NCG210195 received October 11, 2013, the Division of Energy, Minerals and Land Resources
(DEMLR) is forwarding herewith the reissued Certificate of Coverage and stormwater General
Permit. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S.
Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.)
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of the stormwater General Permit
• A copy of a Technical Bulletin for the General Permit
• Copies of the Discharge Monitoring Report (DMR) Form
• Copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with
respect to stormwater discharge controls, management, monitoring, and record keeping. Please
review the new permit to familiarize yourself with all changes in the reissued permit. Significant
changes to the General Permit are outlined in the attached Technical Bulletin.
Your coverage under the General Permit is transferable only through the specific action of DEMLR.
This permit does not affect the legal requirements to obtain other permits which may be required by
NCDENR, nor does it relieve the permittee from responsibility for compliance with any other

Protection Agency dated December 6, 1983.

■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit (both NCGO40000 and NCG210000). This form must be completed and returned to the
Division within 30 days of receipt of this letter. DO NOT send the SPPP with the signed form.
■ Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program which outlines program components
and addresses frequently asked questions.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area

I talked to Mr. Walters today (919-920-0457). He said that he did get my email but he didn't remember
an attachment that he was supposed to sign. It would have got his permit reinstated since he had paid
the invoice in July of this year. He made it very clear that he did want the permit to stay in his name. He
explained that he had a stormwater management plan and would check on it to make sure he was
following it. Since you talked to Mr. Wiggins (252 349 5017 is the number I got from Mr. Walters),
would you please call him and tell him that he does not need to send in an NCI because Mr. Walters was

Samir said to give Mr. Walters 3 options.
1. take responsibility for the permit
2. rescind the permit
3. creat a lega document saying that you are giving the permit to Mr. Wiggins and that he will accept it.
• Most people transfer a permit to the person they sell the land to.
• The transfer form that we use is designed for that
• We can allow you to transfer the permit to Mr. Wiggins but if he defaults, the land owner is
always responsible.
• We will have to prepare a form and you will have to get a lease agreement with the operator.
• If you transfer the permit, our folks will come down to look at the facility before they will allow
it. To make sure there is not any damage done.
• You could have an agreement written that you will continue the permit but he will be
responsible for any damage done or permit violations.

Ken Wiggins, [252-349-5017] current owner of timber operation, called today ( 4/23) & wants to discuss
sw permit requirements and NOI application. I told him that Thom will contact him by phone to set up a
site visit to answer questions & assist with NOL See me for additional info.
I talked to Bradley about the fact that the form only allows for change of ownership if there is a deed
change. He said we would need some type of form saying that he was renting to the other man but he
wasn't sure about that. He said it would be much better for the other man to apply for a permit. He
didn't say I couldn't but he acted like he was never aware of it happening when someone was only
renting,the facility.
I talked to Mr. Walters today. He agreed that it would be easiest for him to transfer the permit to mr.
Wiggins and let him operate under the permit. I asked Bradley about what to do with the status being
"inactive" because of the billing mixup. Bradley said that that would all be worked out when the permit
name/ownership change was made.

I'm not sure why this is still in there as expired as this should have been taken care of during the clean
up last year. I believe that the Point Source Branch considers making a payment a "renewal" so you
could go ahead and renew under the same COC but they would be covered under the current general
permit.

I think you are right about us not being able to update someone's COC if the permit had been classified
as "inactive." However, since this permit is "expired" and no one has gone in and call it "inactive",
Robert said he thought we could just get him to ask for coverage under the newer permit. Robert said
he thought our policy was that if the permit fee was still being paid, even though the permittee failed to
renew the permit, that we allowed the permit holder to renew the permit if he chose.

Samir and Thom Edgerton called me today 4/18/13 to tell me about stopping by the Neuse river Lumber
company site. They said that on the back of the site, there is a fairly substantial lumber operation that
should have a stormwater permit. They asked me to call Mr. Walters and talk to him. Mr. Walters said
that someone in Raleigh (probably me) told him that he was ok. I need to tell mr walters that he can re-

up his permit if that is possible. I'm also supposed to find out if we can reup a permit and if not, why
and tell Thom. I told Samir and thom that Mr. Walters had been paying his bills although he didn't have
an active permit.
Mr. Walters had told me that Kenneth Wiggins now operated a lumber mill at the site.

The land owner, Larry Walters, called me because he had been paying his annual fees on his general
permit but we had listed him as inactive. 1 expect that he's never renewed his permit because I did not
see any note in bims of his permit being renewed since it expired in 2008 or so. He told me that he had
closed down the site a few years ago but he was renting part of it (maybe all) to someone that had a
"Wood miser" operation or something like that. I guess if Larry wanted to continue his permit
coverage, we should contact him and tell him to apply.???
As for the present operation, he says he is renting it to Kenneth Wiggins — Wiggins Lumber. I did not see
anything in BIMS by that name so he probably doesn't have a permit. I'll let you decide what to do on
that.
I believe that Larry's cell is 919-920.0457 . I'm not sure because he always told me to call him at home
(maybe that's his home number) but that he nor his wife were ever at home before 5pm.
Let me know if I should send him a renewal form so he can get his permit back.

Samir & I discussed your email from last week regarding Neuse River Lumber. Please see the following
comments:
(1) BIMS shows NCG210195 for Neuse River Lumber Co as expired, but annual fees have been paid
since 2003.
(2) Google Earth shows what appears to be an active lumber operation on Casey Mill Rd near
Goldsboro.
(3) Samir & I passed by an active lumber operation in this general area on our way to another site
inspection nearby. We made a note of the location & planned to visit this site on our next trip
to the area to determine permit status. At the time, we were unaware that this operation
existed; this may be Neuse River Lumber (to be determined) ?
(4) 1 saved two template letters from Jennifer Jones regarding dormant facilities & monitoring
requirements that may be appropriate for this operation. They are 11/18/11 document that
suspends monitoring requirements while dormant; and 2/8/12 document that denies "dormant
status' based on staff investigation. Will forward those emails to you with the templates.
This appears to be a relatively small, privately owned type operation. This operation may have changed
owners & to my knowledge, no site visits by DWQ in the past. Generally, smaller operations do not have
a specially "designated environmental staff person" which means they quite often count on our
experience & advice regarding stormwater permitting requirements. Based on these circumstances, I
think it would be appropriate for us to conduct a site visit; determine current operational status and
then properly advise the current owner about their stormwater permit requirements. If you have
additional info, please advise. Questions ?

An Environmental Permitting Fact Sheet
No person may act tinder a Department of Energy and Environmental
Introduction Protection (DEEP) license issued to someone else unless such license
has been transferred to such a person. A transfer is only effective if
DEEP notifies the licensee and proposed transferee that the license has
been transferred. The licensee and proposed transferee must register the
proposed transfer of ownership of a licensed facility or activity within
30 days of the transfer. For the transfer of Resource Conservation and
Recovery Act (RCRA) permits, the licensee and proposed transferee
must register the proposed transfer of ownership within 90 days of the
transfer. Note that no person may conduct an activity requiring a permit
from DEEP without first obtaining a permit.
Section 22a-6o of the Connecticut General Statutes (CGS). If you are
Authorizing Statutes applying for a transfer of a RCRA permit, a National. Pollutant
Discharge Elimination System (NPDES) permit, or an Air permit, the
transfer must also be consistent with the requirements of applicable
federal law.

Comment: The Owner was not present during inspection, but will be contacted for
additional information. The inspection was in response to a rescission request. The
office is vacant, although upon inspection, the back section of the site is being operated
as a cedar log to lumber mill and storage/curing operation. There are saw dust piles,
waste wood pile(s) and lumber storage bundles stored on much of the property. The
trailer mounted mill appeared to be fully operational. A new large generator (still
protected with plactic) has been recently set up, somewhat permanantly in one of the
timber onsite buildings near the center of this back operational section. Additional
information will be gathered and I will update this inspection w/ the findings asap.

NCG210000 which is a new General Permit to cover most of the Timber Products Industry. You
have now been given coverage under NCG210000 and your coverage under NCGO40000 is hereby
terminated. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection Agency dated December 6, 1983.
The following information is included with your permit package:
■ A copy of the stormwater general permit NCG210000.
■ A new Certificate of Coverage under general permit NCG210000.
■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit (both NCG040000 and NCG210000). This form must be completed and returned to the
Division within 30 days of receipt of this letter. DO NOT send the SPPP with the signed form.
■ Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program which outlines program components
and addresses frequently asked questions.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.
