Dear Mr. Weygoldt:
The Division last contacted you on December 18, 2008 to request that you apply for a State Stormwater permit for
the Blackcat Marina after we were notified that you had applied for a CAMA Major permit. After talking with Mr. Don
Quinn at the Clark Corporation, it was determined that your facility located on Lennoxville Road in Beaufort already
had a State Stormwater permit which was issued in 1991, but not named "Blackcat Marina". In order to complete the
required modifications, you will need to apply to modify your existing State Stormwater permit, SW8 910105. Permit
number SW8 081216 was assigned to you for this project, but will be voided since we now know there is already a
permit for this site. I have enclosed a copy of our permit file for your convenience.
The "Certification of Compliance with Stormwater Regulations" issued in 1991, which we now refer to as a "permit",
allowed 22.33% built upon area. It was issued under the low -density option of the Coastal Rule, 15A NCAC 02H
.1003(a)(2), effective in 1988, This law allowed for a maximum of 25%. built upon area (BUA) within a half -mile of
and draining to shellfish waters (class SA waters). Your permit modification will have two options for compliance:
1.) If the new site design's BUA <22.33%: You may apply to be permitted as a minor modification to the
existing low -density permit under the 1988 rule. This Administrative Code has changed twice since
1988, once in 1995 and again in 2008. If you apply for a new permit (under the 2008) rules, your site
will be considered low density only if the BUA is <12%.
2.) If the new site design's BUA >22.33%: You must apply to be permitted as high density under either
the 1988 or the 2008 rule. (The 1988 rule required control and treatment of the first 1.5 inch of
water. The 2008 rule requires control and treatment of the greater of the 1.5 inch or the difference in
pre and post development for the 1-year, 24-hour storm.) For high density under either rule, you
would have to construct structural stormwater Best Management Practice(s) (BMP(s)), such as wet
ponds, to treat your stormwater.
There are technical considerations for the SW8 910105 modification for either option to discuss with your consultant.
Additionally, you must also comply with your National Pollutant Discharge Elimination System (NPDES) General
Stormwater Permit, NCG 210050.
