We received your December 21, 2007 letter on January 2, 2008 and have taken immediate action to
remedy the issues that were highlighted in paragraphs 3, 4, and 5.
On January9, 2008 we had a contractor repair the damage to the containment walls around the diesel
tank as noted in paragraph 4.
On January 9, 2008 a valve was placed on order and we anticipate the closing and securing of the
drain line as noted in paragraph 4 by January 18, 2008.
Per your recommendation in paragraph 5, we have instituted an alternative method of sawdust
disposal. Starting on January 3, 2008 sawdust will no longer be disposed near the riparian barrier.
We have contracted with a local environmental consulting firm to develop an adequate SP3 plan as
noted in paragraph 3. We request a 90 day extension on implementation of the plan in order to give
the consultant time to write the plan and for the training of appropriate personnel to occur.
Please note that Allan Carter will still serve as our primary point of contact. Thank you again for the
November inspection and for bringing these issues to our attention.

NCG210000 which is a new General Permit to cover most of the Timber Products Industry. You
have now been given coverage under NCG210000 and your coverage under NCGO40O00 is hereby
terminated. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection Agency dated December 6, 1983.
The following information is included with your permit package:
■ A copy of the stormwater general permit NCG2100O0.
■ A new Certificate of Coverage under general permit NCG210000.
■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit (both NCG04O000 and NCG210O00). This form must be completed and returned to the
.Division within 30 days of receipt of this letter. DO NOT send the SPPP with the signed form.
■ Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program which outlines program components
and addresses frequently asked questions.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.

I. Ron Boone, of the NC Division of Water Quality (DWQ), Raleigh Regional Office (RRO), Surface Water
Protection (SWP) section; conducted a stormwater compliance evaluation inspection (CEI) of the subject
facility on 8 November 2007. The CEI was conducted in order to assess Amerlink's compliance with
their general stormwater discharge permit, NCG210313. Your assistance and cooperation during the
inspection was greatly appreciated. The results of the CEI are summarized below and in the attached
inspection report.
2. The facility is located at 7991 Beasley Road in Whitakers, Nash County, NC. The NCG210313
Permit/Certificate of Coverage (COC) allows the discharge of stormwater to Swift Creek, which is
currently classified as a class C, nutrient sensitive water (NSW) in the Tar Pamlico river basin, from
stormwater point source discharges associated with activities classified as establishments primarily
engaged in Timber Products [standard industrial classification (SIC) 24].
3. At the time of the inspection, neither you nor any of your peers were aware of the stormwater permit and
its requirements. The facility does not have a stormwater pollution prevention plan (SP3) and has not
conducted any of the regular monitoring required by the permit.
4. There were also several issues noted at the site that violate the terms of your permit. One item in
particular concerns secondary containment systems for the bulk storage of liquid chemicals. There is one
active secondary containment on site for the diesel fuel tank, which is located on the north side of the
southernmost building. The walls of the containment were crumbling and the drain line was open and
unsecured. Please note that in accordance with your permit, secondary containment devices must be

properly maintained and strictly controlled. You must repair this containment immediately and manage it
in accordance with your permit.
5. Additionally, please be aware that NC Administrative Code 15A NCAC 02B .0259, establishes a 50-foot
wide riparian buffer directly adjacent to all surface waters in the Tar -Pamlico River Basin (intermittent
streams, perennial streams, lakes, ponds, and estuaries), excluding wetlands. This buffer is to remain
undisturbed without prior authorization from the Division, except for those uses established as exempt in
tl�te+tlgintioned rule. The sawdust being deposited in several areas on the outer perimeter of the site

6. At the time of the inspection you did not have a copy of the permit or certificate of coverage (COC). For
your convenience, a copy of the COC is attached to this NOV. To obtain a copy of the general permit,

7. Please note that the issues listed in paragraphs 3 and 4 above, constitute several violations of your permit
as well as NC General Statute 143-215.1, which are subject to civil penalties in an amount not to exceed
$25,000 per day per violation. Please reply in writing to the issues noted in paragraphs 3 through 5 of this
notice of violation within 30 days of receiving it. Your response must include a list of corrective actions
and an implementation schedule for those actions. You may wish to secure the services of a private
environmental consultant to help you achieve full and lasting compliance with all of the terms and
conditions of your permit. Should you have any questions regarding the inspection or this notice, please
