In accordance with this information, NPDES General Permit NCG210160 is rescinded, effectively immediately. Please be advised that this permit rescission is based wholly upon the activities which would require general permit coverage at the site have ceased or been eliminated. Division staff has not visited the site to obtain independent verification. Operating a treatment facility, discharging wastewater or discharging stormwater to waters of the State without a valid NPDES Permit will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES Permit. The Division apologizes for the delay in addressing your permit application. The wastewater generated from this facility is not eligible for coverage under general permit NCG500000, as a result of the wet decking process water. Currently, the Division is assessing whether an individual NPDES permit or non -discharge recycle permit is applicable to this facility. It is the Division's understanding, that boiler blowdown and stormwater is sprayed onto logs for mold control and that the runoff is collected in an on -site pond. Discharge from the pond only occurs in response to a rainfall event. If the facility can demonstrate that the pond discharges only in response to a rainfall event greater than 25-yr/24-hour storm, the system can be classified as a recycle system. If the facility cannot demonstrate that the pond discharges only in response to a rainfall event greater than 25-yr/24-hour, a NPDES permit would be required. As part of the NPDES permitting process the facility would be required to complete an Engineering Alternatives Analysis. The Engineering Alternatives Analysis examines the feasibility of non -discharging options. The analysis would include a cost analysis for increasing the capacity of the pond to handle a 25- yr/24-hour rainfall event without discharging. It is the Division's preference, that where feasible that a non -discharge option be implemented. Guidance for the complete Engineering Alternatives Analysis can be found on the Division of Water Quality's web site the URL listed below. In addition, to the Engineering Alternatives Analysis requirement the individual permitting process includes a 30-day public notice period, and a $715.00 annual fee.
