A facility that does not retain exposed (either exposed to incident precipitation or exposed to stormwater run on) piles of sawdust, wood chips, bark, mulch, or other similar material on
site for more than seven (7) days before removing the material is not required to monitor for the parameters in Table 1 of the General Permit. If at any time the material is not removed
within this time frame, the facility must begin analytical monitoring immediately. (Reminder: This condition does not exempt any facility from qualitative monitoring of SDOs.)
If the facility removes such materials within seven days to meet the monitoring exemption, the Permittee shall record and maintain in the facility's SPPP a log which documents, at a
minimum, the dates when material is generated and removed, how removed, and by whom. The log must be sufficient to establish that no materials were exposed for longer than seven
days. For record -keeping purposes, the Permittee may also maintain in the SPPP this form with the signed certification below:
"Based upon my inquiry of the person or persons directly responsible for managing compliance with the permit requirement for analytical monitoring, I certify that to the
best of my knowledge and belief, no piles of sawdust, wood chips, bark, mulch or other similar materials were stored exposed (either to incident precipitation or to

On March 6, 2014, the Raleigh Regional Office of the Division of Water Resources (DWR)
received a spill incident report for the lumber dip tank overflow -biocide spill that occurred on
February 21, 2014 at the Butner Palletone Facility. A Notice of Violation (NOV-2014-11C-0053)
was issued to Palletone of North Carolina, Inc. on May 7, 2014.
Thank you for your response(s) to the Notice of Violation. We have reviewed the responses and
the response letters dated .tune 2 and June 17, 2014 revealed:
1) An above ground tank used for treating wood with ISK biocide products (for fungal/mold
prevention of wood pallets for use in pharmaceutical industry) over -flowed and discharged to
two stormwater detention ponds.
2) The stormwater detention basins discharged the day of the spill conveying diluted product
(Biocides and water) as explained in the Notice of Violation response through the stormwater
release channels that have formed as a result of the stormwater outfall discharges.
3) A storm and heavy rain event also occurred the day of the release.
4) Palletone reported that a level valve had failed and was not discovered until later and the
water supply (biocide/water) continuously filled the tank. The size of the tank was reported to be
4500 gallons, and amount of water and biocide released from the tank was reported to be 624
gallons.

Accordingly, a biocide product was discharged through the stormwater outfalls during the time
of the level valve failure until the time it was discovered. The receiving stream is an unnamed
Tributary to Picture Creek, a Water Supply (WS-V), Nutrient Sensitive Water (NSW) draining to
Falls Lake in the Neuse River Basin
As a part of the site investigation the evening of the spill and following day, surface water
samples were collected. The Raleigh Region received the lab results in April 2014.
After review of the sample results and your reponse to the violations cited on May 7, 2014, the
following violation(s) of North Carolina General Statutes NC G.S. 143-215.1 (a) (1) and 143-
215.1(a) (6) are also identified and respectively state the following:
NCGS 143-215.1 (a) (1) "Activities for Which Permits Required. - No person shall do any of
the following things or carry out any of the following activities unless that person has received a
permit from the Commission and has complied with all conditions set forth in that permit.
(1) Make any outlet into the Water s of the State."
NC C.S. 143-215.1(a) (6) requires that no person shall cause or permit any waste, directly or
indirectly, to be discharged to or in any manner intermixed with the waters of the State in
violation of the water quality standards applicable to the assigned classifications or in violation
of any effluent standards or limitations established for any point source, unless allowed as a
condition of any permit, special order or other appropriate instrument issued or entered into by
the Commission under the provisions of this Article.
These violations and any future violations are subject to a civil penalty assessment of up to
a maximum of 525,000.00 per day for each violation

On Friday, February 21, 2014, the Town of Butner, Granville County Emergency Management,
and local South Granville Sewer and Water Authority observed a spill and foam in an unnamed
tributary of Picture Creek in the vicinity of 28 th Street, D-Street, E-Street, and downstream to
the bridge at Veazey Rd. The Raleigh Regional Office of the Division of Water Resources
(DWR) responded to an anonymous complaint of the spill Friday afternoon.
Autumn Romanski of the Raleigh Regional Office conducted a site visit/investigation, walked
sections of the creek, took photographs, and collected surface water samples. In addition, DWRs
staff also conducted a file review. The DWR file review revealed that Palletone was covered
under NCG210015 General Stormwater Permit, for discharging stormwater.
The site investigation, communications with Palletone, ISK Biocides Inc., Town of Butner,
South Granville Sewer and Water Authority, and Shamrock Environmental revealed the
following:
1) An above ground tank used for treating wood with ISK biocide products (for fungal/mold
prevention of wood pallets for use in pharmaceutical industry) over -flowed and discharged to
two stormwater detention ponds.

2) The stormwater detention basins discharged the day of the spill conveying diluted product
(Biocides and water) through the stormwater release channels that have formed as a result of the
stormwater outfall discharges.
3) A storm and heavy rain event also occurred the day of the release
4) Palletone reported that a level valve had failed and was not discovered until later (time
interval not known the day of the spill) and the water supply (biocide/water) continuously filled
the tank. The size of the tank, and amount of water and biocide released from the tank was not
known the, day of the spill.
5) The 5- Day Report revealing a detailed account of the spill was submitted as required via e-
mail on February 27, 2014.
Accordingly, a biocide product was discharged through the stormwater outfalls during the time
of the level valve failure until the time it was discovered. The receiving stream is an unnamed
Tributary to Picture Creek, a Water Supply (WS-V), Nutrient Sensitive Water (NSW) draining to
Falls Lake in the Neuse River Basin. Multiple departments responded to this spill due to the
amount foam that was observed in town and reported to authorities.
Shamrock Environmental was hired and on -site the evening of the spill and pumped out the
stormwater detention basin closest to the tank spill and placed absorbent booms in the
stormwater release channels. Clean-up and pumping of the stormwater detention basin
continued the following day. Also, barricades with wood fiber, dirt, and hay bales were
placed/constructed in order to abate/stem product loss/conveyance of spill product to stream.
Product was pumped from the above ground tank containment/process area and a temporary
plug was placed in stormwater discharge pipe that receives the flow from the above ground tank
process area.
DWR staff observed visible foam and product in the stream the day of the spill. The impacted
stream segment documented the day of the spill was estimated at 0.5 miles of stream. During
sampling efforts, DWR staff observed no dead fish in the unnamed tributary of Picture Creek.

The investigation confirmed violations of North Carolina General Statutes and North Carolina
Administrative Codes, 15A NCAC 02B .0211 (2), 15A NCAC 02B .0211 (3)f , and 15A NCAC
02B .0211 (3)(1)(xiv). These Statutes and North Carolina Administrative Code violations
respectively states the following:
Removal of Best Usage 15A NCAC 02B .0211 (2)
The waters shall be suitable for aquatic life propagation and maintenance of biological integrity,
wildlife, secondary recreation, and agriculture; sources of water pollution which preclude any of
these uses on either a short-term or long-term basis shall be considered to be violating a water
quality standard.
Other Waste 15A NCAC 02B .0211 (3)(f)
Oils; deleterious substances; colored or other wastes: only such amounts as shall not render the
waters injurious to public health, secondary recreation or to aquatic life and wildlife or adversely
affect the palatability of fish, aesthetic quality or impair the waters for any designated uses;
Toxic Substances 15A NCAC 02B .0211 (3)(1)(xiv)
Numerical water quality standards (maximum permissible levels) for the protection of human
health applicable to all fresh surface waters are in Rule .0208 of this section. Numerical water
quality standards (maximum permissible levels) to protect aquatic life applicable to all fresh
surface waters: Copper 7 ug/L
These violations and any future violations are subject to civil penalty assessment of up to
$25,000 per day per violation. Please respond to this letter in writing with 30 days of receipt.

The 5- Day Report revealing a detailed account of the spill was submitted as required. A
response is also required to this Notice of Violation. The response to this Notice of
Violation should address the followine:
1) Please communicate how much product was in the Above Ground Storage Tank prior to
the release and how much product was subsequently spilled from the tank. Also clearly
detail how much product was released to the stormwater retention ponds, provide an
estimate of the amount of biocide product that was discharging to surface waters, and
explain how these calculations were determined.
2) Please explain the following:
a- why the above ground tank secondary containment failed in this case to retain
the product from release.
b- why the tank level malfunctioned
c- why the tank was left unattended during continuous filling operation
d- specifically address what caused the release/failure
3) Please clearly explain when you were first aware of the spill, who you notified and when
the notification was made.
4) Clearly communicate in your written response what cleanup efforts were taken and when
contractors got on site.
5) Clearly communicate in your written response what measures the contactors installed,
specifically what did they do.
6) Clearly communicate in your written response the ultimate disposal of the recovered
product.
Thank you for your attention to this matter. This office requires that the violations, as
detailed above, be abated immediately and properly resolved. Environmental damage
and/or failures to proper maintain, operate infrastructure have been documented for the
subject site as stated above. Your efforts to undertake activities to bring the subject site back
into compliance is not an admission, rather it is an action that must be taken in order to begin
to resolve ongoing environmental issues.
These violations and any future violations are subject to a civil penalty assessment of up
to a maximum of S25,000.00 per day for each violation. Your above -mentioned response
to this correspondence will be considered in any civil penalty assessment process that may
