Stream Buffers for site grading.

The purpose of the project is to construct a single-family residential subdivision with community cohesion and the necessary amenities within the southeastern section of Wake County.

Magnolia Walk is a multi -phased residential development project that is located at 1408 & 1520 New Bethel Church Road, within Garner, North Carolina (Wake County).
The project site will include approximately 364 single family homes, 180 townhomes, and associated amenities (including roads, stormwater control measures (SCMs), utility
improvements, and a greenway).
All work will be conducted in accordance with local, state, and federal regulations. Traditional equipment will be used consisting of front-end loaders, bulldozers, paving equipment,
graders, and earth movers. SCMs are required and will be used.

S&EC submitted a combined Preliminary and Approved Jurisdictional Determination Request for the project Site. Dave Bailey of the USACE conducted a site inspection with S&EC on
March 22, 2019 reviewing and confirming the delineated boundaries utilized for site planning. The AJD portion of the reviewwas limited to a non -jurisdictional farm pond located within
high ground. All other areas were included as part of the PJD review. Please see attached confirmed delineation map and email from Dave Bailey confirming delineation.
Additionally, S&EC obtained a Buffer Determination from NCDEQ DWR confirming buffered features on -site (please see attached).

Magnolia Walk is a 3-phased residential development, consisting of 3 phases, which will be for the development of 364 single family homes, 180 townhomes, and associated amenities.
Phase 1 will total 68.47 acres and contain 129 single family homes with an average lot size of 5,175 square feet and 48 townhome units with a minimum width of 22 feet. Phase 2 will
total 58.33 acres and contain 128 single family homes with an average lot size of 5,175 square feet and 50 townhome units with a minimum width of 22 feet. Phase 3 will total 62.63
acres and contain 107 single family homes with an average lot size of 5,175 square feet and 82 townhome units with a minimum width of 22 feet.
This application takes into account impacts associated with all project phases.
The City of Raleigh is requiring a 60-ft wide public utility easement be placed along the southern portion of the property. However, there are no plans to develop this area for the
proposed development, and any future impacts would be the responsibility of the City of Raleigh.

Impact 3 consists of 798-sq. ft. of temporary wetland impacts in order to install a sewer line aerially through the area. Impacted areas will be stabilized
and re -seeded immediately following installation.
Impact 4 consists of 6,817-sq. ft. of permanent wetland impacts in order to install a road crossing, necessary to connect the northern and southern
portions of the project area. The road crossing will include the installation of a 48" Reinforced Concrete Pipe (RCP) culvert with NCDOT required
headwalls to either side, and the necessary grading of the surrounding area. The RCP will be countersunk underneath the road crossing to maintain
the hydrologic connection between the up gradient and down gradient portion of the wetland, with an up -stream invert of 246.80-ft above mean sea
level (AMSL) and a downstream invert of 245.90-ft AMSL. No riprap installation is proposed.

Impact 1 consists of 56-ft of permanent stream impact associated with the installation of a 48" corrugated plastic pipe (CPP) culvert to allowfor a
greenway trail crossing. The impact is necessary due to requirements of the local municipality to have a walking path connection in this area if no road
crossing is proposed. The proposed culvert will be countersunk beneath the greenway crossing to maintain the upstream and downstream hydrologic
connection, with an up -stream invert of 249.2-ft above mean sea level (AMSL) and a downstream invert of 248.5-ft AMSL.
Impact 2 consists of 44-ft of temporary stream impact necessary for the installation of an aerial sewer line. Down -stream flowwill be maintained during
installation and all impacted areas will be returned to previous conditions immediately following installation.

Impacts 5 through 9 are permanent impacts to Buffer Zone 2 along a portion of the stream buffer for delineation feature B is required for grading
associated with the proposed road crossing, sewer line, and stormwater control pond (proposed dry detention pond).

E. Impact Justification and Mitigation U
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
Impacts to jurisdictional features have been avoided and minimized to the mabmum extent practicable by incorporating resourceful site planning,
including utilization of the wetland/stream delineation to adjust the layout of the Site design to avoid and minimize impacts. The remaining impacts
proposed are necessary in order for the project's goals to be realized.
The proposed sewer line was designed at a minimal slope while staying as consistent as possible with natural grade. A portion of the sewer line was
designed as an aerial crossing to both avoid permanent stream/wetland impacts and allow for appropriate slopes. Further, the proposed sewer line
was placed in a way to minimize wetland and stream impacts to the mabmum eMent practicable and was adjusted to limit stream buffer impacts to only
portions of Buffer Zone 2.
Grading associated with storm oter controls was pulled in as close to the proposed roadway as possible to limit impacts to only a small portion of
Buffer Zone 2.
Only one road crossing is proposed for connecting the northern and southern portions of the proposed development, avoiding additional crossing
impacts down -stream. Further, the crossing was designed to use headwalls to minimize the amount of grading required. A culvert will be installed
beneath the crossing to maintain the hydrologic connection of the wetland up and down -slope.
Impacts associated with the development's 10-ft wide greenway trail system and the 30-ft public greenway easement (required by the local
municipality) were designed around the delineation in order to minimize the amount of crossing, and place all unavoidable impacts in upslope and
narrow areas, reducing impact amounts.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with
the requirements of the North Carolina Department of Environment and Natural Resources: Erosion Control Planning and Design Manual (May 2013)
and local codes. All work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground. The contractor shall
install silt fence, inlet protection, sediment traps, diversion ditches, temporary coffer dams, tree protection, and clearing only as necessary to install
devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case
less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is
required and will be kept by the owner's representative.
Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best
Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. Measures will be taken
to prevent oil, tar, trash, debris and other pollutants from entering adjacent jurisdictional features. Any excess excavated materials not utilized as back
fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore,
stockpiling of excavated material within jurisdictional waters of the U.S. will be strictly prohibited as part of the construction of this project. All project
construction activities initiated within jurisdictional waters of the U.S. will be carried to completion in an expeditious manner to minimize the period of
disturbance within jurisdictional waters.

There are 3 phases to this project. This permit request takes into account impacts associated with all project phases. The project will be completed

A USFWS IPaC Report and NCNHP Natural Heritage Database Report were utilized for review of potential protected species in the vicinity of the
project Site. Species identified by IPaC as potentially occurring in the vicinity of the site include the red -cockaded woodpecker, the Neuse River
waterdog, the Carolina madtom, the Atlantic pigtoe, the dwarf wedgemussel, the yellow lance, and Michaux's sumac. Further, Swift Creek, which
borders the site to the south-southwest, is identified as a proposed Critical Habitat area for the Atlantic pigtoe.
No occurrences of the aforementioned protected species were observed during site inspection. Due to the maintained nature of open areas on -site
and the absence of forested areas of an appropriate age and size, it is the opinion of Timmons Group that the proposed project may affect, but is not
likely to adversely affect the red -cockaded woodpecker and Michames sumac.
The NCNHP report indicates known occurrences of the dwarf wedgemussel, yellow lance, and Atlantic pigtoe within Swift Creek. However, the
proposed project will avoid impacts to Swift Creek, with only minor impacts (8-sq ft) to Zone 2 of its associated buffer. The project will have minimal
impact to streams and wetlands on -site. Further, a recent aquatics survey performed on the adjoining property to the west found no occurrences of
protected aquatic species. Therefore, it is the opinion of Timmons that the proposed project may affect, but is not likely to adversely affect aquatic
protected species.

According to FEMA Flood Insurance Rate Maps 3720162900J, 2720161900J, and 3720161800 (issued May 2, 2006), the majority of the site and
associated jurisdictional impacts are located within Zone X areas located outside of the 100-year floodplain.
The south -southwestern edge of the site is located within a portion of Zone AE, portions of the 100-year floodplain with base -flood elevations (bfe)
between 218 and 220-ft above mean sea level. Portions of the regulatory floodway are located within this along the property boundary.
Impacts to jurisdictional features within this area are limited to those associated with the proposed 30-ft wide public greenway easement required by
the local municipality. This easement was designed around the jurisdictional feature delineation in order to avoid and minimize impacts to the maximum
extent practicable.

MAGNOLIA WALK RESIDENTIAL DEVELOPMENT PROJECT

This cultural resource background study has been prepared by Timmons Group for the
proposed Magnolia Walk Residential Development Project located in Garner, Wake County, North
Carolina (Figure 1). The project area of potential effects (APE) encompasses approximately 189
acres located at 1408 and 1520 New Bethel Church Road. The irregularly shaped APE is bound
by New Bethel Church Road to the north and residential homes and forest to the south, west, and
east. Approximately 50% of the site is comprised of agricultural fields with the remainder of the
site being occupied by hardwood forest and planted pine forest.
The proposed residential development will consist of 180 townhome lots and 364 single-
family lots and associated amenities, roadway, stormwater control measures, and utility
improvements (i.e. public water supply and sanitary sewer alignment). Extensive ground
disturbance is expected to occur as a result of construction.
Historic Map Research
Aerial photographs and maps (NETR and Google Earth, accessed 1/28/2020) indicate that
the project area appears to have been either forested or minimally developed since at least the
1970s.
Archaeological Resources
Timmons Group Secretary of the Interior qualified archaeologist, Jay Sander, M.A.,
conducted a review of the cultural resources database at the North Carolina Office of State
Archeology (OSA) on January 23, 2020. The proposed project APE extended one (1) mile from
the project’s area of direct effects.

One previous archaeological survey has been conducted within a one-mile- radius of the
APE (Table 1). That survey did not include any portions of the current APE. The review of the
cultural resources database also revealed that there are six previously recorded archaeological sites
within one mile of the current project area (Table 2), none of which are within or adjacent to the
APE. One of the aforementioned sites was determined to not be eligible for listing on the National
Register of Historic Places. The remaining sites have not been evaluated for eligibility.

Architectural Resources
The National Register of Historic Places (NRHP) is the United States federal government's
official list of districts, sites, buildings, structures and objects deemed worthy of preservation for
their historical significance. Archaeological sites and historic architectural resources which are
listed or eligible for listing to the NRHP are notable for the purposes of this study. Sites or
structures that have been noted but not considered for their significance are listed as “surveyed
only” or “not evaluated.”
Based on a review of the NCHPOWEB Online Mapper there are 19 previously recorded
historical sites within a 1-mile radius of the APE (Table 3). One of these, WA-R171, a house built
between 1900 and 1910, is located within the current APE. This residence has been surveyed only,

without a determination of eligibility. The remaining resources have been surveyed only or have
been destroyed.

Soils
The USGS Web Soil Survey (accessed 1/24/2020) depicts 7 soil series within the APE
(Table 4). Appling sandy loam (ApB), Cecil sandy loam (CeB and CeC), and Pacolet sandy loam
(PaD) are well drained soils with slopes of less than 15 percent.

Conclusions
Aerial photographs and maps (NETR and Google Earth, accessed 1/28/2020) indicate that
the project area appears to not have undergone much development since the 1960s.
There are no historical resources listed on or eligible for listing on the NRHP within or
immediately adjacent to the direct impacts APE. The reported presence of an unevaluated historic
resource (WA-R171) suggests that a qualified architectural historian may be required to evaluate
the property for eligibility. This recommendation is subject to review by the North Carolina OSA
and HPO. Once this document is submitted by the project proponent any further actions required
will be initiated by the North Carolina OSA and HPO.

The species list generated pursuant to the information you provided identifies threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by
your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife
Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended
(16 U.S.C. 1531 et seq.).
New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could change this list. Please feel free to
contact us if you need more current information or assistance regarding the potential impacts to
federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the
Act, the accuracy of this species list should be verified after 90 days. This verification can be
completed formally or informally as desired. The Service recommends that verification be
completed by visiting the ECOS-IPaC website at regular intervals during project planning and
implementation for updates to species lists and information. An updated list may be requested
through the ECOS-IPaC system by completing the same process used to receive the enclosed list.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally-listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally-protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

If your project contains suitable habitat for any of the federally-listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally-protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require
development of an eagle conservation plan (http://www.fws.gov/windenergy/
eagle_guidance.html). Additionally, wind energy projects should follow the wind energy
guidelines (http://www.fws.gov/windenergy/) for minimizing impacts to migratory birds and
bats.
