This is in regards to your memo dated May 11, 2001 (copy attached). In your memo, you
recommend that the Division of Coastal Management (DCM) place the subject project on hold until
it is determined whether any fill for the soccer field will be within 30 feet or 50 feet of the normal
water level (NWL) contour of the Pamlico River. Attached is a copy of a scaled drawing provided
with the application showing the location of the soccer field upon which the applicant is proposing
to place fill material to level the area. I have scaled off the 30 foot and 50 foot lines from the NWL
on the attached drawing for your review. I also want to advise you that, in accordance with
T15A:07J.0204(d), I cannot put this project on hold due to the fact that the applicant did in fact
provide the necessary information with the original permit application. Therefore, our processing
clock is continuing to run
Your memo does raise some questions that need to be answered so that my staff will know
how to proceed with the processing of this permit application. My questions are as follows:
1. Does your request mean that no 401 Certification will be issued for the riprap and rock
jetties until the buffer issue(s) is resolved?
2. Can DCM issue the permit with the requirement that a variance from the Tar Pamlico Buffer
rules must be granted by the Environmental Management Commission before the proposed
fill for the soccer field can go forward?
I would appreciate a timely response from your office in response to these questions to
enable us to move toward a final permit decision on this project. Thank you in advance for you

Dear Mr. And Mrs. Price:
On May 4, 2001, Joanne Steenbuis and Noelle Lutheran of the Wilmington Regional Office conducted a
site visit to the above-mentioned property in Brunswick County. The inspection and subsequent review of your
activity, revealed that fill material has been placed in wetlands. A review of DWQ (Division of Water Quality)
files and discussions with Allen Davis of the Corps of Engineers confirm that no 401 Certification and no 404
permit has been issued for this activity, a requirement pursuant to 15A NCAC 2H .0500.
The filling of wetlands for road crossings of streams without a 401 Water Quality Certification
represents wetland standards violations. Specifically, 15A NCAC 2B .023(b) (1) and (5) which states the
following:
1) Liquids, fill or other solids or dissolved gases may not be present in amounts which may cause
adverse impacts on existing wetland uses;
5) Hydrological conditions necessary to support the biological and physical characteristics naturally
present in wetlands shall be protected to prevent adverse impacts on:
C) The chemical, nutrient and dissolved oxygen regime of the wetland;

D) The movement of aquatic fauna;
F) Water levels or elevations.
This Office requires that violations, as detailed above, be corrected immediately. In addition, please
note, these violations and any future violations are subject to civil penalty assessment of up to $25,000.00 per
duly for each violation.
This Office requests that you provide a written response within fifteen (15) days following receipt of this
letter. Your response should clearly explain why you did not apply fora proper individual 401 Water Quality
Certification for the wetland fill.
Until such time that you have received a permit from the Army Corps of Engineers, you will be
considered in violation of wetland standards. Thank you for your attention to this matter. Enclosed is an
application for 404/401 permits. Your contact is Allen Davis with the Army Corps of Engineers for Brunswick
County; his telephone number is (910) 251-4466. If you have any other questions concerning the 401
Certification, please call Joanne Steenhuis at (910) 395-3900.

APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Sirs:
You have our approval, in accordance with the attached conditions, to place fill in 0.18 acre of non-vegetated wetlands (river
bottom) in order to stabilize 1,650 feet of shoreline with rock rip-rap and backfill to the 3-foot elevation contour and refurbish and extend 3
existing rock jetties in Dare County, as described in your application received by the Division of Water Quality on March 14, 2001. In-your
application, you also proposed to add fill in Zones 1 and 2 of protected Tar-Pamlico Buffers in order to increase the elevation of a soccer
field. Fill shall be allowed but must be limited to Zone 2 of the Tar-Pamlico Buffer and must not extend into Zone 1. After reviewing your
application, we have determined that this fill is covered by General Water Quality Certification Number 3274, which can also be viewed on
our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when it is issued by
the NC Division of Coastal Management. This approval is also valid for the Neuse River Buffer Rules (15A NCAC 213 .0259). In addition,
you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA
Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must
be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h).
For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below:
1. Fill within Tar-Pamlico Buffers associated with the soccer field is allowed only in Zone 2. No fill in Zone 1 is permitted;
2. An additional condition is that stormwater shall be directed to diffuse flow at non-erosive velocities through the protected stream
buffers.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

Environmental Setting
The applicant is the Town of Washington Park which is located in Beaufort County. A
portion of town property comprises the town park known as Riverfront Park and it lies adjacent to
both the Pamlico River and Runyon Creek. Riverfront Park encompasses approximately 2,300 feet
of linear shoreline with ±450 feet in the center along the Pamlico River belonging to private land
owners. The park averages 100' in width and can be divided into 3 distinct zones: 1) The area
immediately adjacent to the Pamlico River is vegetated with cypress trees and a sporadic fringe of
Spartina patens is present on the crest of the various sand overwash areas. Exposed tree roots and
erosion escarpments show evidence of erosion between the sand overwash areas. Two brick
bulkheads (102' and 105' long respectively) exist on the project site. Two 10' long rock jetties and
a 15' long rock jetty are present at the eastern end on the park. 2) The area from the shore landward
to ±50' is vegetated with mixed pines, various hardwoods, vines, and upland grasses. 3) The
landward most portion of the project site is maintained lawn grass and in the widest section (±150')
a soccer field exist. The soccer field has subsided in the last 5 years and it is ponding water during
major storm events.
The project site is bordered on the east (downstream). side be a developed lot with a dwelling
and maintained lawn. The upstream (north) end of Riverfront Park terminates at the NC 32 bridge
crossing of Runyon Creek.
The Pamlico River at the project site has been classified as SC-NSW by the Environmental
Management Commission and is closed to shell fishing.
Project Proposal
The Town of Washington Park is proposing to stabilize the shoreline by installing 11,650'
of rock rip averaging 5' waterward of the normal water level (NWL). The area landward of the new
riprap will be filled to the 3' elevation contour. The upland area to be filled averages 15.7' in width
with a range of 5' to a maximum of 30'. At the east end of the park, the applicant proposes to rock
around 5 individual cypress trees in an effort to offer protection in future storm events. This rock
will extend a maximum of 15' waterward of the NWL. The existing brick bulkheads are to be
stabilized with rock riprap that will project 6' below the NWL in these two areas.
The applicant proposes to extend the 3 existing rock jetties to a total of 25' waterward of the
NWL. The refurbished jetties will have.a base width of 9' with a 3:1 slope and a 1' projection above
the NWL. The existing PVC dry hydrant pipe at the east end of the project site is to be removed.
The existing soccer field will be leveled by adding ±1' of earthen fill in a ±120' by ±83' area
and reseeding.

The project as proposed will result in the filling of ±7,995 ft' of river bottom associated with
the placement of the riprap and jetty extensions. Some short term turbidity is probable as a result
of the riprap installation and rock jetty extensions. The backfilling and upland impact will result

Dear Mr. Moye:
Enclosed please find a CAMA Major Development permit submitted in
behalf of the Town of Washington Park. The town is seeking an approved
permit to stabilize the shoreline along Riverfront Park, which has .
experienced isolated erosion; and create a level soccer field. The project
can be divided into four segments:
Site One - placement of stone riprap to stabilize existing brick
bulkhead
Site Two - extension of three existing rock groins to 25' from
shoreline, and filling of existing highground to create level soccer
field
Site Three - stabilize existing brick bulkhead by placing rock riprap
in front of structure, and removing the existing pipe that extends
into the river
Stabilize the entire shoreline along the Pamlico River (1,650' linear
- existing brick bulkheads included) by placing rock riprap along the
existing shoreline and backfilling to the 3' contour interval on land;
additional stabilization of isolated trees with riprap (1' above the
NWL)
Site One
The town proposes to place stone riprap (NCDOT Class Two) 6' wide
around the existing 102' brick bulkhead. The rocks will create an "L"
around the upstream "L' of the bulkhead, as you suggested (see
drawings).
Site Two
There are three existing rock groins that extend from the shore. Two are
10' from shore; the other is 15'. All three extend approximately 1' above

the normal water level. The town wishes to extend these groins so that
they all are 25' from the shore. This will stabilize the area and hopefully,
in time, create a small breach area for the enjoyment of the town citizenry.
At present, the park has a soccer field, which is not level. This application
proposes to fill the contiguous low area (120'x83') to a depth of 1', thereby
insuring good footing and a level playing field. Fill material will come from
an approved upland source and be spread by tractor. (see drawings)
Site Three
There is an existing brick bulkhead (105' long) that the town proposes to
stabilize. A, 6' wide band of NCDOT Class Two stone riprap will
encompass the outside of the bulkhead and wrap around the existing "L's"
on each end.
The town would like to place the same riprap material starting15' from the
property line of Dorothy Scott and continue upstream for 800' along the
shoreline. Also, starting at a point 15' from property of Zeno Edwards, the
town wishes to extend a rock riprap 850' downstream to a point 15' from
the property of Henry Rumley (see drawing). In addition, the town
proposes to protect a few isolated trees that extend out from the shore by
placing the riprap around the trees to a depth of 1' above the NWL. This
riprap will tie into the riprap that stabilizes the shoreline. All riprap slopes
will be 3:1.
The above activities will enhance the use of the Riverfront Park and
provide a stable shoreline. Thank you for your favorable consideration of

Reference the application of the Town of Washington Park for a Department of the Army
(DA) permit to place rock riprap material along an eroding shoreline and repair existing rock
jetties, on property located at Riverfront Park, adjacent to the Pamlico River, in the Town of
Washington Park, Beaufort County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the application
and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with
the permit plans, which are a part of this permit.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized,
or if, in the opinion of the Secretary of the Army or his authorized representative, said structure
or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate,
or alter the structural work or obstructions caused thereby, without expense to the United States.
No claim shall be made against the United States on account of any such removal or alteration.

water level elevation contour at any point along its alignment.

6. The riprap material will be clean and free of any pollutants except in trace quantities.

7. No attempt will be made by the permittee to prevent the full and free use by the,public
of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must
not interfere with the public's right to free navigation on all navigable waters of the United States.
