After reviewing your application, we have decided that this is covered by the Neuse River buffer rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. TE, _ RE: Pine Hollow Golf Course Applicability of Neuse Basin Buffer Rules Wake County, NC As per our office meeting on 2/23/01 the purpose of this memo is to request that you provide written documentation of our previous telephone conversation where you indicated that the proposed work on Greens #5 and # 17 were in compliance with the buffer rules since an existing use was present. I am sorry to have to request this information but the engineer has advised us that the locality which issues grading permits will not do so without a letter from your office. Our client plans to revise two existing greens adjacent to ponds. The reason for the revision is that current green design, construction and size do not meet current golf standards. This course is an old one which was built prior to current knowledge of "proper" golf design and construction. The client understands that any new drainage will need to be discharged 50' away from any water subject to the buffer rules and be allowed to diffusely flow through the buffer prior to reaching the stream/pond. The areas affected contain no forest vegetation and are currently maintained in turf to the waters edge. Upon completion of the work there will still be turf at least 50' in all directions from the waters edge. Therefore, there will be no loss of buffer. Some of the work at hole # 17 involves replacing a wood bulkhead with a stone one and re-establishing turf but this is maintenance of an existing structure therefore does not require a 401 Water Quality Certification. In summary, based on our conversation, the project is in compliance with the rules even though there will be grading in Zone 1 of the buffer because of the presence of an existing use and the fact that turf vegetation will be re-established 50' from the waters edge.* Please call if you need further information to provide the letter of compliance requested. *Note: A stone retaining wall will be placed at one green, but it is in an area that currently contains a deteriorating wood bulkhead therefore, there is no new impervious surface being placed in the buffer. There will be 50' of turf re-established landward of all disturbed areas measured from the wall or waters edge as applicable.
