This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. Per the requirements of the Tar -Pamlico Riparian Buffer Rule, all stormwater drainage From portions of this site that have been constructed after January 1, 2000 must be discharged through a correctly designed level spreader or another device that meets diffuse flow requirements per 15A NCAC 2B .0261. Diffuse flow requirements are described in Chapter 8 of the North Carolina Stornwator BMP Manual, available at: http://h2o err strte nc us/su/bmn forms htm. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other federal or local govemmental permit that may be required. Franklin County Dear Mr. Morgan: On June 3, 2011, Dave Parnell of the Raleigh Regional Office carried out a stormwater compliance evaluation inspection (CEI) for the above permit. Mr. Richard Morgan III, was available to assist Mr. Parnell. A file review indicates that this was the first time DWQ had inspected this facility, although a technical assistance site visit by Mr. Ken Pickle of DWQ was reported by Mr. Morgan III. See the enclosed inspection checklist. A number of issues emerged and are discussed below: 1. This permit was issued March 20, 2009 and it expires July 31, 2013. The permit was available during the CEI, although the text of the permit was not. 2. Mr. Morgan III had possession of the Stormwater Pollution Prevention Plan (SPPP) for this facility. The SPPP has been reviewed and updated annually. There is a good deal of relevant information within the plan, but a complete re -production of the plan is required. The following items required to be within the SPPP but are not present currently are: a Narrative Description of Practices, a Site Plan (which includes the locations of the stormwater Discharge OUtlallS (SDO) and drainage areas), a Preventative Maintenance and Good Housekeeping Plan, documented annual Employee Training and a Stormwater Facility Inspection Program. Mr. Morgan III could not locate the Stormwater Discharge Outfalls (SDO). During Mr. Parnell's walk-through of the site, he discussed with Mr. Morgan III general locations of SDO, but these locations must be further defined and correctly located on the detailed site map, within the SPPP. Mr. Morgan III could not produce any monitoring results for 2010. Mr. Morgan 111 and Mr. Parnell discussed the Stormwater Facility Inspection Program and what is required of the facility by the Permit. As discussed during the CEI, the NCG210000 Stormwater Permit requires analytical and qualitative monitoring, be conducted at each (all) designated SDO, in the frequency directed by tables within your permit. 3. Please address the following: A) Re -produce a Stormwater Pollution Prevention Plan containing all items required by the Permit and have it available at the facility. Have the test of your permit available at the facility. It will be beneficial in reproducing the SPPP. B) Implement the analytical and qualitative monitoring requirements of your permit as soon as possible. Follow the guidelines for a representative storm and timelines found in your permit. Provide documentation of the monitoring results to this office as soon as they are completed. Please provide a written response to this letter, within 30 days of the receipt of this letter, detailing Franklin Veneer's compliance efforts with respect to the bold items found above in #3A and #313. Please note that a violation of Stormwater Permit conditions, monitoring and record -keeping, may be subject to civil penalties.
