Dear Mr. Malphrus,
Mitch Hayes conducted the subject inspections on October 17, 2007. Your assistance and cooperation with
this inspection was greatly appreciated. Below is a list of findings and recommendations developed from the
inspection.
1. The subject NPDES permit NCO080519 was reissued 11/21/2003 and expires 03/31/2008. This permit
covers the discharge from a wet deck operation at the loth Street Facility. A permit renewal was received
in the NPDES Unit on October 09, 2007 and is currently being reviewed. Please continue to operate
under the last issued permit until a new permit is issued.
2. Spraying occurs when the temperature is above 50 degrees F. Most of the flow from log spraying is
conveyed to a grass lined ditch behind the property parallel to the railroad tracks. Discharge from the
new log yard sprayfield bordering Ninth Street flows through several screens to capture large pieces of
bark. Absorbent pads capture any fine bark solids and oil or grease that may be released into the stream
by equipment. The discharge from wet decking operation flows into a sedimentation basin divided into
three sections by gravel check dams. Rip/Rap is placed upslope of the sedimentation basin to prevent
over wash from the other wet decking operation. Water in the grass -lined channel appeared clear with no
indication of sediment build up. Water in the last gravel section before discharge appeared dark in color
but clear. There was no indication of any solids.
3. DMR's for the period July 2006 thru September 2007 were reviewed for compliance with permit limits
and monitoring requirements. Permit monthly average for settleable solids was exceeded for September,
and October 2006. These violations have already been addressed. BIMS also lists that Quarterly Total
Nitrogen is not being reported in pounds per quarter. Quarterly Total Nitrogen should be reported in
milligrams per liter as well as pounds per month. Annual Total Nitrogen load should be reported in
pounds /year. Calculation of TN in pounds per quarter can be found in the permit in section A. (2).
4. Commercial lab results, chain of custody records, and bench sheets were compared with data submitted
on the DMR for the month of May 2007. No discrepancies were noted. NOn, ca o ina

5. There is one distinct stormwater outfall for the 10`h Street facility. This outfall is located at the old 118 N
10`h Street address. The gravel and roadways are sprayed to prevent excess dust formation from vehicle
traffic. Water drains from the gravel yard, roadway, and from half of the other wet decking operation
bordering Ninth Street. The water is conveyed via underground pipe to the grass -lined channel that
discharges from outfall 002. Water in the grass -lined channel downstream from the outfall appeared
clear with no'indication'of sediment build up.
6. Qualitative monitoring report for June 22, 2007 is on file and compliant with permit conditions.

7. Permits NCG210080 and NCG210079 were rescinded March 16, 2006. Stormwater monitoring is not
necessary under these permits. Stormwater Permit NCG210252 covers all stormwater discharges from
the 10`h Street address.

8. This stormwater permit covers the property at 37 Peedin Road. There are two distinct outfalls though
BIMS lists one outfall 001. Flow from the facility consists of stormwater runoff and water from roadway
spraying for dust control. There are no wet decking operations on site. Both outfalls discharge into two
separate sedimentation basins with gravel check dams. One basin is located near the railroad tracks on
the east side of the property and the other basin is located on the west side of the property. Both basins
discharge into Buffalo Creek. The basin located near the railroad tracks was dry due to the ongoing
drought. The other sedimentation basin was not checked.
9. Qualitative monitoring report for June 27, 2007 was on file and compliant with permit conditions.

Inspection Summary:

The subject inspections were conducted by Mitch Hayes on May 26, 2005. The assistance and cooperation
of you, Chris Heritage and Crystal Benson was greatly appreciated. Below is a list of findings and
recommendations developed from the inspection.
The subject NPDES permit NCO080519 was reissued 11/21/2003 and expires 03/31/2008. This permit
covers the discharge from a wet deck operation at the 10`h Street Facility.
2. There was some confusion on the location of Outfall 001. The current permit lists two out£alls however;
during inspection only one outfall was noted. The last inspection conducted October 31, 2002 by Ted
Cashion, stated that there were two wet deck areas discharging at separate locations into a ditch beside
the railroad tracks. Outfall 001 was added to the reissued permit to account for the additional Outfall. If
there is not an additional wet deck operation producing any discharge, please indicate "no discharge" on
the Discharge Monitoring Reports (DMR) for Outfall 001. Outfall 001 can be deleted from the permit
upon the next reissuance if there is not an additional wet deck operation producing any discharge.
3. Spraying occurs when the temperature is above 50 degrees F. The discharge from Outfall 002 (lows into
a road ditch that has a gravel check dam installed. The water in the basin was but black in color though
not turbid. Water filters out of the check dam and continues to flow toward a drainage ditch next to the
railroad.
4. DMR's for the period April 2004 thru April 2005 were reviewed for compliance with permit limits and
monitoring requirements. No discrepancies were noted.
5.
Commercial lab results, chain of custody records, and bench sheets were compared with data submitted
on the DMR for the month of April 2005. No discrepancies were noted. N°.thca olina

6. According to Division of Water Quality's computer database, Basinwide Information Management
System (BIMS), Stormwater permits NCG210079, NCG21080, and NCG210252 cover the same 10'h
Street facility. The facility once was two distinct facilities specifically at 118 N loth Street and at 210 N
loth Street. The facilities are now contiguous and named the loth Street facility. Only one stormwater
permit is needed for this facility and a request was made to you via telephone to rescind Stormwater
Permits NCG210079 and NCG210080. This request was received in this office September 01, 2005.
Stormwater Permit Number NCG210252 will cover all stormwater discharges at this facility.

`were noted in the storm ditch. The solids are from the dust runoff from the gravel.
8. There have been no qualitative monitoring records kept for Stormwater Permit No. NCG210252 since
it's May 01, 2003 issuance. A Notice of Violation is being issued as a result of this failure. You stated
that records would be kept.

9. This storrwater permit covers the property at 37 Peedin Road. There are two distinct outfalls though
BIMS lists one outfall 001. Flow from the facility consists of stormwater runoff and water from roadway
spraying for dust control. Both outfalls discharge into two separate sedimentation basins. One basin is
located near the railroad tracks on the east side of the property and the other basin is located on the west
side of the property. Both basins discharge into Buffalo Creek. There is a sedimentation basin on an
adjoining property discharging into a small tributary. Lampe & Malphrus Lumber Company once owned
this property and is no longer responsible for the discharge from this basin. The Peedin Road facility
does not discharge into this tributary.
10. Water in the sedimentation basin next to the railroad tracks was cloudy, orange in color most likely from
previous rains. The discharge flowing out of the basin and into Buffalo Creek was clear.
11. The condition of the water in the sedimentation basin on the west side of the property could not be
ascertained. Thick underbrush was restricting access to the basin. You stated that the underbrush would
be cut and the access maintained.
12. There have been no qualitative monitoring records kept since September 14, 1999. A Notice of
Violation is being issued as a result of this failure.
13. The Stormwater Pollution Prevention Plan for the Peedin Road facility was updated in 2003. Items I
through 9 of Section A of the Plan are being maintained.

Two outfalls discharge from the wet deck operation. The wet deck operation is covered under Permit NC0080519.
The other outfall is at the opposite end of the facility at the old address 118 North loth Street. This outfall
receives discharge from road runoff which is wetted to prevent dust formation from vehicle traffic. This
discharge contains fine silt from the "crush and run" gravel. The flow enters a drainage ditch beside the
railroad.

The SWPPP was updated in 2003 April. There have been no qualitative monitoring records kept. There are two
distinct outfalls. As inspected, outfall 004 and 003'are discharges from stormwater retention basins. outfall
004 was accessible. The water in the stormwater basin orange in color, cloudy, most likely from previous rains.
The discharge flows approximately 50 yards into Buffalo Creek. The condition of the stormwater basin that
flows to outfall 003 could not be determined due to the right of way not being maintianed. Mr. Malphrus
stated that the stormwater basin is identical to outfall 004 stormwater basin.

permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection
Agency, dated December 6, 1983.

NCG210000 which is anew General Permit to cover most of the Timber Products Industry. You
have now been given coverage under NCG210000 and your coverage under NCG040000 is hereby
terminated. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection Agency dated December 6, 1983.

■ A new Certificate of Coverage under general permit NCG210000.
■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit (both NCGO40000 and NCG210000). This form must be completed and returned to the
Division within 30 days of receipt of this letter. DO NOT send the SPPP with the signed form.
■ Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program which outlines program components
and addresses frequently asked questions. '
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
