Taylor Road Henderson, North Carolina 27536 Illegal Discharge/Unpermitted Facility Vance County Dear Mr. Sadler: This letter is being sent to address an illegal discharge that was reported to the Division of Energy, Mineral and Land Resources (DEMLR) on December 13, 2013. The concern is the lack of an NPDES stormwater permit and the required monitoring for a facility of this type. A site visit was conducted on December 20, 2013. Dave Parnell, of the DEMLR Raleigh Regional Office conducted the site visit, after receiving the complaint. During the site visit, it was observed that a large number of salvaged vehicles were being stored on the site. Mr. Parnell spoke with an employee by the name of Curtis, who stated that he thought the City of Henderson was involved with the facility's stormwater program. A business card was received that stated that the facility buys steel, copper, aluminum and brass. Therefore, it is apparent that a facility such as this, requires a NPDES Stormwater permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other federal or local governmental permit that may be required. Checking under Sadler's Recycling Center (name on the business card given to Parnell), there was no facility in BIMS by that name and no one on site this day could give documenation that the facility has a stormwater permit. After calling the facilty and receiving no documentation of permitting, a letter was issued asking for the facility to be permitted. Parnell made the decision not to issue an NOV or NOD but in effort to prod them towards compliance.
