The Division has reviewed your submittal of the No -Exposure Certification for Exclusion from NPDES
Stormwater Permitting form, which we received on August 5, 2003. We apologize for the extended period it
has taken us to get back to you on this request and we appreciate your patience as we have worked through
this process. Based on your submittal and signed certification of no exposure at the above referenced facility
the Division is granting your certification as provided for under 40 CFR 126.22(g) which is incorporated by
reference in North Carolina regulations.
Please note that by our acceptance of your no exposure certification, you are obligated to maintain no
exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no -
exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater
discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your
conditional no -exposure exclusion expires in five years (April 30, 2010). At that time you must re -certify with
the Division, or obtain NPDES permit coverage for any stormwater discharges from your facility.
Your certification of no exposure does not affect your facility's legal requirements to obtain environmental
permits that may be required under other federal, state, or local regulations or ordinances.

Dear Mr. Bennett,
Attached for your use is a "No Exposure Certification for Exclusion from NPDES
Storm Water Permitting."
Please note that the company name has changed since our last correspondence
from Biogen to Biogen U.S. Limited Partnership.
The following updates site information submitted to your office 8-3-00 which is
attached for reference. Also an updated sited map is attached.
1. The 50,000-gallon fuel oil storage tank and the 28,600-gallon
propylene glycol tank were installed as noted in the 8-3-00
correspondence.
2. The 10,000-gallon tank previously used to store fuel oil is not in
service.
3. Currently, as noted below, we have on -site 6 emergency
generators and 1 diesel driven fire pump. Refer to the attached
site map, note that 1 emergency generator is located inside the
facility and the fire pump is located inside a pump house.
• A Caterpillar 1100kw diesel fueled generator is used for emergency power.
It is located inside the facility (Room 1701). A 100-gallon day -tank serves
the generator. The day -tank is within a primary containment tank -capable of
holding 171% of the day-tank's volume.

• Three 2000kw emergency generators are located in the utility yard. They are
served by the 50,000-gallon fuel oil tank, which is located within a
containment area capable of retaining 214% of the contents of the fuel oil
tank. Piping from the storage tank to the emergency generators is above
ground.
• One 2000kw emergency generator is located north of building 5024. It is
served by a 2200-gallon double walled sub base fuel tank. The fill pipe is
located inside the structure housing the generator. There is an adjacent oil
truck unloading area that provides a containment volume of 9340 gallons.
• One 40kw emergency generator is located southeast of the parking deck to
provide emergency lighting for the parking deck. It is served by a 150-gallon
double -wall sub -base fuel tank.
• The diesel engine driven fire pump is served by a 187-gallon storage tank
within a 222-gallon containment structure within the pump house.

NODES Storm Water Permitting
Submission of this No Exposure Certification constitutes notice that the entity identified in Section A does not require permit authorization for its storm water
discharges associated with industrial activity in the State identified in Section B under EPA's Storm Water Multi -Sector General Permit due to the existence
of a condition of no exposure.
A condition of no exposure exists at an industrial facility when all industrial materials and activities are protected by a storm resistant shelter to prevent
exposure to rain, snow, snowmelt, and/or runoff. Industrial materials or activities include, but are not limited to, material handling equipment or activities,
industrial machinery, raw materials, intermediate products, by-products, final products, or waste products. Material handling activities include the storage,
loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is
not required for the following industrial materials and activities:
— drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed"
means banded or otherwise secured and without operational taps or valves;
— aasquarely maintained vehicles used in material handling; and
— final products, other than products that would be mobilized in storm water discharges (e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is
available on a facility -wide basis only, not for individual outfalls. If any industrial activities or materials are or will be exposed to precipitation, the facility is
not eligible for the no exposure exclusion.
By signing and submitting this No Exposure Certification form, the entity in Section A is certifying that a condition of no exposure exists at its facility or site,
and is obligated to comply with the terms and conditions of 40 CFR 122.26(g).
ALL INFORMATION MUST BE PROVIDED ON THIS FORM.

Subject: Category 11 Exemption for Biogen Inc. 5000 Davis Drive Wake County,
Research Triangle Park, NC 27709
Dear Mr. England:
Biogen, Inc. is expanding the facility located at 5000 Davis Drive in Research Triangle Park, North
Carolina. To support the new Large Scale Manufacturing (LSM) Facility, Biogen will install
additional outdoor storage tanks for fuel oil, propylene glycol and wastewater. Figure 1 illustrates
the new campus layout with the location of the tank and containment areas marked for your
information.
The new structures include a 50,000-gallon carbon steel tank for the storage of No. 2 fuel oil to be
used as fuel for the boilers and generators. A 28,600-gallon carbon steel tank will be installed for
storing propylene glycol for chiller systems and two 10,000-gallon fiberglass tanks for the storage
of process wastewater. The four tanks and associated pumps are placed together within one
containment pad with a total holding capacity of 106,814 gallons (214% of the largest tank).
The existing 10,000-gallon fuel oil lank will either be closed in place or converted to store irrigation
water as applicable.
On August 3, 1998 Biogen was granted a Category 11 Stormwater Exemption from your office.
We respectfully request that this exemption be extended to include the new structures. To ensure
that stormwater exposures have been eliminated the following procedures have been instituted:
• Virgin chemicals are stored and used throughout the facility: in the laboratories, production
areas, and maintenance/service areas. Containers vary in size from small vials to 55-gallon
drums and 400-gallon totes. Chemicals are received at the warehouse loading dock where
they are transferred from trucks direct into the building with no exposure to outdoor elements,
including stormwater.
• Wood pallets/crates are stored in covered dumpsters before they are shipped off site for
recycling.
• Guardsmark, Inc provides physical security for the facility and construction area on a 24-hour
basis. A card access system is used to enter the facility. Twenty-four hour TV surveillance

• and inspection rounds of the construction site are used for security and the possibility of
vandalism is remote.
• All chemicals and process materials are stored/used within this secured limited access facility.
Hazardous waste is stored in a locked, secured small building adjacent to the warehouse
structure. The location of the hazardous waste storage building is noted on Figure 1.
• Loading and unloading of fuel oil, glycol and wastewater is conducted within a bermed area,
which draws to a sump. Prior to material transfers, the Biogen operator in charge, who will be
present during the entire transfer, follows a fixed sequence of steps designed to insure that
the possibility of a spill is minimized.
• Sump control valves are kept locked and the keys to the valve are contolled by the Biogen
Key Control Program. Procedures are in place to insure that stormwater is inspected by the
Biogen operator in charge before it is released.
• Used oil is collected in small containers and carried to the hazardous waste storage building
where it is accumulated in a 55-gallon drum. The drum is on a containment pad capable of
holding 314 gallons. Wastes are shipped off -site for disposal or recycling by a licensed
transporter.
• Biogen follows Best Management Practices for product loss prevention, accident prevention,
fire prevention and environmental management. They include:
1. Good Housekeeping
2. Preventive Maintenance
3. Quarterly Visual Inspections
4. Spill Controls and Countermeasures
• An Emergency Control Group is in place to ensure that adequate emergency response
procedures are implemented, establish communications with support agencies, and
coordinate release of information.
