II On 9/17/2009, the Division of Water Quality received your request to rescind you coverage under No Exposure Ntnnber NCGNE0307. In accordance with your request, No Exposure NCGNE0307 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stonnwater to waters of the State. without valid coverage under an NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per clay. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished permit coverage when, in ftct, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires oermit coverage, you should notify this office immediately. Furthermore, if in the future you wish to ag,rir.discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. Plant Manager 917 JR Industrial Dr. Sanford, NC 27331 Dee Freeman Secretary Subject: Stormwater Compliance Inspection NPDES Permit No. NCG050311f�N,CGNE`07—N,CGNE0308, and NCGNE0309 3M Sanford Lee County Dear Mr. Phillips: On March 20, 2009, Vicki Webb of the Raleigh Regional Office conducted a stormwater compliance inspection of the subject facility. The facility is located at 917 JR Industrial Dr. in Sanford, NC. The assistance of Cindi Webb, EHS Engineer, was greatly appreciated as it facilitated the inspection process. The following observations were made: NCGO50311 Stormwater runoff from this site is discharged to the receiving waters designated as Carrs Creek, a class C stream, in the Cape Fear River Basin. All components of the Stormwater Pollution Prevention Plan (SP3) were present including: detailed site map with labeled storm outfall, a list of potential contaminants, a spill and response plan, a narrative describing BMPs, and a contact list of whom to contact in an emergency. Please add phone numbers to the contact emergency list. Employee training records were on -site. This facility maintains good house keeping practices. The files are kept in a well organized fashioned. Such order eased the file review process. 3. Qualitative and quantitative inspection records were available for review and appeared complete. 4. The facility contains three stormwater outfalls. All three of the facility's stormwater outfalls were observed during the inspection. NCGNE0307, NCGNE0308, & NCGNE0309 5. Review of the three no -exposure permits for 3M Sanford was performed during the visit on March 20, 2009. While all three of the permits meet the no -exposure requirements, it was determined that the facilities falls under your NPDES permit NCG050311. To consolidate all of the permits, you will need to send in a request to rescind permits NCGNE0307, NCGNE0308, and NCGNE0309. Send to: Stormwater permitting Unit, Division of Water Quality, 1617 Mail Service Center, Raleigh, NC 27699-1617. Once you have rescinded your permits NCGNE0307, NCGNE0308, and NCGNE0309, you will need to update your SP3 to include the facilities and their outfalls. These three are covered by the stormwater permit conditions set forth in NCG050311. The overall condition of 3M Sanford is compliant with Division standards. Sullins, Deputy Director Division of Water Quality Subject: No Exposure Certification NCGNE0307 3M Sanford (Building 11) 926 JR Industrial Drive, Sanford, NC Lee County Dear Mr. Phillips: The Division has reviewed your submittal of the No -Exposure Certification for Exclusion from NPDES Stormwater Permitting form, which we received on September 22, 2006. Based on your submittal and signed ; certification of no exposure at the above referenced facility, the Division is granting your certification as provided for under 40 CFR 126.22(g), which is incorporated by reference in North Carolina regulations. Please note that by our acceptance of your no exposure certification, you are obligated to maintain no exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no - exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your conditional no -exposure exclusion expires in five years (October 31, 2011). At that time you must re -certify with the Division, or obtain NPDES permit coverage for any stormwater discharges from your facility. Your certification of no exposure does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances.
