You reported that continued permit coverage is not required because the site activities are not regulated bv the NPDES stormwater permitting program. ❑ Note other basis: IrDEMLR Regional Office (RO) inspection and concurrence ❑ No RO inspection. We are relying on your representation that a permit is no longer required. Discharging regulated industrial stormwater, discharging wastewater, or operating a treatment facility without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. The Division may pursue enforcement action on persons that have voluntarily relinquished permit coverage when continuing permit coverage was necessary. If in the future you wish to again discharge to the State's surface waters, you must first apply for and receive new coverage under an NPDES permit. I was able to get to these facilities on 1/26/2016 and here's what I found/recommend: NCGNE1091— Westrock Converting Company —This is only a warehouse for storage of packaged materials. No process or production. NCGNE1089 — Westrock Converting Company —This is only a warehouse for storage of packaged materials. No process or production. NCGNE1090 — Westrock Converting Company —This is only a warehouse for storage of packaged materials. No process or production. I believe the above mentioned permits should be rescinded. I also conducted an inspection of the main Westrock facility. There is a new Env. Mgr. and he's trying to get up to speed. Here's what I found and have questions on: 1. Their current permit appears to still be in the name of Rock Tenn In -Store Solutions, Inc. (COC NCG180003). Was there a request for a name change? If not, can you guide him on this process? 2. He does not find their permit on site (only the cover letter). Can you send this to him? 3. 1 have nothing in our paper or electronic files for a facility in this name or with this COC and I don't know why it would even be a Textile COC. Can you help me with this? 4. There are currently 3 outfalls per their SWPPP (which is pretty complete). But I think only two are representative of the facility. - 5. The facility is very clean with very little minor production, but without more information I don't know what else to say about the facility. 6. The current contact is: Alan Hooper at 828-248-4921. Please advise me on what to do next with this! He would like to know what he's supposed to be doing. Thanks! ROCK TENN-IN STORE SOLUTIONS \ SPCC APPLICABILITY FOR AFA WAREHOUSE ON PINE STREET MAY 20, 2015 RockTenn leases the AFA warehouse, which is serviced by three utility -owned transformers, each with an oil holding capacity of approximately 700 gallons. RockTenn has not developed a Spill Prevention Control and Countermeasure (SPCC) plan at the ASA warehouse due to the following: a. These transformers are owned, operated, and controlled exclusively by Duke Power b. Duke Power has exclusive access to the transformers. The transformers are locked, and only Duke Power has the key. c. Duke Power is responsible for addressing/cleaning up any transformer leaks and managing other facility -related issues directly involving the transformers; Duke sent an email stating this to Rock Tenn on April 13, 2015. d. There are no other transformers on the property of the leased warehouse and RockTenn does not own, operate, or control any transformers as part of its warehouse operation on the leased property. Based on these factors, RockTenn has determined that the transformers are a separate "facility" as defined in 40 CFR 112.2, which is not owned, controlled, or operated by RockTenn. Excluding the transformers since they are a separate facility, RockTenn's warehouse operation on the leased property has far less than 1320 gallons of aboveground oil holding capacity (There are no oil storage containers/drums 55 gallons or greater in the warehouse under Rock Tenn control) so it is not required to develop and implement an SPCC plan for its warehouse operation. In the event warehouse personnel discover a leak or other problem associated with the transformers, they would immediately contact Duke Power at and report the problem. A condition of no exposure at an industrial facility means all industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to prevent exposure to rain, snow, snowmelt, and/or runoff. For permitted facilities in North Carolina, DEMLR must approve your application for No Exposure Certification before this exclusion is effective. Until you are issued a No Exposure Certification and your NPDES permit is rescinded, your facility must continue to abide by the terms and conditions of the current permit. Industrial materials or activities include, but are not limited to: material handling equipment or activities, industrial machinery, raw materials, intermediate products, by-products, final products, or waste products. Material handling activities include the storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is not required for the following industrial materials and activities: drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed" means banded or otherwise secured and with locked or non -operational taps or valves; adequately maintained vehicles used in material handling; and final products, other than products that would be mobilized in stormwater discharges (e.g., rock salt). A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is available on a facility -wide basis only —not for individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, you certify that a condition of no exposure exists at this facility or site and are obligated to comply with the terms and conditions of 40 CFR 122.26(g). The Regional Office may inspect your facility for compliance with no exposure conditions prior to that approval. The Regional Office may also inspect your facility at any time in the future for compliance with the No Exposure Exclusion. North Carolina General Statute 143-215.6 B(i) provides that: Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, or other document fled or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false statement of a material fact in a rulemaking proceeding or contested case under this Article; or who falsifies, tampers with, or knowingly renders inaccurate any recording or monitoring device or method required to be operated or maintained under this Article or rules of the [Environmental Management] Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine not to exceed ten thousand dollars ($10,000).
