Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The project site consists of an approximately 9.4 acre parcel located at 1021 Morrisville Parkway in Morrisville, North Carolina within Wake County. The property is currently occupied by a commercial structure and associated parking, a primarily pine -dominated forested area, and approxmately 364 feet of intermittent stream. The project site is bound by commercial use to the north and east, by a mixed hardwood/pine stand to the south, and by a railroad right-of-way to the west. 4b. Explain the purpose of the proposed project:* The purpose of the project is to complete necessary upgrades to the building located on -site to retrofit it for a commercial mini -storage facility and neighborhood shopping center with shops and restaurants to provide residents within this community in eastern Wake County with additional storage and shopping options. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The proposed commercial storage facility, known as Bee Safe Storage - Morrisville, will retrofit the building currently on -site so that it consists of one, 2-story mini -storage facility and a 1-story neighborhood shopping center that includes both retail and restaurant spaces. Additional roadway, stormwater control measure (SCMs), and utility (i.e. public water supply and sanitary sewer alignment) improvements Will also be made. The majority of the riparian stream buffer impacts are due to the Town of Morrisville's mandatory requirement that this project construct a pedestrian greenway trail and bridge located along the western edge of the property. Installation of the trail will include construction of a bridge (by others) to allow pedestrian access from one side of the unnamed stream, located along the southern edge of the site, to the other. This bridge will result in 212 square feet and 34 linear feet of temporary stream impacts, 2,065 square feet of permanent Zone 1 buffer impacts, and 1,418 square feet of permanent Zone 2 impacts. This project requires the replacement of an existing stormwater pipe, resulting in 593 square feet of permanent Zone 1 buffer impacts and 903 square feet of permanent Zone 2 buffer impacts. All of the proposed buffer impacts for storm pipe replacement will occur within previously disturbed areas, replacing the existing system with a similar but improved pipe. The Town of Morrisville requires a mandatory wet detention pond SCM for stormwrater quality and detention. This detention pond with be located entirely outside of jurisdictional stream and buffer areas. However, 1,532-sq. ft. of temporary disturbance along the edge of the Zone 2 buffer is required for temporary construction access. All work will be conducted in accordance with local, state, and federal regulations. Traditional equipment will be used including front-end loaders, bulldozers, paving equipment, graders, and earth movers. SCMs are required and Will be used. 4j. Comments: In order to construct the pedestrian greenway bridge across the stream to connect the greenway trail, temporary stream impacts are required. Construction of the proposed pedestrian greenway bridge requires a temporary stream crossing consisting of 2, 18-inch corrugated metal pipes (CMPs) and rip rap that are anticipated to disturb an approximately 34-ft long by-6.24-ft wide segment of stream. A temporary tree protection fence and temporary silt fence are also required. Upon completion of the greenway bridge, the rip rap and CMP will be removed from the stream, the tree protection and silt fences will be removed, and all disturbed areas will be stabilized and seeded at the end of construction. 6. Comments: The Town of Morrisville is requiring that his project construct a pedestrian greenvoy trail along the western edge of the property, Which includes the installation of a pedestrian bridge across the existing stream on -site to allow pedestrian access across the stream. Permanent impacts for the bridge crossing include asphalt paving of the walkway and grading along the top of the stream bank. The finished bridge requires 2,065 square feet of permanent impacts in Zone 1 and 1,418 square feet of permanent impacts in Zone 2. These impacts are categorized as "Allowable" as long as there is no practical alternative and require written authorization from the DWR. In order to improve on -site SCMs, replacement of an existing storm pipe and riprap apron are proposed. This will result in 593 square feet of permanent Zone 1 and 903 square feet of permanent Zone 2 buffer impacts. These impacts are "Exempt" from the buffer rules. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Impacts to jurisdictional features have been avoided and minimized to the mabmum extent practicable by incorporating resourceful site planning, including the utilization of the stream delineation to adjust the layout to avoid and minimize impacts during the design phase of the project. The proposed impacts are required in order for the project's goals to be realized. Additional stream impacts were avoided by aligning the impacts at the narrowest point of the stream. Additionally, the proposed overall site plans completely avoid all streams and associated buffers. In order to minimize temporary stream impacts associated with construction, two (2) temporary 18" corrugated metal pipe (CMP) culverts will be installed to maintained hydrologic connection between the up gradient and down gradient of the stream. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with the requirements of the North Carolina Department of Environment and Natural Resources Erosion Control Planning and Design Manual (May 2013) and local codes. All work will take place during dry conditions and can be facilitated from high , non -jurisdictional, stable ground. The contractor shall install silt fence, inlet protection, sediment traps, diversion ditches, temporary coffer dams, tree protection, and cleaning only as necessary to install devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept by the owner's representative. Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. Measures will be taken to prevent oil, tar, trash, debris and other pollutants from entering the adjacent jurisdictional features. Any excess excavated materials not utilized as back fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore, stockpiling of excavated material within jurisdictional waters of the U.S. will be strictly prohibited as part of the construction of this project. All project construction activities initialed within jurisdictional waters of the U.S. will be carried to completion in an expeditious manner to minimize the period of disturbance within jurisdictional waters. 2. The USFWS IPaC search for the proposed project's site (Consultation Code 04EN2000-2020-SLI-0594, Event Code 04EN2000-2020-E-01333) identified three (3) federally listed endangered species as potentially occurring in the vicinity of the project site: red -cockaded woodpecker (Picoides borealis), dwarf wedgemussel (Alasmidonta heterodon), and Michaux!s sumac (Rhus michauxii). Additionally, the IPaC identified one (1) proposed endangered species, Carolina madtom (Noturus furiosus), and two (2) proposed threatened species: Atlantic pigtoe (Fusconaia masoni) and Neuse river waterdog (Necturus lewisi). Construction activities on -site associated with the proposed project may affect but are not likely to adversely affect the reported threatened and endangered species within the proximity of the project site. The eAsting disturbed nature of the site does not provide adequate habitat for the red - cockaded woodpecker, Carolina madtom, dwarf wedgemussel, Atlantic Pigtoe, or the Neuse river waterdog, which require relatively to completely undisturbed habitats. Further, given the maintained nature of the site, no suitable habitat for Michawes sumac is present. In addition, the INC NHP report did not identify known occurrences of the 6 federally listed species within the project site limits or within a 1-mile radius around the project site. Further, the proposed project has minimal impacts to streams and buffers with the absence of permanent stream impacts and plans to stabilize and seed all disturbed buffer areas after construction is complete. Therefore, it is the opinion of Timmons that the proposed project WII have "no effect" on the aforementioned protected species. The project site encompasses approximately 9.36 acres and is located at 1021 Morrisville Parkway in Morrisville, North Carolina within Wake County. The project site is further described as Wake County Parcel Identification Number (PIN) 0754292407. The project site is located within the Neuse River Basin (HUC 030202010801) within the Upper Crabtree Creek watershed. The project site drains to an unnamed tributary to Crabtree Creek which has a NC Division of Water Resources Stream Index Number of 27-33-(1) and a Stream Classification of Class C and Nutrient Sensitive Waters (NSW). The project site does not contain a floodplain or floodway according to NC FIRM Map 3720075400J (map revised May 2, 2006). The project site is comprised of existing commercial/industrial building, parking facilities, forested areas, and an intermittent tributary to Crabtree Creek. The project site was delineated based upon the methodology outlined in the 1987 U.S. Army Corps of Engineers (USACE) Wetland Delineation Manual and the Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Eastern Mountains and Piedmont Region (Version 2.0). In addition, streams were delineated based upon the methodology outlined in the North Carolina Division of Water Resources (DWR) Methodology for Identification of Intermittent and Perennial Stream and Their Origins (Version 4.11). Based on our field investigations, the following waters of the U.S. and buffers were identified within the project site and are depicted on the attached Figure 3: Waters of the U.S. Delineation and Neuse Riparian Buffer Delineation Map. SUMMARY OF FINDINGS & RECOMMENDATIONS Waters of the U.S. - One (1) intermittent stream, Stream A, was identified within the project site. A total of approximately 364 linear feet of streams were flagged within the subject property. It should be noted that the stream has not been field surveyed by geomatics; and therefore, the size and dimensional limits within the project site are subject to change. Stream Buffers - There are 50-foot Neuse River Riparian Buffers associated with the intermittent stream feature located within the project site. Recommendations - Please note these are preliminary findings as the limits of waters of the U.S. and buffers will need to be verified by the USACE and DWR. Timmons recommends scheduling CIVIL ENGINEERING I ENVIRONMENTAL I SURVEYING I GIS I LANDSCAPE ARCHITECTURE I CONSTRUCTION SERVICES concurrence meetings with the USACE and DWR to verify the limits and potentially reduce the encumbrances of these features, as the verified location of these features will affect overall site planning. WATERS OF THE U.S. PERMITTING A Nationwide Permit (NWP) can be utilized if the project is designed to impact less than 0.50-acre of jurisdictional wetlands/waters of the U.S. including a maximum of 300 linear feet of important/mitigatable stream channel impact. Pre -construction notification and approval from the USACE is required for any wetland and/or stream impacts associated with residential, commercial, and/or institutional development. The processing time for a NWP pre -construction notification is 45 days with the USACE and 60 days with DWR. All projects qualifying under a NWP are required to submit a report (post -construction notification) within 30 days of completing the construction activity, describing and quantifying the impacts and stating that the conditions of the NWP have been adhered to. Cumulative impacts for residential and commercial projects over the NWP thresholds (over 0.50- acre of wetland impact or 300 linear feet of stream impact) will require an Individual Permit (IP). Individual Permits require an analysis to determine that the proposed impact to waters of the U.S. is the least environmentally damaging practical alternative, typically require compensatory mitigation, notification to adjacent property owners, a public notice, and may require a public hearing. Mitigation Fees for Stream and/or Wetland Impacts The USACE can require mitigation for any stream or wetland impacts. In most cases, stream mitigation is not triggered until stream impacts approach 150 linear feet; wetland mitigation is usually triggered when impacts exceed 0.1 acre. The following is the current fee schedule, as of October 6, 2017, from the NC Division of Mitigation Services (DMS), allowing for payment to offset wetland and stream impacts. ,�• � -� �"�.� � �-"�'�`_'� � �--�_��.'� - � ,---�a�'�. ram' ". The subject property is located within the Neuse River Basin (Hydrologic Unit Code 030202010801) and DWR has adopted buffer rules for the Neuse River Basin. This rule applies 50-foot wide riparian buffers directly adjacent to surface waters (intermittent and perennial streams, lakes, ponds, and estuaries) excluding wetlands. For the purposes of this rule, surface waters must be present in the field and be depicted on either the USDA County soil survey map and/or the most recent USGS topographic quadrangle map. Stream A is depicted on the Soil Survey and therefore is subject to the Neuse River Buffer Rules. Within the protected 50-foot wide stream buffer, DWR's Neuse River Basin Buffer Rules establish a restricted "Zone 1" buffer of 30-feet from edge of water, and a less restrictive "Zone 2" buffer being the outer 20-feet of the 50-foot wide stream buffer. Allowable development activities within either of the two zones of the 50-foot wide stream buffer is dependent upon the type of use (Table of Uses - DWR's Neuse River Basin) within the zones and whether that activity is designated as exempt, allowable, allowable with mitigation, and/or prohibited. In general, perpendicular utility and roadway crossings are allowable uses, while new impervious structures, such as buildings, parking lots, and etc., are considered prohibited uses within the stream buffer. The following are examples of the limited uses allowed within Zone 1 (inner 30-foot): (1) Perpendicular crossings (between 75 degrees and 105 degrees, as measured from the stream centerline) for driveways, streets, roads, sidewalks, and associated bridge components; (2) Perpendicular overhead and underground utility crossings (between 75 degrees and 105 degrees, as measured from the stream centerline); (3) Perpendicular (between 75 degrees and 105 degrees, as measured from the stream centerline) greenways/hiking trails; that do not impact diffuse flow conditions; (4) Elevated greenways/hiking trails; (5) Fences that do not remove forested vegetation. The following uses are allowed in the less restrictive Zone 2 (the outer 20-foot): (1) All uses allowed in the stream side zone; (2) Overhead and underground utilities; (3) Greenways/hiking trails (4) Playground equipment; and (5) Some stormwater best management practices. Mitigation Fees for Neuse Buffer Impacts Uses within the buffer that are deemed allowable with mitigation require riparian buffer mitigation to offset the impacts.
