In compliance with the provision of North Carolina General Statute 143-215.1, other lawful
standards and regulations promulgated and adopted by the North Carolina Environmental
Management Commission, and the Federal Water Pollution Control Act, as amended,

to receiving waters designated as an UT to Sandy Creek, a class C; NSW:+ water in the Tar -
Pamlico River Basin, in accordance with the effluent limitations, monitoring requirements, and
other conditions set forth in Parts I, 11, III, IV, V, and VI of General Permit No. NCG200000 as
attached.
This certificate of coverage shall become effective December 7, 2012.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

Illegal Discharge/Unpermitted Facility

Dear Mr. Sadler:
This letter is being sent to address an illegal discharge that was reported to the Division of Energy, Mineral and
Land Resources (DEMLR) on December 13, 2013. The concern is the lack of an NPDES stormwater permit
and the required monitoring for a facility of this type. A site visit was conducted on December 20, 2013. Dave
Parnell, of the DEMLR Raleigh Regional Office conducted the site visit, after receiving the complaint.
During the site visit, it was observed that a large number of salvaged vehicles were being stored on the site. Mr.
Parnell spoke with an employee by the name of Curtis, who stated that he thought the City of Henderson was
involved with the facility's stormwater program. A business card was received that stated that the facility buys
steel, copper, aluminum and brass. Therefore, it is apparent that a facility such as this, requires a NPDES
Stormwater permit.
Please note that the release of stormwater from an unpermitted used motor vehicle or scrap metal facility is a
violation of the following North Carolina General Statutes:

In accordance with your application for a discharge permit received on October 30, 2012, we
are forwarding herewith the subject certificate of coverage to discharge under the subject state -
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
Per the requirements of the Tar -Pamlico Riparian Buffer Rule, all stormwater drainage to
stream buffers, from portions of this site that have been constructed after January 1, 2000, must be
discharged through a correctly designed level spreader or another device that meets diffuse flow
requirements per 15A NCAC 26.0259. Diffuse Flow requirements are described in Chapter 8 of the
North Carolina Stormwater BMP Manual, available at:

This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land Resources,
Coastal Area Management Act or any other federal or local governmental permit that may be
required.

Inspection Summary:
Following up on a complaint that oily sheered stormwater was leaving this site, Dave Parnell visited the site. Checking
under Sadler's Recycling Center (name on the business card given to Parnell), there was no facility in BIMS by that name
and no one on site this day could give documenation that the facility has a stormwater permit. After calling the facilty and
receiving no documentation of permitting, a letter was issued asking for the facility to be permitted. Parnell made the
decision not to issue an NOV or NOD but in effort to prod them towards compliance. On April 21, 2014 a copy of the
letter was sent to DEMLR and a copy of the permitted in the name of Sadler Salvage Yard dated 12-7-12. drp

NCGS 143-21 5.l (a) Activities for Which Permits Required. -No person shall do any of the following things or
carry out any of the following activities unless that person has received a permit from the Commission and has
complied with all conditions set forth in the permit:

document filed or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false
statement of a material fact in a rulemaking proceeding or contested case under this Article; or who falsifies, tampers with, or knowingly
renders inaccurate any recording or monitoring device or method required to be operated or maintained under this Article or rules of the
[Environmental Management] Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine not to
exceed ten thousand dollars ($10,000).
