Dear Mr. Bryan:
In accordance with your application for coverage under Stormwater General Permit NCG210000
received on August 26, 2008, we are forwarding herewith the subject certificate of coverage to discharge
under the subject state - NPDES general permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
DWQ has determined that coverage under General Permit NCG210000 (for stonnwater discharges
from Timber Product facilities) is appropriate based on your report of two specific aspects of your on -site
industrial activities: that woody materials and soil are the only ingredients, and that while screening
occurs, other typical composting activities (such as shredding, turning, and heat and moisture control) are
not conducted on site. If either the ingredients or processes change, coverage under the general permit
may no longer be appropriate.
Please note that the wet extended detention basin and the two sediment basins, as depicted in your
permit application documents, are stormwater treatment units and require regular excavation and other
maintenance in order to continue to effectively remove pollution from stonnwater discharges.
Please note that Section I B of your permit provides that the permit does not authorize discharges
that DWQ determines to be wastewaters. If DWQ subsequently discovers or determines that wastewater
discharges are present, coverage under the general permit may no longer be appropriate.
Please note that this certificate of coverage is not transferable except after notice to, and approval
by, the Division of Water Quality. The Division of Water Quality may require modification or revocation
and reissuance of the certificate of coverage.

On May 3, 2013, Cheng Zhang of the Raleigh Regional Office (PRO) conducted a Stormwater
Compliance Evaluation Inspection at the subject facility. Your assistance was greatly appreciated. The
inspection report is attached. Findings during the inspection were as follows:
Certificate of Coverage (COC) No. NCG210391 of NPDES general permit NCG210000 was
issued to John Bryan Yard Waste Recycling to discharge stormwater runoff to an unnamed
tributary to Tar River, a Class WS-V NSW stream, in the Tar -Pamlico River Basin.
2. The facility has not developed and implemented a Stormwater Pollution Prevention Plan
(SPPP) within 12 months of the effective date of the initial Certificate of Coverage issued
(September 12, 2008). This is in violation of Part 11 Section A of the General Permit. You
must develop and implement a SPPP within 60 days of receipt of this letter.
The facility had conducted qualitative monitoring at all outfalls as required by the General
Permit. Monitoring reports for 2011 and 2012 were reviewed during the inspection. No bench
mark exceeding was noted.
4. The only stormwater outfall was observed during the inspection and found well maintained.
Please respond in writing to RRO within 30 days of receipt of this letter regarding Item 2. Please
understand that violation of your stormwater permit can be subject to civil penalty assessment.

within 30 days of receipt of the letter. This letter is to inform you that I have hired Tim Stall to
handle any paperwork that is needed. He informed me that he has contacted NCDENR on 6/6/13
and is working on the problem.

Per your letter of May 10, 2013 detailing your Stormwater Compliance Evaluation Inspection at the
subject facility we are submitting Stormwater Pollution Prevention Plan for your review. The plan
can be found on sheet 2 of 3, Stormwater Management Plan and Stormwater Pollution Prevention
Plan. The new text for this plan has been clouded on the sheet.
Information from the General Permit No. NCG21000 and the publication "Developing Your
Stormwater Pollution Prevention Plan, A Guide for Industrial Operators" was consulted to address
the key components of the SPPP.
