NOTICE OF PUBLIC HEARING AND DRAFT PERMIT
RECEIVE®

THE NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION
SUBJECT: A draft permit has been prepared by the Division of Water
Quality for a State National Pollutant Discharge Elimination
System (NPDES) Permit for point source discharges of
stormwater for the following applicant:
Edisto Farm Credit (now owned by Palmetto Farm
Credit, Orangeburg, South Carolina, Mr. William Heirs, Vice
President) for discharge(s) of stormwater from a site proposed
for operation of a wood chip mill in Williamston, NC.
The proposed discharge(s) of stormwater runoff would be to
Roanoke River and unnamed tributaries of Roanoke River at a
site of a former chip mill (Upchurch) operation. The specific
location is 1012 Whitaker Lane, Williamston, NC, Martin
County. The site is approximately 1500 feet east of the bridge
where US Hwys. 13 and 17 cross the Roanoke River and is on
the South bank of the river.
PURPOSE: On the basis of preliminary staff review and application of Article 21 of
Chapter 143, General Statutes of North Carolina, and other lawful
standards and regulations, the North Carolina Environmental
Management Commission proposes to issue a State - NPDES permit
subject to specific conditions. The Director of the Division of Water
Quality pursuant to NCGS 143-215. 1(c) (3) and Regulation 15 NCAC
2H, Section .0100 has determined that it is in the public interest that a
hearing be held to receive all pertinent public comment on whether to
issue the permit as drafted, issue a modified version of the draft permit,
or to not issue a permit.
HEARING
PROCEDURE: The hearing will be conducted in the following manner:
1. Explanation of the NC Environmental Management Commission's
Permit Procedure and components of the draft permit proposed for
issuance — staff of the Division of Water Quality.
2. Explanation of the project for which the discharge permit is being
applied — applicant.
2. Public Comment - Comments, statements, data and other information
may be submitted in writing prior to the meeting, during the meeting or
i may be presented orally at the meeting. Written comments may be
submitted after the hearing by the deadline in #6., below. Persons
' desiring to speak will indicate this intent at the time of registration at the
meeting. So that all persons desiring to speak may do so, lengthy
statements may be limited at the discretion of the meeting officer. Oral
presentations which exceed three minutes must be accompanied by three
(3) written copies which will be filed with the meeting clerk at the time
of registration.
4. Cross examination of persons presenting testimony will not be
allowed; however, the hearing officer may ask questions for
clarification.
5. The hearing record will be closed two weeks (May 9, 2002)
following the date of the hearing.
6. Written comments regarding the draft permit may be submitted in
writing to the Division of Water Quality at the address shown below.
The deadline for comments to be submitted is May 9, 2002. All
comments received by the Division whether.in writing prior to the
hearing or presented at the hearing or received by mail by the deadline
above, will be taken into consideration by the Director of the Division of
Water Quality prior to making a final decision on the matter of permit
issuance.

In accordance with your request received July 11, 2000, the Division is forwarding the
subject permit modification for the sawmill previously owned by Upchurch, Inc. at this location.
This modification documents the change in name/ownership at the subject facility. All other
terms and conditions in the original permit and original permit application package remain
unchanged and in full effect (see attached). Issuance of this permit is based on the
original permit application which stated that over 80% of the operation at this site will be a
sawmill operation with the remaining portion of the operation being a chip mill operation.
This, permit modification is issued under the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental
Protection Agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit
are unacceptable to you, you have the right to request an individual permit by submitting an
individual permit application. Unless such demand is made, this certificate of coverage shall be
final and binding.
The Division is currently reviewing your request for an individual NPDES stormwater
permit to operate this facility as a wood chip mill. Before this operational change can take place
for this facility you must receive this individual permit coverage.
This permit does not affect the legal requirement to obtain other permits which may be
required by the Division of Water Quality, the Division of Land Resources, Coastal Area
Management Act, or any other Federal, State or Local government permit that may be required.

The purpose of this letter is to determine which of you intends to set up a business at the former Upchurch
site in Martin County. Each of you has had contact with the Division for a different type of water quality permit for
this site. Mr. Richardson, in a telephone conversation with Aisha Lau on June 8, 2000, inquired about a name
change to transfer the Upchurch certificate of coverage under the NCG21 general stormwater permit to his client.
Mr. Richardson informed Ms. Lau that his client's main business at the site would be chipping operations along with
some sawmill and debarking operations. He also indicated that a wet decking process would be utilized.
Mr. Hiers, of Edisto Farm Credit, filed an application for an individual NPDES permit on April 3, 2000.
Edisto's application indicated that it intended to operate a chip mill as well. The application did not indicate
intentions to operate a wet decking process or saw mill operations.
Before the Division can proceed further, we request that each of you inform us in writing as to the identity of
the current owner of this site. Please include the paperwork which indicates the transfer in ownership from
Upchurch, Inc. to the current owner. Secondly, the current owner must inform the Division of the type of business
that is to be conducted at this site and the name of the corporation or individual that is going to operate the
business. Also, please inform the Division whether a wet decking process will be utilized. Once these issues are
clarified we can proceed with our review and may request additional information.
Please note that at the present time there is no general stormwater permit coverage available for wood chip
mills. The NCG21 permit is available to sawmills and other timber products operations, but it is not available for
wood chip mills. Thus, if the entity that is going to establish a business on the Upchurch site intends to set up a chip
mill, the proper permit is an individual NPDES permit. If there is going to be a wet decking operation, regardless of
the type of enterprise, the proper permit is an individual NPDES permit.

addressing the followina items:
The section VII of Form 21- was not completed correctly. The regulations concerning completing this section
for a proposed discharge require that the applicant complete the values for Section VII using an estimate of the
pollutant values. The source for these estimates must be included in the application materials. (During the First
two years of actual operation, the permittee will be required to perform and submit actual analyses for these
parameters if they have not already done so by other permit mandated analytical monitoring). These provisions
are explained in 40 CFR 122.26(c)(1)(G). A copy of this section is attached for your use.
The requested information must be submitted within fill days of this letter. If the required information is not
received by this date. the Division will have no alternative but to return this application as incomplete. If you have

storm water outfall; paved areas and
buildings within the drainage area of
each storm water outfall, each past or
present area used for outdoor storage
or disposal of significant materials,
each existing structural control meas-
ure to reduce pollutants In storm water
runoff, materials loading and access
areas, areas where pesticides, herbi-
cides, soil conditioners and fertilizers
are applied, each of its hazardous waste
treatment, storage or disposal facili-
ties (including each area not required
to have a RCRA permit which Is used
for accumulating hazardous waste
under 40 CFR 262.34); each well where
fluids from the facility are Injected un-
derground; springs, and other surface
water bodies which receive storm water
discharges from the facility;
(B) An estimate of the area of imper-
vious surfaces (including paved areas
and building roofs) and the total area
drained by each outfall (within a mile
radius of the facility) and a narrative
description of the following: Signifi-
cant materials that In the three years
prior to the submittal of this applica-
tion have been treated, stored or dis-
posed In a manner to allow exposure to
storm water; method of treatment,
storage or disposal of such materials;
materials management practices em-
ployed, In the three years prior to the
submittal of this application, to mini-
mize contact by these materials with
storm water runoff; materials loading
and access areas; the location, manner
and frequency In which pesticides, her-
bicides, soil conditioners and fertilizers
are applied; the location and a descrip-
tion of existing structural and non-
structural control measures to reduce
pollutants In storm water runoff; and a
description of the treatment the storm
water receives, including the ultimate
disposal of any solid or fluid wastes
other than by discharge;
(C) A certification that all outfalls
that should contain storm water dls-
charges associated with industrial ac-
tivity have been tested or evaluated for
the presence of non -storm water dis-
charges which are not covered by a
NPDES permit; tests for such non.
storm water discharges may include
smoke tests, Buorometrlc dye tests,
analysis of accurate schematics, as
well as other appropriate tests. The
certification shall include a description
of the method used, the date of any
testing, and the on -site drainage points
that were directly observed during a
test;
(D) Existing information regarding
significant leaks or spills of toxic or
hazardous pollutants at the facility
that have taken place within the three
years prior to the submittal of this ap-
plication;
(E) Quantitative data based on sam-
ples collected during storm events and
collected In accordance with §122.21 of
this part from all outfalls containing a
storm water discharge associated with
Industrial activity for the following pa-
rameters:
(1) Any pollutant limited 1n an efflu-
ent guideline to which the facility 1s
subject;
(2) Any pollutant listed in the facili-
ty's NPDES permit for its process
wastewater (if the facility is operating
under an existing NPDES permit);
(3) Oil and grease, pH, BOD5, COD,
TSS, total phosphorus, total Kjeldahl
nitrogen, and nitrate plus nitrite nitro-
gen;
(4) Any information on the discharge
required under paragraph §122.21(g)(7)
(Ili) and (iv) of this part;
(5) Flow measurements or estimates
of the now rate, and the total amount
of discharge for the storm event(s)
sampled, and the method of Dow meas-
urement or estimation; and
(6) The date and duration (in hours)
of the storm event(s) sampled, rainfall
measurements or estimates of the
storm event (in inches) which gen-
erated the sampled runoff and the du-
ration between the storm event sam-
pled and the end of the previous meas-
urable (greater than 0.1 inch rainfall)
storm event (in hours);
(F) Operators of a discharge which Is
composed entirely of storm water are
exempt from the requirements of
§122.21 (g)(2), (g)(3). (g)(4), (9)(5),
(g)(7)(1). (9)(7)(11), and (g)(7)(v); and
(0) Operators of new sources or nea
discharges (as defined in § 122.2 of this
Part) which are composed In part or en-
tirely of storm water must include es-
timates for the pollutants or param-
eters listed in paragraph (c)(1)(1)(E) of
this section instead of actual sampling
data, along with the source of each es-
tlmate. Operators of new sources or
new discharges composed in part or en-
tire]-v of storm water must provide
Quantitative data for the parameters
listed In paragraph (c)(1)(1)(E) of this
section within two years after com-
mencement of discharge, unless such
data has already been reported under
the monitoring requirements of the
NPDES permit for the discharge. Oper-
ators of a new source or new discharge
which Is composed entirely of storm
water are exempt from the require-
ments of §122.21 (k)(3)(I), (k)(3)(ill),
and (k)(5).
(11) The operator of an existing or
new storm water discharge that is as-
sociated with Industrial activity solely
under paragraph (b)(14)(x) of this sec-
tion, is exempt from the requirements
of §122.21(g) and paragraph (c)(1)(1) of
this section. Such operator shall pro-
vide a narrative description of:
(A) The location (including a map)
and the nature of the construction ac-
tivity;
(B) The total area of the site and the
area of the site that is expected to un-
dergo excavation during the life of the
permit;
(C) Proposed measures, Including
best, management practices, to control
Pollutants in storm water discharges
during construction, including a brief
description of applicable State and
local erosion and sediment control re-
quirements;
(D) Proposed measures to control pol-
lutants In storm water discharges that
will occur after construction oper-
ations have been completed, Including
a brief description of applicable State
or local erosion and sediment control
requirements:
(E) An estimate of the runoff coefB-
clent of the site and the increase In im-
pervlbus area after the construction
addressed In the permit application is
completed, the nature of fill material
and existing data describing the soil or
the quality of the discharge; and
(F) The name of the receiving water.
(lit) The operator of an existing or
new discharge composed entirely of
storm water from an oil or gas explo-
ration, production, processing, or
treatment operation, or transmission
facility is not required to submit a per-
mit application in accordance with
paragraph (c)(1)(1) of this section, un-
less the facility:
(A) Has had a discharge of storm
water resulting in the discharge of a
reportable quantity for which notifica-
tion is or was required pursuant to 40
CFR 117.21 or 40 CFR 302.6 at anytime
since November 16. 1987; or
(B) Has had a discharge of storm
water resulting In the discharge of a
reportable quantity for which notifica-
tion is or was required pursuant to 40
CPR 110.6 at any time since November
16, 1987; or
(C) Contributes to a violation of a
water quality standard.
Ov) The operator of an existing or
new discharge composed entirely of
storm water from a mining operation Is
not required to submit a permit appli-
cation unless the discharge has come
into contact with, any overburden, raw
material, intermediate products, ❑n-
Ished product, byproduct or waste
products located on the site of such op-
erations.
(v) Applicants shall provide such
other information the Director may
reasonably require under §122.21(g)(13)
of this part to determine whether to
Issue a permit and may require any fa-
cility subject to paragraph (c)(1)(1i) of
this section to comply with paragraph
(c)(1)(1) of this section.
(2) Croup application for discharges as-
sociated with industrial activity. In lieu
of individual applications or notice of
Intent to be covered by a general per-
mit for storm water discharges associ-
ated with industrial activity, a group
application may be filed by an entity
representing a group of applicants (ex-
cept facilities that have existing indi-
vidual NPDES permits for storm
water) that are part of the same sub-
category (see 40 CFR subchapter N, part
405 to 471) or, where such grouping Is
Inapplicable, are sufficiently similar as
to be appropriate for' general permit
coverage under §122.28 of this part. The
part 1 application shall be submitted to
the Office of Water Enforcement and
Permits, U.S. EPA, 401 M Street, SW.,
Washington, DC 20460 (EN-336) for ap-
proval. Once a part 1 application Is ap-
proved, group applicants are to submit
Part 2 of the group application to the
Office of Water Enforcement and Per-

application for coverage under NPDES Permit for discharges to surface waters on April 3, 2000. The submitted
package contained the following items:

A review of the submitted material indicates additional information is needed. Please submit documentation
addressing the following items:
> The section V Il of Form 2F was not completed correctly. The regulations concerning completing this section
for a proposed discharge require that the applicant comQlete the values for Section VII using an estitnate.of the
pollutant values. The source for these estimates must be included in the application materials. (During the first
two year's of actual operation, the permitter: will be required to perform and submit actual analyses for these
parameters if they have not already done so by other peRmit mandated analytical monitoring). These provisions
are explained in 40 CFR 122.26(c)(1)(G). A copy of this section is attached for your use.
The requested information must be submitted within 60 days of this letter. If the required information is not
received by this date, the Division will have no alternative but to return this application as incomplete. If you have

unless the appropriate additional permits are obtained from DWQ, including the
individual permit Edisto now seeks. Upon the transfer of the Certificate of Coverage
from Upchurch to Edisto, Edisto intends to retain the services of North Carolina Fiber
Group, LLC to operate the Williamston facility as a sawmill. Edisto will be the holder of
the Certificate of Coverage while North Carolina Fiber Group will be the operator.
Your letter also discusses inquiries made by Mr. Hood Richardson to DWQ staff
regarding wet decking operations at the site. It is our understanding that Mr. Richardson
had been asked by North Carolina Fiber Group, LLC to inquire about permitting
requirements under various scenarios, including wet decking. However, Edisto is the
current occupant of the site and all permits should be issued in the name of Edisto Farm
Credit, A.C.A. As stated above, Edisto (and the operator North Carolina Fiber Group)
will not perform any wet decking operations at the site without the appropriate permits.
Furthermore, per the attached letter, it is our understanding that Mr- Hood Richardson
will not be pursuing any further options regarding this site on behalf of North Carolina
Fiber Group. Therefore, in the future, please direct your requests for additional
information to me.

I am writing in response to your letter dated Mine 15, 2000 in which you inquired about
the former Upchurch, Inc. site (the site) in Williamston, North Carolina (Martin County).

Edisto is the current occupant of the site by viitue of the assignment of lease from
Upchurch, Inc. to Edisto on May 10 1999. A copy of the -Assignment of Lease
Agreement is enclosed. Edisto also owns all of the assets formerly owned by Upchurch,
Inc., including all equipment and machinery at the site.
Your letter notes that Edisto has applied for an individual NPDES permit. Edisto's
application indicates that Edisto intends to operate a chip mill at the site and that the only
discharge to surface waters will be storm water(i.e., Edisto will not discharge a process
wastewater from wet decking operations). 'I he information contained in the application
dated April 3, 2000 is still correct. Therefore, we urge the Division of Water Quality
(DWQ) to proceed with it's review of our pending application.
On October 21,1998,DWQ issued Certificate of Coverage NCG2 10333 to Upchurch,
Inc. for the discharge of storm water from a sawmill at the site in accordance with Storm
water General Permit No. NCG210000 (NCCW ). Pending AWO's final action on the

The purpose of this letter is to determine which of you intends to set up a business at the former Upchurch
site in Martin County- Each of you has had contact with thel Division for a different type of water quality,permit for
this site- Mr. Richardson, in a telephone conversation with Aisha Lau on June 8, 2006, inquired about a. name
change to transfer the Upchurch certificate of coverage under the NCG21 general stormwater permit to his client.
Mr. Richardson informed Ms. Lau that his client's main business at the site would be chipping operations along with
some sawmill and debarking operations. He also indicated that a wet decking process would be utilized.
Mr. Hiers, of Edisto Farm Credit, filed an application for an individual NPDES permit on April 3, 2000.
Edisto's application indicated that it intended to operate a chip mill as well. The application did not indicate
Intentions to operate a wet decking process or saw mill operations.
Before the Division can proceed further, we request that each of you inform us in writing as to the identity of
the current owner of this site. Please Include the paperwork which indicates the transfer in ownership from
Upchurch, Inc. to the current owner. Secondly, the ourrentowner must Inform the Division of the typo of business
that is to be conducted at this site and the name of the corporation or individual that is going to operate me
business. Also, please inform the Division whether a wet dscking process will be utilized. Once these Issues are
clarified we can proceed with our review and may request additional information.
Please note that at the present time there is no general stomnwater permit coverage available for wood chip
mills. The NCG21 permit is available to sawmills and other timber products operations, but it is not available for
wood chip mills. Thus, if the entity that is going to establish a business on the Upchurch site intends to set up a chip
mill, the proper permit is an individual NPDES permit. If there is going to be a wet decking operation, regardless of
the type of enterprise, the proper permit is an individual NPDES permit.

Application for Permit to Discharge Storm Water
Associated with Industrial Activity
Who Must File Form 2F
Form 2F must be completed by operators of facilities which discharge storm water associated Ath industrial
activity or by operators of storm water discharges that EPA is evaluating for designation as a significant
contributor of pollutants to waters of the United States, or as contributing to a violation of a •rater quality
standard.
Operators of discharges which are composed entirely of storm water must complete Form 2F (EPA Form
3510-2F) in conjunction with Form 1 (EPA Form 3510-1),

Discharge Stormwater Discharges Associated with Industrial Activity) for the above
referenced site. Based on our telephone conversation of February 28, 2000, these are the
only forms necessary to apply for an individual permit to discharge stormwater under the
National Pollutant Discharge Elimination System (NPDES). Section VII of Form 2F
0scharge Information) was left blank since this facility is not currently operational and
there is no historical stormwater monitoring data for the facility. We were also unable to
locate historical monitoring data for similar facilities. Based on our conversation, it Is our
understanding that the permit will be issued with general monitoring requirements and then
amended to include site specific potential pollutants, if any, once the facility is operational
and stormwater quality data is available. We appreciate your assistance with this.process.

discharge under the subject state - NPDES general permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the
certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management

Dear Mr. Bennett,
I hope the enclosed site plan and the following additional information concerning the proposed Upchurch sawmill will give you the
information needed for securing the necessary certificate of coverage.
Lumber production will be approximately 40,000 boardfeet per day and approximately 83% of the income from the facility will
be derived from lumber sales.
By-products will be approximately 2 tons of chips and 2 tons of bark and sawdust per thousand boardfeet. Approximately 17%
of the facility's income will be derived from the sale of these by-products.
All by-products will be moved from the site on a daily basis.
The proposed sawmill operations are as follows:
Logs will be weighed in at the existing scales and unloaded by the existing crane. Wood will be stacked around the crane
as was done previously. Wood will be fed into the merchandising system and from there, cut to length logs will feed into
the debarker. Logs will flow through the debarker into the infeed to the sawmill where a hydraulic loader will pull logs
onto the infeed chain to the saw carriage. The logs will be sawn on a conventional carriage and the resulting lumber off-
loaded to conveyors where it will be stacked for shipment. Slabs from the carriage will be conveyed to the chipper. Waste
wood from the merchandiser will be chipped into a by-product by the existing chipper. These chips will be screened and
loaded into trucks for transport on a daily basis. Bark from the debarker will be conveyed to a "hog" where
It is pulverized into another by-product. This, too, will be loaded into trucks for transport on a daily basis.
This is a conventional sawmill design.

As detailed in the site plan, Upchurch will be adding sawmill machinery as per the attached plan, as well as using most of the existing
equipment. The conveyors and the chip reclaim to the barge loading area will not be used, however, because all products will be
transported by truck.

The purpose of this letter is to request additional information on the referenced permit
application. After discussions with the Division of Water Quality (Division) Washington
Regional Office there are some questions concerning the site layout and operation of the
sawmill at this location.
The Division would like to see a site plan detailing:
• The equipment that is already on site that would be used by the saw mill
• New equipment that will be brought in
• Log storage areas
• Lumber storage areas
• Waste piles
The Division would also like to know the volume of lumber and waste wood you intend
to generate on a daily basis and what you intend to do with the waste wood, bark, etc.
Please briefly describe the steps of your saw mill operation from arrival of the logs at the
mill until the lumber and waste wood products are removed from the site.

Upchurch Chip Mill
The situation for the above is the following:
Mr. Upchurch operated a Chip Mill at the old Olin Site near the Hwy. 64 Bridge in Williamston, a
couple of years ago and then closed down. At the time of operation he hired an engineer to get all
needed permits. 1 believe the firm was F. T. Green and Associates but I'm not sure. Well, the
engineer talked to Bill Moore about coastal stormwater and Bill informed him that he did not need
a permit. The engineer never inquired about a federal stormwater permit. So, Mr. Upchurch started
his operation thinking he had all necessary permits.
Mr. Upchurch called the office approximately three to four months ago to inquire about starting his
operation again. I asked if he had a stormwater permit (federal) and he said that his engineer had said
he did not need one based on Bill Moore's conversation. I checked with the database to see if he had
a permit and he did not. I then talked with Bill, to check his memory on the matter. Bill did not
remember talking about a federal permit at the time, only coastal stormwater.
I then met Mr. Upchurch on site to determine if he needed a permit or not. With the proposed site
he needed a permit and informed him that he needed a permit before startup. He then asked the
question about startup after an application had been submitted. I quoted the law again and told him
that I would check on the matter. Well I checked with Raleigh, and again called him back and quoted
him the law. At that point the Director sent him a letter stating the above. See attached.

This letter is in response to your recent inquiries concerning the reopening of a wood chip mill facility in
Williamston, NC. It is my understanding that this facility has previously been open and operational but
has been closed for the last year or so. I also understand that this facility has never applied for permit
coverage for stormwater point source discharges. The Division of Water Quality is responsible for the
<implementation of National Pollutant Discharge Elimination System (NPDES) permits within North
Carolina. Under this program the Division requires NPDES permits for point source discharges of
stormwater from certain categories of industrial activities. Wood chip mills are a part of the Lumber and
Wood Products Industry which is subject to these NPDES stormwater permits.
You have previously had discussions with staff from our central and regional offices concerning the
NPDES stormwater permitting process for your facility. One of your major concerns in these discussions
was our requirement that the facility be permitted before it begins operations. I will be happy to discuss
our position on permitting of this facility with you. Please call me or Donna Pittman at (919) 733-5083
ext. 203 to arrange a convenient time.
The Division received a permit application request for coverage under General Permit NCGO40000 for this
facility on February 19, 1998. We will hold any action on this request until after we have had an
opportunity to meet and discuss the process. Please note that the package received did not include the
$400 application processing fee as indicated in the accompanying transmittal letter.

This letter is in response to your April 2, 1998 letter concerning the acceptance of your general
permit application. As we discussed in our meeting on March 25, 1998 the Department will not issue new
permit coverage for a wood chip mill under the 1992 general permit for Timber Products (NCG040000).
This general permit expired in August of 1997. Those chip mills that currently have coverage under this
permit will continue to be covered. Other chip mills seeking coverage under a NPDES stormwater permit
will have to apply for coverage under an individual NPDES stormwater permit. Once the Department's
study on the wood chip mill industry is completed we will review the permitting procedures for wood chip
mills to determine the most appropriate types of permit coverage.
In the interim, facilities such as Upchurch, Inc. in Williamston, N.C. must apply for permit
coverage under our individual permitting procedures. We have attached copies of the two forms that you
will need to complete and return to our offices to begin the individual permit process (EPA Forms 1 and
2F). We are also returning your previous application package (received 2/19/98) requesting coverage
under the general permit and the $400.00 application fee (received 4/8/98). When you return your
individual permit application information, please include the location map for the facility and the
processing fee. At our previous meeting we also discussed additional information that you should submit
with your application to assist our review. This included information on sources of trees for your wood
chip production, production rates at your facility during the time you previously operated and any
modifications to the production rates or facility that are proposed.
