Mr. Myrl Nisely of the Raleigh Regional Office inspected the lumber mill on March 7, 2009 for
compliance with the above stormwater permit with the help of Gary Webber and Jack Avery. Their help
was greatly appreciated. The mill was in compliance. Please see the attached inspection checklist for
details. The following were highlights:
The areas under the sawmill onto which bark and woodwaste fall are being kept clean by being
picked up daily. Much of this processing area has been put under roof as well. As a result, there
is no detrimental rainwater runoff from this primary processing activity.
No wood chips or mulch are currently stored at the facility. Therefore, the type of material
(whole logs and cut lumber) stored onsite is such that analytical monitoring is not required.
However, qualitative monitoring of both discharge points is to be documented twice a year. An
observation form recently revise by DWQ has been emailed to Mr. Webber. Because he lives
adjacent to the property, he maintains a high level of awareness of how the rainwater looks.
The spill response section of the Stormwater Pollution Prevention Plan (SP3) is generalized.
Explicit details about what to do, whom to notify and where response equipment is located
should be added to the SP3. Likewise, names and telephone numbers for Responsible Parties
should be added to the section that now simply names the positions.
We discussed small improvements in documenting employee training when stormwater topics
are worked into weekly safety meetings. Training should include Spill Response instructions, as
noted in the written SP3.

Plant Manger Mr. John Lucy recently shared with DWQ the beginnings of a Stormwater
Pollution Prevention Plan (SP3) and otherwise gave feedback on progress since receiving
a letter of NOV in early January 2005. We were in the area, so John willingly provided a
tour of the site. The following observations were made:
a 2 or 3 ft diameter area of oily soil inside a maintenance building has been
improved somewhat since the January inspection, and had fresh oil-dri sprinkled
on it. Because this location is sheltered from rain, it seems acceptable to leave
the soil in place, but continue to improve the oil handling to avoid any new spills.
a ditch serving the area below debarking exits to a stream branch. John and his
consultant should establish whether this is genuinely an outfall to be sampled and
clearly identified on maps and narrative in the SP3, or whether it joins other
runoff conveyances. The fewer the outfalls, less sampling and analytical costs
will be required.
• near the front of the site are fuel tanks within a block wall containment structure,
the outside of which is painted blue. Several blocks have been dislodged, so
rehabilitation of that structure is needed.
• we emphasized the importance of employee training. Ideally, sessions should be
more frequent than annually as required by the permit so that employees buy in
to the importance of reporting and correcting problems they observe. Many
facilities insert awareness training into periodic safety meetings, for example.
John asked about training materials, perhaps from the internet. There are

a compliance evaluation inspection at Clary Lumber. Your discussion pertaining to compliance
with your stormwater permit number NCG210196 was appreciated. The permit was issued to you
May 1, 2003 and expires April 30, 2008. Mr. Nisely reviewed, and left with you, a checklist
summarizing the components of the permit. You are strongly urged to read the permit itself
carefully and carry out its requirements. The permit text is available at:

Observations were as follows:
Essentially the permit conditions have not been carried out. No Stormwater Pollution
Prevention Plan has been created, nor was there evidence of other components of the permit
such as employee training, records of qualitative inspections or a housekeeping plan.
• . A cursory tour of some of the buildings onsite showed patches of oil soaked soil that will
need to be cleaned up. The permit will guide on how to better handle materials that are
potentially a threat to pollute rainwater.
You agreed to begin taking steps to come into compliance. There are resources, particularly
consulting firms, that can guide you in this process. Please respond within 30 days of
receipt of this letter with the specific steps you plan to take.

Among other purposes, the stormwater permit is intended to bring a heightened awareness of
stormwater concerns to all employees at the facility. One outcome should be a commitment by
every employee to regularly carry out Best Management Practices (BMPs) that organize the
handling and storage of potential pollutants, and knowing proper response when they observe
polluted water on the site. Managing production activities correctly will protect the environment
and help Clary Lumber avoid enforcement fines.

Mr. Nisely,
I apologize for doing this at the last minute but I have been delayed due to
illness. I will be happy to document any of this information on company
letterhead but wanted to get you something by February 25th as I had agreed
to do.
After investigating what has occurred it appears that we had a plan that had
been implemented according to our permit. It is also my understanding that
the Town of Gaston applied for a federal grant to re -work the drainage on
Grant Street which our property borders on both sides. This re -work would
have handled the run-off from most of our site. Although the Town of Gaston
did work on Grant Street, apparently they did not complete the entire
project as planned due to a lack of funds. I am still not completely clear
on all of what occurred with the Town of Gaston but I am following up to get
more details.
We still have not been able to find the sampling documents which I am told
the previous manager put in storage. We were also missing documents related
to OSHA compliance but have found many of those and as with the stormwater
information, we are re-creating those that we cannot find. We still have
some storage boxes to inspect but at this stage I am not sure it is worth
the effort since we are developing new information anyway.
Steps we have taken to date are:
1. Removed excess or used lubricants to minimize the potential for a spill
and cleaned up the small patches of what may have been spilled lubricants
that you saw when you were here. This was handled for us by our supplier of
lubricants.
2. Ordered needed containment barriers in case of a spill.

3. Retained the services of Thomas Freeman Consulting to assist us with
developing a worst case Ian which makes the assumption that the Town of
Gaston will take no further action. Mr. Thomas Freeman, CPESC has developed
a stormwater pollution prevention plan for our facility, a copy of which is
attached. Mr. Freeman just received the topographic maps needed to do the
sizing of the controls and this is expected to be complete within 14
calendar days so that we can begin implementation of Best Management
Controls.
4. Assembled our plan in a notebook which includes training forms and
monitoring reports, and I have included photos of this notebook for
validation of its existence. we will attach all maps and subsequent
documents to our plan as we receive them and will forward a final copy of Ajii�:-u.'
the complete plan to you for your records.
As we discussed on the phone this entire process is somewhat new to me, but
we are moving forward to ensure compliance with our permit through use of
the outside consultant. If there is something that you feel is missing from
the steps we are taking please let me know so that we can take the necessary
steps to become and remain compliant.

Location
The Plant area is located in Northampton County, North Carolina on
Mitchell Street and North Carolina Highway 46 in Gaston. The Plant area is
within the City Limits of the Town of Gaston, North Carolina.
Site Description
Clary Lumber Company is located on 2 multi -acre lots located off North
Carolina 46 on Mitchell and Grant streets. The site consists of 2 saw mills, a
maintenance and storage building, office complex, log yard and debarking
operation at the end of Mitchell and Grant streets and a pallet shop, log
unloading and handling and storage facility are south of Grant street.
Operation
The plant operation consists of two sawmills one old and one new which is
the center of the operations. Logs are trucked to the site, weighed, unloaded
and stored in the log storage area (log yard) for use as feedstock for the
sawmilling operation. Logs are taken from the storage area to the debarker
and then processed through the mills. Finished lumber produced by the
mills are stored for shipment or taken to the pallet shop for processing as
pallets. Vehicle maintenance is performed at the maintenance building or at
an offsite location. All bark produced from debarking operation is recycled
offsite and transformed into mulch. All sawdust produced in the sawmills
are used as boiler fuel offsite.

Pollution Prevention Team
The Pollution Prevention Team shall consist of the following personnel:
• General Manager
Duties: Supervision of activities, inspections, and
implementation of this plan and sampling.
• Mill Supervisor, Cut Supervisor and Pallet Shop Supervisor
Duties: Operation, construction, inspections, maintenance, and
implementation of this plan's procedures, and required
documentation.
• All Employees
Duties: Any actions deemed necessary to ensure the effectiveness
of the team and this plan as specified by management.
Potential Pollutant Sources
The following is a list of potential pollutant sources located at this site.
• Lubricants from equipment operations
• No. 2 Diesel Fuel
• Dust from roadways and storage areas
• Debris and litter
• Soils washed from log storage area and travel ways

No materials other that soils, sand and stone in the log storage area and the
roadways will be exposed to precipitation and/or stormwater runoff. Runoff
from these sources will be directed to sediment basins via open ditches and

berms. Spare parts, lubricants, and other materials needed for the plant will
be stored in the maintenance building or in area where precipitation and
stormwater runoff cannot come into contact with them.
Drainage from the production areas will be directed to sediment basins and
other best management controls located throughout the plant site. No
collected or concentrated flow will be allowed to exit the site without first
going through a sediment basin or other BMP control. Stormwater runoff
from buildings and equipment will be collected and treated by passage
through a BMP control. The plant area will be kept clean so that no runoff
comes into contact with minimal pollutants. Sheet flows are not covered by
stormwater regulations and will not be part of any treatment system unless
concentrated.
There is no historical evidence of any significant spills or leaks at this plant
site.
Measures and Controls
The plant operations site shall be maintained in a neat and clean fashion to
include (but not be limited to) the removal of built up dusts, soils, fluids
spillage, trash, used parts and equipment (except in designated areas), empty
containers and other debris which not only look bad but can be conveyed to
adjacent property or clog BMP controls. Records of stormwater monitoring
reports and checks of the area shall be kept on the sampling data sheet
included in this manual.

Maintenance Plan
1. All control will be checked for stability following each runoff producing
rainfall but in no case less than once every week. Any needed repairs
will be made immediately to maintain all controls in an effective
condition.
2. Sediment and other materials will be removed from basin and/or ponds
when the storage capacity has been 50% filled. Gravel used as filtering
media will be replaced and/or cleaned when the control structure no
longer drains properly.
3. Berms will. be checked for stability, and repaired as needed to keep them
in effective condition. Sediment or other materials collected behind any
berm shall be removed if there is any danger of runoff breaching the
berm due to buildup.
4. All vegetated areas will be fertilized, reseeded as necessary and mulched
according to specification, to maintain vigorous dense vegetation cover
in areas subject to erosion.
5. All road surfaces will be checked for slope and proper drainage. Roads
with hard solid surfaces will be cleaned of spillage and carry on.
6. Oil absorbing socks and or mats will be kept onsite and utilized when
and or if oil is spilled or is visibly evident in a sediment basin, pond or
other control measure

In the event of a spill or leak on site, the following procedures should be
used:
• Utilizing berms, ditches or any other temporary measure, contain the
spill in the smallest area possible. Keep spills separated from other
materials and runoff as is feasible.
• Notify members of the Pollution Prevention Team.
• Upon assessing the extent of the spill or leak, begin remediation
utilizing necessary measures. Since the major risk for this operation
would be a fuel or lubricant leak or spill, oil absorbing socks or pads
should be stored onsite and utilized.
• Spill collection media shall be disposed of in an appropriate and
environmentally sound manner, compliant with State, Federal and
local regulations.
• ,Any such actions shall be recorded in this stormwater Plan.
Employees shall be trained in spill/leak remediation procedures as part of the
implementation of this prevention plan. All facility personnel should be
familiar with their role in the prevention of any spill and the proper steps to
take in case of any spill. Employee training shall become part of this plan
and all training shall be documented.

Best Management Practices
Storm water will be directed from the plant and storage areas by positive
drainage. This will be accomplished through ditches, culverts, berms and
sediment basins. The control measures, structure sizes and general locations
will be added to this plan when all the structure and conveyances are
constructed. Flow patterns and control measures will be shown on a BMP
drawing and shall be reviewed annually and revised as necessary.
Sampling Techniques
Clary Lumber employees or qualified contractors as directed by
management should collect the actual stormwater sample as specified in the
attached permit. Because the facility uses less than 55 gallons of oil per
month only qualitative monitoring is required in the spring and fall (see
attached permit). This qualitative monitoring will be for color, odor, clarity,
floating and suspended solids, foam, oil sheen and other pollutants.
If samples are taken for analytical testing, the sampling method to be used
will be a simple grab sample. Upon the result of a representative rainfall
event (stormwater discharge, as specified in the permit) a grab sample of the
discharge will be taken by cutting perpendicular to the discharge flow with
an open mouth container. Several cuts should be taken to create a more
representative sample (as directed by the permit language). The sample
container shall be labeled with the day, date and time of collection, sample
location point and any other required information. The sample shall be
stored in a cooler when collected and stored at 4 degree C or below until
analyzed by a certified laboratory. Testing for pH, temperature and some

parameters may be required at the time of collection and will be discussed in
the permit. Results from all sample testing will be recorded in the BMP
manual and reported to the necessary agencies.
Physical samplings of discharges are determined by the actual permit
requirements. Visual inspections will be made once a week for all control
measures. All visual inspections will be recorded in this plan along with any
maintenance or corrective actions taken.
Guidelines for sampling frequency, threshold limits guidelines and reporting
requirements are outlined in the stormwater permit, which is included in this
Plan.
Comprehensive site compliance, evaluation and inspection
Once per year, qualified personnel shall inspect the plant site to assess the
adequacy of the stormwater pollution prevention controls. Any changes or
modifications shall be noted in this plan.
Housekeeping
To prevent pollutants from entering stormwater runoff good housekeeping
practices shall be observed by all employees. Spills and leaks shall be
cleaned up immediately and all cleanup materials disposed of immediately.
Discarded used parts that have oil on them shall be disposed of immediately
in an approved manner. Floor sweepings from maintenance and process
areas shall also be disposed of immediately. Paper trash, beverage cans and
bottles and other debris created in break and lunch area shall be placed in
covered containers to prevent wind scattering.

Division of Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This
permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection
Agency, dated December 6, 1983.

This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS § 143.215.1 (c)(1) which
stales "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or. the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. A valid reason for
requesting rescission is required, incomplete forms will be returned and you will still be subject to possible
escalated action. Mailing instructions for submitting rescission request are listed on the bottom of the form. You
will be notified when the rescission process has been completed.

Payment of the required annual administering and compliance monitoring fee of $80.00 for this year has not
been received for the subject permit. This fee is required by Title 15 North Carolina Administrative Code 2H.0105, under
the authority of North Carolina General Statutes 143-215.3(a)(1), (1a) and (1b). Because this fee was not fully paid within
30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 15 ncac 2H.0105(b) (2) (k)
(4), and G.S. 143-215.1 (b) (3).
Effective 60 days from receipt of this notice, subject permit is hereby revoked unless the required Annual

NCGO40000, the Division of Water Quality (DWQ) is forwarding herewith the General Permit
NCG210000 which is anew General Permit to cover most of the Timber Products Industry. You
have now been given coverage under NCG210000 and your coverage under NCGO40000 is hereby
terminated. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection Agency dated December 6, 1983.
The following information is included with your permit package:
■ A copy of the stormwater general permit NCG210000.
■ A new Certificate of Coverage under general permit NCG210000.
■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit (both NCGO40000 and NCG210000). This form must be completed and returned to the
Division within 30 days of receipt of this letter. DO NOT send the SPPP with the signed form.
■ Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program which outlines program components
and addresses frequently asked questions.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.
