On Rescission requested, the Division of Water Quality received your request to rescind your coverage
under Certificate of Coverage Number NCG210317. In accordance with your request, Certificate of
Coverage Number NCG210317 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

Dear Mr. Schuster:
In June, 2004, Mr. Keith Caruthers, owner of The Mulch Masters of NC, Inc. received a notice of
violation (NOV) from your office dated June 14, 2004. Mr. Caruthers attempted to respond to
the NOV himself on June 28, 2004 after having completed some emergency construction work to
relieve the situation; however, DWQ staff indicated that a more in-depth response would be
required. Mr. Caruthers then contacted me in early July, 2004 and requested my assistance in the
matter.
On July 5, 2004 I spoke by telephone to Mr. J. D. Hester to obtain a briefing on the matter. After
several referrals, I then spoke to Mr. Bradley Bennett about the matter on July 8, 2004. Mr.
Bennett indicated that he wished to assemble key personnel from DWQ staff to meet with Mr.
Caruthers and myself in order to establish a proper required response to the NOV since there was
confusion on the part of DWQ staff as to exactly what type of response was required. Mr.
Bennett stated that he would contact me with proposed meeting dates.
I wish to report to you that Mr. Caruthers and myself continue to await contact from Mr. Bennett
and have tried to contact him by e-mail and telephone as follow up. I forward this letter on behalf
of my client, Mr. Caruthers, to ensure you that he is most anxious to provide complete and proper
response to the NOV. We look forward to contact from your agency.

Dear Mr. Schuster:
I am in receipt of your notice of violation dated June 14°i-2004. My.responses to your
three points of issue are as follows:
1. The cause of the discharge was a failure on my part to inspect.daily the backside'
of my mulch piles for potential effluent discharge. The estimated amount spilled.
or discharged, I do not know. I feel the amount was small due to the hardwood
bark fiber's natural absorbency.
2. I eliminated the seepage immediately upon notice by your staff that the leakage .
was occurring. The mulch pile was moved away from the drainage ditch and the
ditch was cleaned. A natural earthen berm was installed with'a retention pond '
built to divert and capture the leakage and any storm water run off from the mulch
area. This,retained water is being pumped back into the mulch pile: A copy of
my plan is enclosed.
3.. The mulch piles are now inspected on a daily basis. My first knowledge of the
mulch seepage,was known when'your staff notified me in person. Once notified,
I took immediate corrective action. I have met with Environmental Biologist, Mr.
Robert J. Goldstein, Ph.D. to assist me in obtaining a recycle;permif for my:
location at 9410 Durant Road in Raleigh. He has engaged Mr. W.K. Dixon for
the professional engineering work.

The following plan will capture the run-off of my storm water from the materials I
store at 9410 Durant Road. The captured water will then be pumped onto the existing
hardwood bark for 100% retainment.

Dear Mr. Caruthers:
On April 27, 2004, Mr. Jarwin (JD) Hester with this office visited the site near the 10000
block of Durant Road in Raleigh, NC.
This investigation revealed that mulch effluent was actively discharging to an unnamed
tributary to the Neuse River. A significant amount of a black liquid was observed in the creek.
There was also a noticeable odor detected in the creek. It is unclear how long this discharge was
ongoing.
On April 28, 2004, water quality sampling of the unnamed tributary (UT) was conducted
by Mr. Shannon Langley with this office. The results indicated extremely elevated BOD
(Biological Oxygen on Demand) values. A BOD reading of 3000 mg/1 was reported
approximately 50ft down gradient of the spill area with a DO ( Dissolved Oxygen) reading of .36
mg/l. A sample taken at the property line just before the fence revealed a BOD of 290 mg/1 and a
DO of 2.10 mg/l. The instream water quality standard of D.O. is 5 mg/l.
On April 27, 2004, DWQ staff discussed this incident with you and recommended
immediate clean-up.
The above mentioned discharge is a violation of North Carolina General Statues (NCGS)
143-215.1 (a) (1) and (6) which states " No person shall do any of the following things or carry
out any of the following activities until or unless such person shall have applied for and shall
have received from the Division of Water Quality a permit therefore and shall have complied
with such conditions, if any as are prescribed by such permit:"

(1) Making any outlets into the water of the state;
(6) Cause or permit any waste, directly or indirectly, to be discharged to or in any
manner mixed with the waters of the state;
This is also a violation of 15A NCAC 213.0211 (3)(b), which states, "Dissolved oxygen: not less
than a daily average of 5.0 mg/l."
Please note that violations of NCGS 143-215.1 are subject to civil penalties of up to $25,000
dollars per day, per violation.
This office is issuing a Notice of Violation regarding this matter. Please respond to this
notice, in writing, within 15 days of receipt. You should specifically discuss the following
points:
t. Explain the cause of the discharge? Please include all information concerning
the estimated amount spilled, calculations, etc.
2. How have you eliminated the discharge and what steps have been taken to
prevent its reoccurrence?
3. How often are these mulch piles inspected? State when first knowledge of this
spill was known to you or your representatives.
The Mulch Masters of N.C., Inc. is required to apply for and shall obtain a recycle
permit for this facility. Please be advised that any design work must be performed by a licensed
professional engineer. All approval of the final plans and specifications should come from the
Division of Water Quality before any construction occurs.
Failure to complete the required items as specified in this letter may result in a
recommendation from this office for civil penalty assessment for the discharge without a permit.
The discharge is a violation of NCGS 143-215.1, which may incur civil penalties of up to
$25,000 per day per violation per each violation.

On April 27, 2004, Mr. Jarwin (JD) Hester with this office visited the site near the 10000
block of Durant Road in Raleigh, NC.
This investigation revealed that mulch effluent was actively discharging to an unnamed
tributary to the Neuse River. A significant amount of a black liquid was observed in the creek.
There was also a noticeable odor detected in the creek. It is unclear how long this discharge was
ongoing.
On April 28, 2004, water quality sampling of the unnamed tributary (UT) was conducted
by Mr. Shannon Langley with this office. The results indicated extremely elevated BOD
(Biological Oxygen on Demand) values. A BOD reading of 3000 mg/I was reported
approximately 50ft down gradient of the spill area with a DO ( Dissolved Oxygen) reading of .36
mg/I. A sample taken at the property line just before the fence revealed a BOD of 290 mg/I and a
DO of 2.10 mg/l. The instream water quality standard of D.O. is 5 mg/l.
On April 27, 2004, DWQ staff discussed this incident with you and recommended
immediate clean-up.
The above mentioned discharge is a violation of North Carolina General Statues (NCGS)
143-215.1 (a) (1) and (6) which states " No person shall do any of the following things or carry
out any of the following activities until or unless such person shall have applied for and shall
have received from the Division of Water Quality a permit therefore and shall have complied
with such conditions, if any as are prescribed by such permit:"

(1) Making any outlets into the water of the state;
(6) Cause or permit any waste, directly or indirectly, to be discharged to or in any
manner mixed with the waters of the state;
This is also a violation of 15A NCAC 213.0211 (3)(b), which states, "Dissolved oxygen: not less
than a daily average of 5.0 mg/k"
Please note that violations of NCGS 143-215.1 are subject to civil penalties of up to $25,000
dollars per day, per violation.
This office is issuing a Notice of Violation regarding this matter. Please respond to this
notice, in writing, within 15 days of receipt. You should specifically discuss the following
points:
1. Explain the cause of the discharge? Please include all information concerning
the estimated amount spilled, calculations, etc.
2. How have you eliminated the discharge and what steps have been taken to
prevent its reoccurrence?
3. How often are these mulch piles inspected? State when first knowledge of this
spill was known to you or your representatives.
The Mulch Masters of N.C., Inc. is required to apply for and shall obtain a recycle
permit for this facility. Please be advised that any design work must be performed by a licensed
professional engineer. All approval of the final plans and specifications should come from the
Division of Water Quality before any construction occurs.
Failure to complete the required items as specified in this letter may result in a
recommendation from this office for civil penalty assessment for the discharge without a pen -nit.
The discharge is a violation of NCGS 143-215.1, which may incur civil penalties of up to
$25,000 per day per violation per each violation.

Walked stream for several hundred feet and observed a black liquid in the water. Followed the waste upstream and
observed an ogoing discharge coming from a Mulch Master site off Durant road in Raleigh. Requested that clean-up

I talked to Lyle Kobus with Mallinckrodt @ 4:50 PM concerning the blackened
creek. It was determined that the source of the discharge was coming from behind
a large pile of mulch off of the Mulch Master site. The facility is located
adjacent to the Fire Station 421 off of Durant road. The creek can be accessed
from this location by contacting Mallinckrodt. This Mulch Master site may be a
new. Unknown if it has a NCG permit or if this facility is covered under the old
permit. No permit on site. Talked to Mr. Car. with Mulch Master about situation.
Requested cleanup and containment of the spill. Mr. C mentioned that pile was to
be moved in the morning. The creek was impacted for amount 1/2 mile through
Mallickrodt property to UT to Neuse river. Heavy organic odor was apparent along
the creek. Discharge was observed ongoing from the base of the mulch pile which
is directly closest to the creek. A BOD and N sample and pH reading should be
taken from the creek. Sorry to leave this with yall for I will be in Greensboro
on wed and thur. Mr. Kobus would allow access if necessary for clean-up
activities. Myrl- Mr. C. might call you tomorrow about the discharge. I put the
photos on 2004: mulch master

Here is the info for the mulch master NOV:
I was at the site on 4/28/2004 from - 11:30 am - -2:30 pm.
The first BOD sample, labeled MM1, (3000 mg/1) was taken about 50 feet down below
the mulch pile in that first ditch. The ditch had flow in it at the time and had a
corresponding D.O. level of .36 mg/l.
The second BOD sample, labeled MM2 (260 mg/1), was taken - 25 feet beyond the
confluence of the affected UT and an unaffected UT and had a D.O. level of 4.14.
The unaffected UT had a D.O. of 6.8 mg/1 jusp upstream of the confluence. This
makes sense. The unaffected UT had a lot more flow and the material had only mixed
together for short time.
The third 30D sample, labeled MM3 (290 mg/1) was taken at the property line just
before the fence. The D.O. in that area had dropped to 2.10 mg/l.
I went back on
05/04/2004 and
the mulch pile had been moved.
MM staff were
constructing a
temporary -berm"
and the creek looked better.
There had been a huge
rain event just
before as you
will recall. They had gone and
removed some of the
solid material
from the creek
nearest to mulch pile location.
There still appeared
to be a lot of'mulch"
product
downstream though.
They should apply for a recycle permit and have an engineer design the basin they
are talking about putting in.
I might go look at the operation in Apex sometime soon.
