Yours and Jim Frei's assistance with this inspection was greatly appreciated. Below is a list of findings and recommendations developed from the inspection: 1. The subject permit was reissued and became effective January 01, 2010 and will expire December 31, 2014. Request for permit renewal is required 180 days prior to permit expiration date. 2. The Facility is a buyer of scrap iron, aluminum and other metals. The scrap yard has one distinct Stormwater Discharge Outfall (SDO). Stormwater from the one half of the scrap yard sheet flows into a grass swell with a silt fence installed on the scrap yard side. Hay bales are placed approximately 20 feet apart in the swell. There was no discharge at the time of inspection. There was visible staining in the swell. Stormwater on the other side of the scrap yard sheets flows to a wetland area. There is no visible SDO. A pile of vehicle parts is situated approximately 30 feet from the edge of the property near the sediment basin that receives stormwater runoff. There was oil staining at and around the pile of vehicle parts. The contaminated soil must be removed and properly disposed of and the area returned back to its original state. Failing to collect and remove the discharge of oil is a violation of NC General Statute 143-215.84(b) and is subject to enforcement action. 3. The Stormwater Pollution Prevention Plan (SPPP) was available for inspection. All conditions of the SPPP are being maintained. 4. Analytical results were above benchmark values for Zinc, Copper and Cadmium for more than 9 consecutive times. This would put the facility in Tier 3 monitoring requirements. DWQ received a petition to reduce the frequency of analytical monitoring from the Stormwater Services Group, LLC and stated that the Permittee cease monthly Tier Two monitoring effective June 30, 2011 and continue semi-annual analytical and qualitative monitoring effective October 01, 2011. Failing to complywith all conditions of permit NCG200000, COC NCG200446 is a violation of the Clean Water Act and subject to a Civil Penalty. This office acknowledges the BMPs that were implemented to reduce metals concentration. Currently, this facility is conducting monthly monitoring per Tier Two requirements. This facility has not been able to consistently reduce some metals below the Benchmark Values (see Table 1). While the concentrations have been lowered over the past two years, there are no additional feasible BMPs that could be implemented to reduce these metals much further. We believe this Permittee's funds could be better spent maintaining the implemented BMPs instead of on analytical monitoring costs. BMPs currently installed include multiple haybales in the grass -lined ditch and a silt fence installed parallel to the ditch (see Figures 1 thru 4); samples are collected at the downstream end of this ditch. The haybales act as an oil & grease absorbent and trap sediment and metal particles. The silt fence traps sediment flowing off the scrap yard before it reaches the ditch. The haybales are replaced every six to eight months; the old haybales arc disposed in a landfill. The silt fence has not been replaced since it was installed during the first quarter of 2010, but it is maintained and repaired as needed. Other implemented BMPs include storing copper metal and scrap batteries indoors, and frequent cleaning of oil drips that occur where certain scrap items are accumulated. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. , If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Due to resource constraints, the Division has been unable to adequately consider appropriate modifications to the permit.
