On July 31, 2014, Dave Parnell of the Raleigh Regional Office of NC DENR, performed a
compliance evaluation inspection (CEI) at the Oldeastle mulch production facility. Your
assistance, as well as the assistance of, Shawn Wilkerson, Roberto Garcia, was appreciated.
This inspection was conducted to determine the facility's compliance with its NPDES general
stormwater permit. Observations during the inspection are as follows:
1. The Stormwater Prevention Pollution Plan (SPPP) was available and reviewed during
the inspection. The plan contained all components required by the permit.
Analytical and Qualitative monitoring is required semi-annually by the permit.
Analytical Monitoring is not required for vehicle maintenance being conducted at your
facility. Following the SPPP review, a complete review of your monitoring results was
conducted. Due to exceedences of Chemical Oxygen Demand (COD) and Total
Suspended Solids (TSS), your facility is currently operating under Tier 3 of your
stormwater analytical monitoring requirements. During the review, there was some
indecision pertaining to the number of stormwater outfalls. Following your inspection,
a call referencing your consultant (Falcon), clarified that there are, in fact, two outfalls
that must be monitored — SDO #1 and SDO#2.

compliance evaluation inspection (CEI) at the Oldcastle mulch production facility. Your

This inspection was conducted to determine the facility's compliance with its NPDES general
stormwater permit. Observations during the inspection are as follows:

the inspection. The plan contained all components required by the permit. ,
2. Analytical and Qualitative monitoring is required semi-annually by the permit.
Analytical Monitoring is not required for vehicle maintenance being conducted at your

In accordance with your application for discharge permit received on September 26, 2006, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act, or any other Federal or Local governmental permit that may be required.
Please note that the Division is currently evaluating the question of whether drainage from
composting and mulching facilities should be permitted as wastewater or as stormwater discharges. Our
determinations may affect your future renewal of this stormwater discharge permit.

On May 18, 2011, Dave Parnell of the Raleigh Regional Office carried out a stormwater compliance
evaluation inspection (CEI) for the above permit. Mr. Matt Rizzuto - Plant Manager and Mr. Ted
Carter, were available to assist Mr. Parnell. A file review indicates that this was the first time DWQ had
inspected this facility. See the enclosed inspection checklist. A number of issues emerged and are
discussed below:
1. This permit was issued September 15, 2008 and it expires July 31, 2013. The current permit
was not available during the CEI.
Mr. Carter had possession of the Stormwater Pollution Prevention Plan (SPPP) for this facility,
during the inspection. The SPPP has not been reviewed and updated since 2009. Mr. Withrow
knew the location of the Stormwater Discharge Oulfalls (SDO) and we agreed that he could
document the location of the SDO on the site plan at that time. Mr. Carter could not produce
any of the required analytical monitoring results for this permit cycle. Qualitative monitoring
results were produced, but showed "no flow" for many of the observations. We discussed that
an effort must be made to find a qualifying representative storm during the specified period
which would produce a flow that could be observed. The current NCG210000 Stormwater
Permit requires analytical monitoring to be conducted at each (all) designated SDO, in the
lrequency directed by tables within your permit.

the SPPP.

Follow the guidelines for a representative storm and timelines found in your permit.
Provide documentation of the monitoring results to this office as soon as they are
completed.
