Multiple departments responded to this spill due to the amount foam that was observed in town and reported to authorities. Shamrock Environmental was hired and on -site the evening of the spill and pumped out the stormwater detention basin closest to the tank spill and placed absorbent booms in the stormwater release channels. Clean-up and pumping of the stormwater detention basin continued the following day. Also, barricades with wood fiber, dirt, and hay bales were placed/constructed in order to abate/stem product loss/conveyance of spill product to stream. Product was pumped from the above ground tank containment/process area and a temporary plug was placed in stormwater discharge pipe that receives the flow from the above ground tank process area. DWR staff observed visible foam and product in the stream the day of the spill. The impacted stream segment documented the day of the spill was estimated at 0.5 miles of stream. The Raleigh Region received the lab results in April 2014 that revealed the following: Location Description Sample Result (Copper) 1 UT to Picture Creek Upstream 9.6 ug/L Conductivity = 28 uS/cm 2 Stormwater Outfall/Side Stream 001 (downstream Stormwater basin outlet) 59 ug/L Conductivity = 220 US/cm 3 Stormwater Outlet/Side Stream 002 (In - Stream Sample at outlet (UT to Picture 42 ug/L Creek) Conductivity = 346 uS/cm 4 28 th Street (UT to Picture Creek, see photo page 6 of this report) 44 ug/L Conductivit =206 uS/cm 5 D Street (UT to Picture Creek) 12 ug/L Conductivity =195 uS/cm Palletone of North Carolina, Inc. 05/07/2014 Page 6 of 8 A sample was taken the following morning on February 22, 2014 prior to the additional pump out of the Stormwater Pit/Basin closest to the spill location. Location Description Sample Result (Copper) 6 PalletOnePit (Stormwater Pit behind lumber yard (Closest to spill -see photo page 4 of this 300 ug/L report) Conductivity =250 The investigation confirmed violations of North Carolina General Statutes and North Carolina Administrative Codes, 15A NCAC 02B .0211 (2), 15A NCAC 02B .0211 (3)f , and 15A NCAC 02B .0211 (3)(1)(xiv). These Statutes and North Carolina Administrative Code violations respectively states the following: Removal of Best Usage 15A NCAC 02B .0211 (2) The waters shall be suitable for aquatic life propagation and maintenance of biological integrity, wildlife, secondary recreation, and agriculture; sources of water pollution which preclude any of these uses on either a short-term or long-term basis shall be considered to be violating a water quality standard. Other Waste 15A NCAC 02B .0211 (3)(f) Oils; deleterious substances; colored or other wastes: only such amounts as shall not render the waters injurious to public health, secondary recreation or to aquatic life and wildlife or adversely affect the palatability of fish, aesthetic quality or impair the waters for any designated uses; Toxic Substances 15A NCAC 02B .0211 (3)(1)(xiv) Numerical water quality standards (maximum permissible levels) for the protection of human health applicable to all fresh surface waters are in Rule .0208 of this section. Numerical water quality standards (maximum permissible levels) to protect aquatic life applicable to all fresh surface waters: Copper 7 ug/L These violations and any future violations are subject to civil penalty assessment of up to $25,000 per day per violation. Please respond to this letter in writing with 30 days of receipt. Palletone of North Carolina, Inc. 05/07/2014 Page 7 of 8 The 5- Day Report revealing a detailed account of the spill was submitted as required. A response is also required to this Notice of Violation. The response to this Notice of Violation should address the followine: 1) Please communicate how much product was in the Above Ground Storage Tank prior to the release and how much product was subsequently spilled from the tank. Also clearly detail how much product was released to the stormwater retention ponds, provide an estimate of the amount of biocide product that was discharging to surface waters, and explain how these calculations were determined. 2) Please explain the following: a- why the above ground tank secondary containment failed in this case to retain the product from release. b- why the tank level malfunctioned c- why the tank was left unattended during continuous filling operation d- specifically address what caused the release/failure 3) Please clearly explain when you were first aware of the spill, who you notified and when the notification was made. 4) Clearly communicate in your written response what cleanup efforts were taken and when contractors got on site. 5) Clearly communicate in your written response what measures the contactors installed, specifically what did they do. 6) Clearly communicate in your written response the ultimate disposal of the recovered product. Thank you for your attention to this matter. This office requires that the violations, as detailed above, be abated immediately and properly resolved. Environmental damage and/or failures to proper maintain, operate infrastructure have been documented for the subject site as stated above. Your efforts to undertake activities to bring the subject site back into compliance is not an admission, rather it is an action that must be taken in order to begin to resolve ongoing environmental issues. These violations and any future violations are subject to a civil penalty assessment of up to a maximum of S25,000.00 per day for each violation. Your above -mentioned response to this correspondence will be considered in any civil penalty assessment process that may occur.
