In accordance with your request, Certificate of Coverage Number NCG210200 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. The assistance provided by Mr. Andy Jordan, the safety/Training Manager, was greatly appreciated. The inspection report is attached. Findings during the inspection were as follows: 1. Certificate of Coverage (COC) No. NCG210200 of NPDES general permit NCG210000 was issued to Clayton Homes Inc. - Henderson, to discharge stormwater runoff to Crooked Run, a class B stream, in the Roanoke River Basin. 2. The facility has developed a Stormwater Pollution Prevention Plan (SPPP). It covered all components and met the requirements of the General Permit. 3. It was noted that the facility has not been conducting semi-annual qualitative monitoring at all stormwater discharge outfalls (SDOs) as required by the permit. The facility did conduct semi-annual stormwater facility inspections; however, qualitative monitoring must be conducted at all SDOs once every six months, during a representative storm event. 4. The facility is not required to conduct analytical monitoring because it does not store material piles outdoor and conduct vehicle maintenance on site. 5. All four SDOs were observed during the inspection, they were well maintained and in good condition.
