This permit has been reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007. The following information is included with your permit package: • A new Certificate of Coverage • A copy of stormwater General Stormwater Permit NCG210000 • A copy of the Technical Bulletin for the General Permit • Five copies of the Discharge Monitoring Report (DMR) Form • Five copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. The more significant changes to the General Permit include the following: • Permit cover page, second paragraph — The General Permit now may cover activities that DWQ determines to be similar in either the process, or in the exposed materials, to the Timber Products Industry. • Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL, may not be eligible for continued coverage at the next renewal of the General Permit. • Part I Section B second paragraph — A new clarification that the permit does not authorize discharges that DWQ determines are wastewaters. • Part II Section A — The required contents of the Stormwater Pollution Prevention Plan have been expanded and clarified. • Part II Section B Table 1 — A new requirement to sample stormwater discharges twice per year for those facilities with exposed piles of certain materials remaining on site longer than seven days. • Part II Section B Tables 2 and 3 and following — For permittees with exposed piles, there are new provisions requiring the permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences. • Part II Section B — For permittees with exposed piles, a new provision that four exceedences of any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control measures. • Part II Section C — Clarification that under the qualitative monitoring provisions of the permit, the permittee is obligated to respond to repeated observations of stormwater pollution. DWQ may impose additional stormwater management requirements if the permittee is non -responsive, or if the responses are ineffective. In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the subject discharge has been terminated, please complete the enclosed rescission request form. A valid reason for requesting rescission is required, incomplete forms will be returned and you will still be subject to possible escalated action. Mailing instructions for submitting rescission request are listed on the bottom of the form. You will be notified when the rescission process has been completed. The facility is located on highway 64 east business, on the east side of Nashville, just across the street from Cavalier's business office which is located at 1001 Eastern Avenue, in Nashville, Nash county, NC. The NCG210206 permit/Certificate of Coverage (COC) allows the discharge of stormwater from point source discharges associated with industrial activities classified as establishments primarily engaged in Timber Products [standard industrial classification (SIC) 24], to an unnamed tributary to Sapony Creek, which is currently classified as a class C, nutrient sensitive water (NSW) in the Tar Pamlico river basin. 3. There were several issues noted at the site that should be corrected in order to comply with the NCG210206 permit. The policies and/or procedures you develop to correct these issues should be incorporated into the site's stormwater pollution prevention plan (SP3) and fully implemented. The issues noted are as follows: a. There is currently a great deal of equipment and building materials stored outside exposed to precipitation. There is no large bulk storage of chemicals that require secondary containment, however there were several smaller containers of chemicals (i.e. 55 and 5 gallon containers), such as the antifreeze used in the plumbing systems, which should be stored and dispensed from inside a building. There was apparent incidental spillage around the immediate area of the antifreeze dispensing station. Such spillage could contaminate stormwater runoff from the site. All chemical storage and dispensing activity_ should be "established inside a building and regular clean up procedures developed and implemented.for all spills. c. There wer(:�4severalsgarbage`dumpsters and containers around the site. All garbage containers should remain covered at all times except for when in use. There was a large garbage compactor located on the southwest corner of the site that had a large amount of sheet rock dust and other debris all around the compactor. This area should be cleaned up and better maintained. The sheet rock dust as well as larger debris can also contaminate stormwater runoff. d. There were several 55 gallon drums and 5 gallon buckets around the site that were emptied of their original contents and were either discarded or used to hold/store other items. Some of the 5 gallon buckets contained the residue of the original contents and were exposed. The use of such containers should be limited to prevent their unauthorized use and exposure of potential pollutants to precipitation. Additionally, all containers should be labeled with their contents and/or intended use and properly covered/scaled to protect stormwater from contaminants in the containers or on the materials in the containers. Containers should be properly cleaned out and the residue properly disposed of before such use. e. There is a fenced -in compressor/dryer area on the west side of the large building located on the west side of the site. The compressor and dryer are technically covered in this area but these mechanical units do have a small discharge that was apparent during the inspection. The discharge pooled up in a low spot of the concrete/asphalt floor of the fenced -in area and did not flow any further. The pooled up wastewater had oily sheen on top of it. Although it simply pooled up on the floor during the inspection, a large rainstorm would certainly fall into the fenced -in area and wash out any of the discharge that is on the floor. The source of the oily sheen should be identified and corrected. Also, you must install a concrete curb or some other containment device to prevent the loss of this wastewater outside the fenced -in area. Such discharge is a violation of NC General Statute 143-215.1, Control of Sources of Water Pollution; Permits Required. Discharge of this wastewater without the appropriate permit is subject to civil penalty assessments. 4. The facility does not have a SP3 fully developed and implemented as required in the permit. Proper development and implementation would effectively address each of the issues noted above. Please refer to Part II, Section A of the permit for details on what is required in the SP3. 5. Qualitative monitoring has not been accomplished as required in the permit. Also, it was apparent during the inspection that not all stormwater discharge outfalls (SDO) have been identified and monitored as required. It appears that the southwest corner of the site, near the trash compactor, drains separately and constitutes another SDO. You must reevaluate the entire site to ensure all SDOs are identified and monitored as required in the permit. Finally, the SDOs have not been evaluated for the presence of non- stormwater discharges as required in Part 11, Section A, Paragraph le of the permit. 6. Contractors conduct vehicle maintenance at the site. According to you, all such maintenance is performed inside the facility. If vehicle maintenance needs exceed 55 gallons or more of new motor oil per month, Cavaleir Home Builders '27 November 2007 Compliance Evaluation Inspection/Notice of Violation Page 3 of 3 then there are analytical monitoring requirements in the permit that you must accomplish. You must keep a good accounting of the amount of new motor oil used monthly so you can determine whether you are required to perform this analytical monitoring. Also, please be aware of your responsibility in regards to the proper disposal of vehicle maintenance wastes produced at your facility; having a contractor perform the maintenance does not necessarily release you from all responsibility regarding the proper disposal of such wastes. If your maintenance requirements place you below the 55-gallon per month threshold, then there are currently no other analytical monitoring requirements in the permit that you must accomplish. 7. Please note that the items in paragraphs 4 and 5 above constitute violations of your permit as well as NC General Statute 143-215.1 and are subject to civil penalty assessments in an amount not to exceed $25,000 per day per violation. Please reply in writing to this Notice of Violation within 30 days of receiving it. Your response must include a list of corrective actions and an implementation schedule for those actions.
