APPROVAL of 401 Water Quality Certification
Dear Mr. Webb:
You have our approval, in accordance with the attached conditions, to modify the existing floating dock
configuration to accommodate a larger boat on your property in New Hanover County, as described in your application
received by the Division of Water Quality on March 19, 2001. After reviewing your application, we have determined that this
fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit
when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge
and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires
unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application for a new certification. If the property is
sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in
the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

configuration to accommodate a larger boat.

9. PROJECT DESCRIPTION:
The project site is located adjacent to Banks Channel, at 208 Water St., in Wrightsville Beach,
in New Hanover County. The lot is 100 feet wide and approximately 98 feet in depth from the
Water St. right-of-way. The lot is developed, consisting of the applicant's residence and the
existing pier and docking facilities. The waterward side (northwest) of the property is stabilized
by a wooden bulkhead. The lot averages approximately 8 feet above mean sea level. Vegetation
on the lot consists of lawn grasses and landscaped shrubs. The existing pier is 74 feet long and
6 feet wide, with a gazebo/T-head (48' X 16') at its waterward end. A U-shaped floating dock
is accessed by a ramp off the front of the T-head. The main dock is 32 feet long and 8 feet wide,
with a perpendicular finger dock (16' X 8') at either end. There are two (2) mooring piling
clusters, approximately 12 feet waterward of the end of each finger dock. There are two additional
finger docks (20' X 6') located on opposite sides of the pier on the landward side of the T-head.
There is a boatlift (14' X 12') adjacent to the northern finger dock, and 2 jet ski davits attached
to the pier walkway. Except for the mooring piling clusters the existing facilities are within the
Wrightsville Beach Pierhead Line. Adjacent lots are developed and exhibit similar piers.
The Wrightsville Beach Land Use Plan classifies Banks Channel as Conservation, and the adjacent
highground in the project area as Developed. The waters of Banks Channel are classified as SA
by the N.C. Division of Water Quality. They are not designated as a Primary Nursery Area by
the N. C. Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish.
The applicant proposes to modify his existing private pier to accommodate mooring of a 63'
Hatteras which he has recently purchased. The modification would consist of re-configuring the
U-shaped floating dock system, by relocating the two finger docks to each end of the main dock.
The resulting floating dock would be 64 feet long and 8 feet wide. The applicant would remove
the two noncompliant mooring piling clusters and install two new steel mooring pilings within the
established Wrightsville Beach Pierhead Line. The two jet ski lifts would also be removed from
existing pier and docking facilities.
10. ANTICIPATED RUFACT
The proposed reconfiguration of the floating docks would not incorporate any additional estuarine
waters or public trust area. The project would reduce the number of boats that could be docked
at the existing pier, from 9 slips to 5 slips, while still providing mooring for the applicant's new
larger boat.

Please note that original drawings are. preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

Dear Sir:
The reason for this applicaton is to modify my existing dock and pilings as shown on the enclosed survev in
order to accomadate my new 63 foot Hatteras Motoryacht which is due to be completed in late March 2001.
The three outer slips will be converted to one slip parallel to Banks Channel. I will also remove the two
waverunner slips[and their two support pilings] which are parallel to the walkway leading to the main dock.
The new dock will be 64 feet long and will simply require straightening the current C shaped dock and
centering it on the current fixed platform. Since my lot is 100 feet wide this will allow 18 feet of clearance
between the new dock and the lateral property lines on each side. The two outer cluster pilings will be
replaced by two steel pilings which will be closer to the main dock. In summary, five slips will be converted
to one and the resulting structure will have appropriate setbacks with respect to the adjacent properties.
My wife and I would greatly appreciate receiving the approval as soon as possible.

The Wilmington Regional Office received a copy of the CAMA Major Permit Application for relocating an existing
dock on February 28, 2001. Staff review of the plans and specifications has determined that the development activities
proposed at this time will not pose a threat to surface water quality from storm water runoff. The Director has determined that
projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should
not be subject to the storm water management permitting requirements of 15A NCAC 2H.1000. By copy of this letter, we are
informing you that your project will not require a stormwater management permit.
If the subject project disturbs five acres or more and has a point source discharge of stormwater runoff, then it is also
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are
required to have an NPDES permit for stormwater discharge from projects meeting these criteria. The siortmwater rules
require the Division to permit the common plan of development, therefore, any future development on the property, regardless
of whether a CAMA Major permit is also required, will require a Stormwater Management Permit application and permit
issuance from the Division of Water Quality prior to any construction.
