Dear Mr. Lassiter:
You have our approval, in accordance with the attached conditions, to shade 0.1 acre of vegetated wetlands and
open water in order to construct a pier accessing two boat slips adjacent to the AIWW on your property in New Hanover
County, as described in your application received by the Division of Water Quality on March 14, 2001. After reviewing your
application, we have determined that this fill is covered by General Water Quality Certification Number 3274. This
Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition,
you should get any other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application for a new certification. If the property is
sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in
the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

9 - PROJECT DESCRIPTION: The project site consists of an extremely small parcel of
highground located on Eastwood Road in New Hanover County. The relic channel of Motts
Creek runs just to the north of the proposed project site. The width of the coastal wetlands
associated with the project range in width from approximately 40' to 140'. There are two
rows of pilings on site, which are the remains of an abandoned pier originally authorized by
State permit # 13-86. There is also an existing wastewater line easement, which crosses the
property. This easement contains the existing wastewater flow from the Wrightsville Beach
system and carries the waste to the Wilmington Southside Treatment Plant. The bridge
fender on the East Side of the AIWW channel is located in a southerly direction
approximately 125' from the proposed structure. The waters within the project area are
classified as SB by the NC Division of Water Quality. They are not a NC Division of Marine
Fisheries Primary Nursery Area and are closed to shellfish harvest. The applicant proposes to
construct a fixed pier terminating in a floating dock. The length of the pier is proposed to be
approximately 646' long by 6' wide. At the terminus of this feature a 19' ramp will connect it
to a 6' wide by 66' long floating dock. Water depths along the face of the dock range from
6' mlw to 12' mlw. The applicant also proposes an 8' wide by 18' long parking space at the
southwest corner of the property. There will be a recently permitted project on the north
side of Motts Creek. This permit authorizes a new pier and some dredging. The permitted
and proposed projects appear to be compatible.
10 -ANTICIPATED IMPACTS: The proposed project will allow for private access to a 2-slip
floating dock. The location of this project, as now proposed, does not appear to have the
potential of interfering with public navigation and safety within Motts Creek or the AIWW.
The final location of the riparian corridors may require a slight adjustment prior to
construction of the floating dock.

The purpose of this document is to provide a narrative description for a pile supported pier and
docking system proposed by CGRS Enterprises, LL.C. The subject property is an approximately
1.24 acre parcel of land located adjacent to Summer Rest Road (SR 1417), US Hwy.. 74-76 and
the Atlantic Intracoastal Waterway (AIWW) in Wilmington, New Hanover County, North
Carolina.
The proposed project is the -construction of a 665' long by 6' wide fixed pier system that will
access a 66' long by 6' wide floating dock system with a sets of dolphins on both ends of the
floating structure. Enclosed with this narrative is a plan view plat with cross sectional details of
the development proposed. The location of the mooring facility is required to provide -6' of
water depth at mean low water while avoiding construction of moorings within the required 80'
setback from the AIWW. The plat also indicated property boundaries, the location of the IAWW
with 80' setback, the NC DOT right of way and easement locations and the location of various
utilities in proximity to the.projeeL
Currently, there is minimal development on the parcel. There is evidence of pilings that were
installed for the construction of a marina facility that was permitted for the subject tract in
November 1986. That work was authorized by Major CAMA Permit #13-86 and the permit was
issued to Consolidated Ventures Corporation. A copy of that permit with associated plat work is
included with the application package. While the marina was never completely constructed and
the permit expired, it is our opinion that issues assessed and resolved prior to the issuance of that
permit are similar in nature to the issues surrounding the current proposal and relevant to the
review of the enclosed application. In fact, the current proposal is a significant reduction in
scope in comparison to the originally permitted project.
The portion of the tract that the pile support structure will impact is dominated by coastal
wetlands species including Spartin.a alterniflora, Spartina patens and Salicorina sp. Along the
interface between wetlands and uplands the plant species include Borrichia frutescens, Myrica
cerifera and upland grasses and -shrubs. Given the resources that will be impacted the structure is
solely for access to public trust waters and has been limited to a pile supported structure, six feet
in width are required by applicable use standards.

(4) The floating docks and mooring piles will be installed no closer than
feet to the near edge of the 90-foot-wide, 12-foot-deep Federally maintained
channel within the Atlantic Intracoastal Waterway (ALWW).
(5) This permit does not authorize the interference with any existing or proposed
Federal project, and the permittee will not be entitled to compensation
for.damage or injury to the authorized structures which may be caused by,
or result from, operations undertaken by the United States in the public
interest.
(5) The permittee's scheme of development, of which the authorized work is a
part, contemplates the presence of structures and their attendant utilities
on lands subject to an easement in favor of the United States for the operation,
maintenance, improvement, and enlargement of the Atlantic Intracoastal Water-
way. Accordingly, the permittee will be required to remove such structures
and improvements at his own expense in' the event that, in the judgment
of the U. S. Army Corps of Engineers acting on behalf of the United States,
said lands are needed at any time for any purpose within the scope of said
easement. Permanent buildings will not be constructed in areas subject
to easement.
(7) The permitted structure may be subject to damage by wavewash from passing
vessels. The issuance of this permit does not relieve the ttee from
taking all proper steps to ensure the integrity of the permittedistructurre
and the safety of moored boats from damage by wavewash. The permittee will
not hold the United States liable for any such damage.
Construction
(8) In order to protect juvenile shrimp populations, no excavation or filling
will be permitted between April 1 and September 30 of any year without t
prior approval of the Division of Coastal Management. he
(9) The area over the 14" force main shall not be excavated unless the applicants
can certify that the dine will have at least 4' cover remaining_
(10) No excavation will be accomplished landward of the mean low water (MLW)
elevation contour. No intertidal or marsh areas will be excavated.
(11) The temporary placement or double-handling of excavated or fill mater'
within waters or wetlands is not authorized. gals

(15) The bulkhead alignment will approximate the mean high water level. To
preclude an unintentional violation of this condition, DCM and COE personnel
are available to stake such alignment.
(16) To. reduce the quantity of marsh vegetation to b

(17) The fill material, placed to construct the vehicle pull-off adjacent to

flooded wetland vegetation.
NOTE: The project does require a 401 Certification and is covered under general
certification for bulkhead construction, No_. 1272 issued November 10,
1978.
NOTE: The permittee is reminded that this permit authorizes only that work
described on the attached plats. Improvement to the parking area, e.g.,
will require a modification of this permit.
Operation
(18) Prior to occupancy of any slips authorized herein, the marina must be r-
manently equipped with a. pumpout'.facility to service boats with holding
tanks.
(19) There shall be no overboard discharge of sewage from boats docked at the
marina. Therefore, a "no sewage discharge policy" must be posted and enforced
for boats not equipped with holding tanks.
(20) All floating structures, other 'than boats, used. for habitation or commerce
(as defined in 15 NCAC 7M.0602) shall be-in conformance with local regulations
for onshore sewage treatment.
(21) Living aboard boats docked at the authorized marina is prohibited.

The enclosed permit constitutes authorization under the Coastal Area Managelrent Act and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original
(yellow form) is retained by you and it rust be available on-site when the, project is inspected for
compliance. Please sign both the original and the copy and return the copy to this office in the enclosed
envelope. Signing the permit and proceeding means you have waived your right of,'appeal described below.
If you object to the permit, as conditioned, you may request an appeal hearing before the Coastal
Resources Corrrnission pursuant to NCGS 1134-122 or 113-229. Such hearing must be requested within twenty
(20) days of your receipt of this letter. You should also be aware that, by law, if another qualified
party submits a valid objection to the issuance of this permit within twenty (20) days, the matter
must be resolved prior to work initiation.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all
work must be carried out in accordance with your application. Modifications, time extensions and future
maintenance require additional approval. Please read your permit carefully prior to starting work
and review all project plans, as approved. If you are having the work done by a contractor, it would
be to your benefit to be sure that he fully understands alI permit requirerlents.
Fran. time to time, Department personnel will visit the project site. - To facilitate this review,
we request that you complete and mail the enclosed Notice Card just prior to work initiation. However,
if questions arise concerning permit conditions, envirornlental safeguards, or problem areas, you may
contact Depart7ent personnel at any time for assistance. By working in accordance with the permit,
you will be helping to protect our vitally irrportant coastal resources.

Dear Mr. Brooks:
The purpose of the enclosed package is for Quible & Associates, PC to submit a Major CAMA
Permit Application for the construction of a pile supported pier and mooring system. The subject
property is an approximately 1.24 acre parcel of land located adjacent to Summer Rest Road and
US Highway 74-76 in Wilmington, New Hanover County, NC. The property owner is CGRS
Enterprises, LLC.
Enclosed with the correspondence is a project narrative and a plan view plat with cross section
details that accurate depicts the subject property and the development proposed. Also included
are Forms DCM-MP-1 and 4, a check for $250.00 to cover the permit application, letters to
adjacent riparian property owners and, as a reference, a copy of a Major CAMA permit (#13-86)
issued in by the Division 9f Coastal Management 1986 for the subject property that authorized a
10 slip mooring facility.
