In accordance with your request, Certificate of Coverage Number NCG210386 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit is against federal and state laws and could result in fines. As we discussed, you indicated that Hambro Forest Products liquidated all assets associated with the subject facility a couple of years ago. Based on this, we would recommend that you (Hasbro) request rescission of the general stormwater permit for this facility. Attached is a form that you may use to request this. I pulled the Blue Ridge Panels file and reached Mr. David Moore (former plant manager) at his cell phone number (828/221-5494). He confirmed that Blue Ridge Panels was no longer in operation and had gone "bankrupt 1 % to 2 years ago". The NC Secretary of State website confirms this with a "dissolved" status for this company. He did give me a contact for the parent company Hambro Forest Products in Crescent City, CA. I have a message in to Mr. Wes White (707/218-5650) asking them to request rescission of the stormwater permit. On another note, I had a call in October 2013 from Woodgrain which will have a new facility at this same location. I have a call into Rick Penley (828/754-2089) of Woodgrain to determine if they are operating. As far as I know, we have not received an NOI from Woodgrain. On the returned invoice, it's indicated that the company is no longer in business. I tried to reach the owner to discuss the possibility of rescission or change of ownership, but the phone number we have on file is disconnected. Is there a staff person in the ARO that can go by the facility to ascertain whether industrial activities have ceased and if any potential pollutant sources remain onsite? You should also know that their permit is expired, so if there are stormwater discharges, they may be in violation. The facility address is: 820 Complex St Sw, Lenoir. 0 0 If we determine that rescission is an option, we'll try contacting the owner by mail and recommend they formally request a rescission. Twice per shift loader operators will scrape all roads around a frame and truck dump. Blue Ridge must reduce the amount of residual wood laying around portions of this dust are washing off in stormwater drains. In addition, once per shift every drain must be checked and cleaned if necessary. The Required Response was to submit the next round of samples, these samples were to be taken during the next monitoring period (January -June 2011). to submit to inspector the Preventative Maintenance and Housekeeping Program, along with an accurate depiction of the stormwater conveyance system and drainage areas. To date none of these items have been submitted. The facility housekeeping was poor during site visit. Mountains of sawdust are outside again with runoff directly to stormdrains. Many barrels or totes of liquids were outside. The quantity appeared to be greater than acceptable without secondary containment. "Liquid raw materials, manufactured products, waste materials or by-products with a single above ground storage container having a capacity of greater than 660 gallons or with multiple above ground storage containers located in close proximity to each other having a total combined storage capacity of greater than 1,320 gallons." Because of two consectutive non -compliant visits the facility needs to initiate monthly monitoring. The results shall be submitted to DWQ-Linda Wiggs. Inspector still believes facility will not be able to meet benchmarks without better housekeeping onsite and removal of the large piles of sawdust. The downstream sample would be ok to represent downstream of Campus on Lower Crk, but upstream was mid stream of Campus property. The Blue Ridge Panels facility use to be run by Broyhill but is currently run by Blue Ridge Panels. This site has millions of square feet under roof and has many SDOs. The Broyhill (Currently called Furniture Brands) facility is referred to as a "Campus" it is so large. There are several SDOs that comingle the furniture industry stormwater with the panel industry stormwater. Blue Ridge Panels sampled two SDOs as well as Lower Crk upstream and downstream in August 2010, in Sept 2010 1 did an inspection at Broyhill and drove by Blue Ridge Panels. The Blue Ridge Panel site had significant housekeeping issues, there was excessive sawdust waste onsite. The August SDO #1 revealed the poor housekeeping with an exceedance of COD. SDO#2 sampled was an incorrect SOO for Blue Ridge to sample as determine during this inspection. The SOO #2 they sampled drained an old Broyhill Hazardous Waste Storage area, not the winter storage area for Blue Ridge Panel. The proper SOO for Blue Ridge Panels would be up by the Guard House. During inspection Blue Ridge Panel had cleaned up the site significantly, the sawdust waste was considerably less compared to the September drive by visit. The facility has exceeded analytical benchmarks for COD and TSS. Housekeeping was a significant issue when the exceeding samples were taken. During the inspection housekeeping had improved. However, further sampling will determine if a more stringent housekeeping regime will be needed for compliance. Regardless a Preventative Maintenance and Good Housekeeping Program has to be developed and implemented as part of the Stormwater Pollution Prevention Plan (SPPP) in order to be compliant with permit NCG210386. The following items need to be addressed: Stormwater Pollution Prevention Plan (SPPP) Dee Freeman Secretary Part 1I Section A #4 requires a Preventative Maintenance and Good Housekeeping Program. Components of this program include an accurate delineation of the stormwater conveyance system and the drainage areas flowing to those conveyances. Required Response By February 2822011,�please submit your Preventative Maintenance and Good Housekeeping Program along with the stormwater conveyance system and drainages to me at 2090 US HWY 70, Swannanoa, NC 28778. I am willing to write another inspection letter addressing the facilities non-compliance, but I really should be sending a Notice of Violation (NOV) because you were not compliant then and have not provided the Required Response to my last inspection letter. Please reread my last letter dated January 6, 2011. The inspection was at the end of November 2010, the letter is dated January 6, 2011. The Required Response was to submit your next round of samples to me, these samples were suppose to be taken between January and the end of June, you were to submit to me your Preventative Maintenance and Housekeeping Program, along with an accurate depiction of your stormwater conveyance system and drainage areas. The response date was February 28, 2011. Below is the definition specifying the quantity of bulk storage and secondary containment. Bulk Storage of Liquid Products "Liquid raw materials, manufactured products, waste materials or by-products with a single above ground storage container having a capacity of greater than 660 gallons or with multiple above ground storage containers located in close proximity to each other having a total combined storage capacity of greater than 1,320 gallons." Your quantity is over this definition and therefore you will need secondary containment if the containers remain outside. Otherwise you need to move the containers inside where they do not pose a spill concern. You still need to submit the information required from the first letter. And you will need to initiate monthly analytical monitoring, which will also be submitted to me.
