After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The relic channel of Motts Creek runs just to the north of the proposed project site. The width of the coastal wetlands associated with the project range in width from approximately 40' to 140'. There are two rows of pilings on site, which are the remains of an abandoned pier originally authorized by State permit # 13-86. There is also an existing wastewater line easement, which crosses the property. This easement contains the existing wastewater flow from the Wrightsville Beach system and carries the waste to the Wilmington Southside Treatment Plant. The bridge fender on the East Side of the AIWW channel is located in a southerly direction approximately 125' from the proposed structure. The waters within the project area are classified as SB by the NC Division of Water Quality. They are not a NC Division of Marine Fisheries Primary Nursery Area and are closed to shellfish harvest. The applicant proposes to construct a fixed pier terminating in a floating dock. The length of the pier is proposed to be approximately 646' long by 6' wide. At the terminus of this feature a 19' ramp will connect it to a 6' wide by 66' long floating dock. Water depths along the face of the dock range from 6' mlw to 12' mlw. The applicant also proposes an 8' wide by 18' long parking space at the southwest corner of the property. There will be a recently permitted project on the north side of Motts Creek. This permit authorizes a new pier and some dredging. The permitted and proposed projects appear to be compatible. 10 -ANTICIPATED IMPACTS: The proposed project will allow for private access to a 2-slip floating dock. The location of this project, as now proposed, does not appear to have the potential of interfering with public navigation and safety within Motts Creek or the AIWW. The final location of the riparian corridors may require a slight adjustment prior to construction of the floating dock. Submitted By: C. The purpose of this document is to provide a narrative description for a pile supported pier and docking system proposed by CGRS Enterprises, LL.C. The subject property is an approximately 1.24 acre parcel of land located adjacent to Summer Rest Road (SR 1417), US Hwy.. 74-76 and the Atlantic Intracoastal Waterway (AIWW) in Wilmington, New Hanover County, North Carolina. The proposed project is the -construction of a 665' long by 6' wide fixed pier system that will access a 66' long by 6' wide floating dock system with a sets of dolphins on both ends of the floating structure. Enclosed with this narrative is a plan view plat with cross sectional details of the development proposed. The location of the mooring facility is required to provide -6' of water depth at mean low water while avoiding construction of moorings within the required 80' setback from the AIWW. The plat also indicated property boundaries, the location of the IAWW with 80' setback, the NC DOT right of way and easement locations and the location of various utilities in proximity to the.projeeL Currently, there is minimal development on the parcel. There is evidence of pilings that were installed for the construction of a marina facility that was permitted for the subject tract in November 1986. That work was authorized by Major CAMA Permit #13-86 and the permit was issued to Consolidated Ventures Corporation. A copy of that permit with associated plat work is included with the application package. While the marina was never completely constructed and the permit expired, it is our opinion that issues assessed and resolved prior to the issuance of that permit are similar in nature to the issues surrounding the current proposal and relevant to the review of the enclosed application. In fact, the current proposal is a significant reduction in scope in comparison to the originally permitted project. The portion of the tract that the pile support structure will impact is dominated by coastal wetlands species including Spartin.a alterniflora, Spartina patens and Salicorina sp. Along the interface between wetlands and uplands the plant species include Borrichia frutescens, Myrica cerifera and upland grasses and -shrubs. Given the resources that will be impacted the structure is solely for access to public trust waters and has been limited to a pile supported structure, six feet in width are required by applicable use standards.
