Box 590 Raleigh, NC, 27602 APPROVAL of Neuse River Buffer Rules Dear Mr. Sykes: You have our approval to conduct the Ashe Avenue Culvert at Rocky Branch culvert and channel maintenance project in Wake County. This application was received by the Division of Water Quality on March 12, 2001. This approval is valid for the Neuse River Buffer Rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions of the Neuse River Buffer Rules. If you do not accept any of the conditions of this approval, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This approval and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under the Neuse Buffer Rules. Ashe Avenue Culvert Maintenance Along Rocky Branch Raleigh, North Carolina Overview The City of Raleigh and the State of North Carolina Department of Transportation (NCDOT) routinely inspect the culverts and bridges along their respective roadway systems. NCDOT inspected Western Boulevard and noted that the culvert under Ashe Avenue needed maintenance. This culvert conveys Rocky Branch and is in close proximity to an existing business (convience store). The City of Raleigh Street Maintenance staff followed up with their own inspection and agreed with the necessary maintenance to the culvert and channel. Maintenance The City of Raleigh would like to perform maintenance of the culvert end, wingwall, and channel immediately downstream of the culvert. The City of Raleigh would will be using small rubber tired equipment to access the site and make the necessary repairs. The repairs are as follows: • Culvert endwall, wingwall, and existing retaining wall: The culvert wall foundation will be stabilized and scour hole will be filled to stabilize structures. The retaining wall to the west will also be stabilized in a similar manner. • Erosion: There are several locations of severe scour. The areas that we will focus on will be 11 the wingwall and slope on the east side of the culvert and along Pullen Park Road; 2) the area just downstream of the retaining wall behind the existing business on the west side of the culvert. The City of Raleigh feels as though these repairs are necessary in order to better stabilize the downstream area, save the culvert end/wingwall section and retaining wall and to protect the existing business.
